This meeting has been called in response to the Covid 19 situation and the State of Emergency declared by the New Brunswick Government on March 201h The continuity of Local Government is imperative in a State of Emergency. Due to the current restrictions on public gatherings, it is necessary for Council to have the ability to participate in a meeting remotely. By holding an Emergency Meeting Council is able to give 3 readings on March 23rd of an amendment to Council's procedural bylaw which would permit the remote participation by Council members in a Council meeting. Public Hearings 6:30 PM 9.1 Proposed Zoning ByLaw Amendment — 399 Burchill Road with Staff Presentation and Planning Advisory Committee report recommending Approval (1St and 2nd Reading) The Common Clerk advised that the necessary advertising was completed with regard to rezoning a parcel of land with an area of approximately 995.1 hectares, located at 399 Burchill Road, also identified as being a portion of PID Number 00412189, from Heavy Industrial (IH), Pit and Quarry (PQ), Rural (RU), and Medium Industrial (IM) to Green Energy (GE); and rezoning a parcel of land having an area of approximately 2.5 hectares, located at 399 Burchill Road, also identified as being a portion of PID Number 00412189, from Pit and Quarry (PQ) and Rural (RU) to Special Zone 5 (SZ -5) to facilitate the establishment of the Burchill Wind Project, which will include the development of several wind turbines on the subject site, with no letters of either support or objection received. Consideration was also given to a report from the Planning Advisory Committee submitting a copy of Planning staff's report considered at its February 19, 2020 meeting at which the Committee recommended the rezoning of a parcel of land located at 399 Burchill Road as described above with Section 59 conditions. J. Kliffer, planner, presented a staff report. Responding to question for a definition of "Green Energy Zone", K. Melanson responded the zoning bylaw does provide a definition; wind energy and solar energy projects are allowed. AUTHORIZATION Primary Author Commissioner/Dept. Head City Manager John Campbell Brent McGovern / Brian Keenan John Collin RECOMMENDATION It is recommended that Contract No. 2019-13: West Saint John Water Supply — Orthophosphate System be awarded to the low Tenderer, G.J. Cahill & Company (1979) Ltd., at the tendered price of $246,100.00 (including HST) as calculated based upon estimated quantities, and further that the Mayor and Common Clerk be authorized to execute the necessary contract documents. EXECUTIVE SUMMARY The purpose of this report is to recommend that Council award Contract 2019-13: West Saint John Water Supply — Orthophosphate System to the low Tenderer. PREVIOUS RESOLUTIONS March 26, 2018, (M&C 2018-88), West Water — Orthophosphate Treatment Update, Received and Filed. July 30, 2018, (M&C 2018-220) 2019 Water & Sewerage Utility Fund Capital, Program Approved. 15 -2 - REPORT BACKGROUND The approved 2019 Water and Sewerage Utility Fund Capital Program includes funding for the design and construction of a permanent orthophosphate system for the West Saint John water supply. The existing, temporary orthophosphate system will be replaced with a permanent, more operationally cost-effective system. TENDER RESULTS Tenders closed on March 3, 2020 with the following results, including HST: 1. G. J. Cahill & Company (1979) Ltd., Saint John, NB $ 246,100.00 2. Filtrum Inc., Quebec, QC $ 247,135.00 3. Select Mechanical Incorporated, Quispamsis, NB $ 273,749.29 The Engineer's estimate for the work was $260,130.00 including HST. ANALYSIS The tenders were reviewed by staff and all were found to be formal in all respects. Staff is of the opinion that the low tenderer has the necessary resources and expertise to perform the work, and recommend acceptance of their tender. FINANCIAL IMPLICATIONS The Contract includes work that is charged against the Water and Sewerage Utility Fund Capital Program. Assuming award of the Contract to the low tenderer, an analysis has been completed which includes the estimated amount of work that will be performed by the Contractor and Others. The analysis is as follows: Budget Project net cost Variance (Surplus) $ 296,000.00 $ 289,290.00 $ 6,710.00 POLICY—TENDERING OF CONSTRUCTION CONTRACTS The recommendation in this report is made in accordance with the provisions of Council's policy for the tendering of construction contracts, the City's General Specifications and the specific project specifications. -3 - STRATEGIC ALIGNMENT This report aligns with Council's Priority for Valued Service Delivery, specifically as it relates to investing in sustainable City services and municipal infrastructure. EXECUTIVE SUMMARY On October 21, 2019 Council referred a letter from citizens of Cosy Lake Road to the City Manager and Chief of Police for discussion regarding the all -terrain vehicle traffic on Cosy