Meeting Called To Order The Mayor called the Committee of the Whole Open Session Meeting to order. 1.0. Agenda Items Moved by Deputy Mayor McAlary, seconded by Councillor Armstrong: RESOLVED that the agenda for Monday, March 6, 2017 be approved with the removal of item Tendering Process—Bidders list from Committee Closed session and its inclusion in Committee Open Session. MOTION CARRIED. 1.1 Provincial Legislation Update (Open Committee of the Whole Session) The Deputy Clerk outlined highlights of the new Local Governance Act and the Community Planning Act noting that the comments are preliminary and not comprehensive. Moved by Deputy Mayor McAlary, seconded by Councillor MacKenzie: RESOLVED that the Mayor be authorized to write a letter to the Minister of the Department of Environment and Local Government stating that the City of Saint John is reviewing the new legislation, the Local Governance Act and the Community Planning Act and we expect to be provided adequate time to respond with our feedback that will be forthcoming in more detail. 2017-2 Committee of the Whole Meeting Open Session March 6, 2017 LT A100000114L1:k]k]11191 1.2 Tendering Process Construction Contracts - Bidders List The City Engineer commented on the risks that would be taken publishing the bidders list that could affect contract pricing. Councillor Norton commented that he wanted to go on the record stating the item should be discussed in Regular Session in the Council Chamber. Moved by Deputy Mayor McAlary, seconded by Councillor Sullivan: RESOLVED that Committee of the Whole recommends Common Council direct the Chief City Engineer to advise the Saint John Construction Association that the City will continue its existing Tendering Policy For Construction Contracts regarding not releasing the names of those companies who have taken out tender documents. MOTION TIED with Councillors Reardon, Norton, MacKenzie, Strowbridge, and Armstrong voting nay. The Mayor broke the tie voting in favour of the recommendation. MOTION CARRIED.
