1. Meeting Called To Order
The Mayor called the Committee of the Whole Open Session Meeting to order.
1.2 Discussion of Confidential Matters
Moved by Councillor McAlary, seconded by Councillor MacKenzie:
RESOLVED that the public be excluded from the meeting for the duration of the discussion on
the following Matters: 1.1 Land Matter 10.2(4)(d); 1.2 Employment Matter 10.2(4)(j); 1.3
Financial Matter 10.2(4)(c); 1.4 Financial Matter 10.2(4)(c); 1.5 Land Matter 10.2(4)(d); 1.6
Financial Matter 10.2(4)(c); and 1.7 Contract Matter 10.2(4)(c).
Record Pursuant to Section 10.2(4)
Councillor Sullivan questioned why items 1.4 Financial Matter 10.2(4)(c); 1.6 Financial Matter
10.2(4)(c); and 1.7 Contract Matter 10.2(4)(c); were inserted on the Closed Session agenda
rather than the Open Session agenda.
The City Manager commented it is the prerogative of Council to conduct all matters in public
session. Staff reviewed the placement and decided the appropriate forum was the in-camera
session for the following reasons:
1.4 Financial Matter 10.2(4)(c); Is a quasi judicial process that involves legal advice, and has a
series of financial implications that affect the City.

1.6 Financial Matter 10.2(4)(c); The matter requires a legal opinion.
1.7 Contract Matter 10.2(4)(c); There is onging legal dispute concerning the contract.
Councillor Sullivan stated he was satisfied with the City Manager's opinion on these items being
held in-camera.
The meeting of the Committee of the Whole of Common Council held on August 8, 2016 was
closed to the public pursuant to Section 10.2(4) of the Municipalities Act during the
Committee's discussion of the following matters: 1.1 Land Matter 10.2(4)(d); 1.2 Employment
Matter 10.2(4)(j); 1.3 Financial Matter 10.2(4)(c); 1.4 Financial Matter 10.2(4)(c); 1.5 Land
Matter 10.2(4)(d); 1.6 Financial Matter 10.2(4)(c); and 1.7 Contract Matter 10.2(4)(c).