Lake Road. PREVIOUS RESOLUTION N/A REPORT Citizens of Cosy Lake Road are requesting action taken to alleviate the amount of all -terrain vehicle traffic on this road. They are requesting reinforcement of the barricade at the end of the road and/or spot checks by the Saint John Police Force. In the New Brunswick Off Road Vehicle Act, Paragraph 16 of the act states; "...no person shall operate an off road vehicle within 7.5 metres of the travelled portion of a highway." The Saint John Police Department has the ability to enforce violations under this act, however resources are limited. iF:3 -2 - Cozy Lake Road is one of many places the city experiences issues with all -terrain vehicle traffic. The City and the Saint John Police Department are unable to continuously monitor these areas for persons conducting violations. This would require long periods of monitoring and staffing levels do not allow for this. Although resources are limited in their ability to provide continuous monitoring, staff has visited the area and confirmed the barricade at the end of the road is in place and will continue to intermittently visit the site to address the barricade as needed. The Saint John Police Department will do periodic spot checks as resources allow and will work with the Kennebacasis Regional Police Department to address enforcement in the Cozy Lake Road area. That the Public Hearing to consider the passing of a By-law to Close a 476 square metre portion of a public street known as Fairville Boulevard, as shown on a Survey Plan (see attached), be set for Monday, June 8, 2020 at 6:30 p.m. in the Council Chamber; 2. That Common Council authorize the publishing of a notice of its intention to consider passing of such By-law identified above; and 3. In the event that Common Council gives Third Reading to Amending a By- law as stated above, that Council approve the sale of the subject property to SBLP Harding Street Property Inc. for $1.00, subject to the reservation of any municipal or public utility easements required and further, that the Mayor and Common Clerk be authorized to execute any document to effect the transfer. EXECUTIVE SUMMARY On October 12, 2010 Council approved a land exchange between the City and the owners of the Lancaster Mall property along with other nearby lands for the purpose of providing extensive road reconstruction work in the area of Fairville Boulevard, adjoining to the Lancaster Mall. The City has received all of its parcels of land and there remains one parcel for consideration to be conveyed from the City to the owners of the Mall and associated lands. It should be understood that although the ownersl�5 of the mall property has changed and -2 - there are no legal agreements in place with the now current ownership group, it is staff's position that the City should honor its commitment in this agreement. Staff is in agreement with the portion of Fairville Boulevard, as shown on the attached plan of survey to be considered for closure and subsequent sale to SBLP Harding Street Property Inc. The recommendation contained in this report will facilitate the process for Council to consider the closing of the street as shown on a plan of survey (attached) and if closed will facilitate the transfer of the land to the proponent. SBLP Harding Street Property Inc. is in the planning process to develop this site this year and the additional land (if stopped -up and closed and acquired) would greatly enhance the layout and development of the site. It is expected the City would benefit in property taxes from a full build -out of a minimum of $80,000.00 annually. PREVIOUS RESOLUTION In 2018, Council (M&C #2018-217) approved the sale of two parcels of land that abut SBLP's property; one at the corner of Fairville Boulevard and Harding Street and the other being a former portion of Harding Street. STRATEGIC ALIGNMENT Providing for entrepreneur opportunities in the City and creating a livable community that is vibrant and diverse, while providing an integrated approach to economic development. REPORT Further to the comments contained in the Executive Summary. Background On October 12, 2010 Council approved a number of land exchanges between the City and the owners of the Lancaster Mall property for the purpose of providing for extensive road reconstruction work in the area of Fairville Boulevard adjoining to the Lancaster Mall. In addition, the "connector" road that existed between Harding Street and Fairville Boulevard had been reconstructed and shifted slightly further east so that it aligned properly with a new street intersection to serve Lancaster Mall. Part of the City's commitment to the then owners of the Lancaster Mall was to convey the former connector street for $1.00 and to sell the former portion of Harding Street. In 2018, Council approved the aforementioned exchanges to the new owners, SBLP and they are now part of the assembled site. W -3 - Current Deal The City has received all of its parcels of land from the then owners of the Mall but there remains one parcel for consideration. If stopped -up and closed, a 476 portion of Fairville Boulevard (presently landscaped area) would be transferred to the ownership group of the Mall and nearby lands. Staff recommends the sale of the subject parcel to SBLP for $1.00 as had been previously agreed upon. Various City departments have been advised and are supportive of the proponent's development plans for this property and are in agreement to have Council consider the closure of a portion of Fairville Boulevard, as shown on the attached plan of survey. There is a public utility and municipal infrastructure contained within the "to be" closed portion of street that would need to be reserved out so that they would continue to be maintained. The recommendation contained in this report will initiate the process to consider the street closing, and if Third Ready is given, the sale of the parcel to the proponent with the reservation of the required easements. SERVICE AND FINANCIAL OUTCOMES As part of the original land exchange agreement with the previous owner of the Lancaster Mall and associated lands on the opposite side of Fairville Boulevard, there are no financial costs to the City other than survey costs associated with this land conveyance. The anticipated cost for the commercial development planned for this site is estimated to be approximately three (3) million and the tax benefit to the City will be approximately $80,000 annually. INPUT FROM OTHER SERVICE AREAS AND STAKEHOLDERS Saint John Water, Transportation and Environment Services, Growth and Development Services along with Infrastructure Development are all in agreement to have the surveyed portion of Fairville Boulevard closed and conveyed to the adjoining property owner. Head City Manager Patricia Anglin Jonathan Taylor John Collin RECOMMENDATION It is recommended that the attached Procedural Bylaw amendment, permitting Council Members to participate in open session meetings of Common Council and Committees using remote technology receive first, second and third reading on March 23, 2020. EXECUTIVE SUMMARY The purpose of this report is to present Council with a procedural by-law amendment which permits remote participation for Council Members in Open Session via teleconference or video conferencing, such as but not limited to WebEx. As permitted by the emergency provisions of s. 15.6 of the Local Governance Act the bylaw is to receive three readings in one day. PREVIOUS RESOLUTIONS January 28, 2019 RESOLVED that Council allow for remote participation for Council Members via teleconference for Committee of the Whole closed session. February 16, 2018 Council resolution: RESOLVED that Council allow for remote participation using teleconference for special or emergency meetings of council; and further, that Council not proceed at this time with changing its procedural by-law to allow for remote electronic participation in regular open session meetings of Council, Committee of the 091 -2 - Whole or other committee meetings until reliable technological solutions have been identified. REPORT Electronic Meetings The Local Governance Act contains provisions (s 69) which allow Council members to participate in Council and Committee of Council meetings remotely using technology, such as teleconference or video conference, if the following conditions are met: • Members of Council can hear and speak to each other • The public can hear the member if the meeting is open to the public • Only a member of council who, at the time of the meeting, is outside of the local government or is physically unable to attend the meeting may participate using electronic means • In a one-year period members of Council shall not participate in a meeting using electronic means more than 25% of the regular meetings, or more than four special meetings, except for reasons of disability • A member of Council must provide sufficient notice to the Clerk • A member of Council who participates electronically in a closed meeting shall, at the beginning of the meeting, confirm that her or she is alone • If the meeting is open to the public, notice of the meeting must be given to the public advising of the location of the meeting and that electronic means of communication will be used at the meeting Council approved the adoption for remote participation using teleconference for special, emergency and closed session meetings on February 16th, 2018 and January 28th 2019. Staff is currently investigating technological options for remote meeting participation while the permanent Council Chamber undergoes renovations as part of the City Hall project. Many of the audio and visual components in the Chamber were installed in 2002 and require upgrades/replacement. Staff is exploring various options, such as remote electronic voting connected to the Council Chamber meeting management software, video conferencing, and web streaming. It is recommended that a reliable technological solution be in place prior to Council considering electronic participation for regular open session meetings. The City is now in an emergency situation and committed to taking important steps in reducing the spread of Covid-19. Staff who can work from home have been directed to do so. This Procedural bylaw amendment will allow Council Members to attend meeting using remote technology, such as teleconference and video conference rather than in person. 011 -3 - It is recommended that Council give first, second and third reading to the bylaw on March 23, 2020. SERVICE AND FINANCIAL OUTCOMES INPUT FROM OTHER SERVICE AREAS AND STAKEHOLDERS The City Solicitor provided a legal opinion that the process being recommended is supportable at law. The Solicitor's Office drafted the Procedural Bylaw Amendment. The Department of Environment and Local Government was also consulted concerning the impact of Covid-19 on Council Meetings and they advised to maintain the spirit and intent of the LGA recognizing the exceptional times in which we are currently living. Second, we have the responsibility to develop a plan to respond to the global economic crisis. This will and has already impacted our community. The time for collaboration amongst all leaders in unions, government, employers, businesses, organizations, has never been as crucial and tested in this way before. We're in unprecedented times and that requires unprecedented actions. Therefore, I'll be presenting a motion at council this Monday. Motion: Direct the City Manager to do the following: Prepare a monthly forecast of the impacts from Covid-19 on finances, human resources and City operations. Including mitigation plans. Work with our employee groups to gain, at minimum, a wage freeze for 4 years and the flexibility to reduce wage costs as necessary, to protect the sustainability of the local economy and taxpayers. That due to restrictions related to some employee groups in terms of binding arbitration and the failure to recognize local conditions, that a corresponding recommendation be made to budget allocations, should current realities be ignored and wage increases be forced upon taxpayers. That the barriers associated with current collective agreements be clearly communicated to the public from all city, agencies, boards, and commissions within the next 30 days. That council rejects in principle any labour agreement that is not at minimum a wage freeze and with restrictive clauses removed, impeding necessary management, productivity and cost flexibility. Enhance governance to ensure the barriers we face related to our workforce, collective agreements and the negotiation process, are addressed. Work with the Provincial and Federal governments to achieve the necessary support to rebuild the Saint John economy. The perennial absence of a bench on the heights of Fort Howe is a prime example. It veritably screams pedestrians not welcome and were never considered. The vision of Discover Saint John appears closely affiliated with that of Move SJ, whose nonsensical contention that a painted crosswalk to safely access the World Famous Reversing Falls lookout from Douglas Ave constitutes a liability, exemplifies their dismissal of pedestrian safety. It is an uncontested matter of public record that Saint John Transit is designed for the profit of other transportation entities and private interests. As public transit is such an integral component of both tourism and transportation, it is difficult to dismiss the perception that Discover Saint John and Move SJ are operated in the same discriminatory fashion as Saint John Transit. Municipal policies have necessitated the use of a vehicle to safely access anything in Saint John. This has effectively relegated pedestrians to second class citizens, not worthy of consideration. Safe Pedestrian Access can no longer remain a foreign concept to our decision makers if Saint John ever hopes to join the 21St century. New and current regulations: From 00:01 of 1st day of month to 18:00 of 15th day of month - park on the odd numbered side of street Then, the same thing from the 15th to the last day of month - park on the even numbered side of street. All year round Previous regulations: On Monday, Wednesday, Friday, and Saturday, from midnight to 07:00 - park on the odd numbered side of the street On Tuesday, Thursday, and Sunday, from SUBMISSION TO COUNCIL FORM the City of Saint gnhn midnight to 07:00 - park on the even numbered side of the street From November 15th to April 15th I am writing to ask you to change the on -street parking regulations on the lower west side of ward 3. Below you will find issues with the current regulations, and possible solutions. On -street parking is a necessity to many lower west siders who do not have driveways. The new parking regulations make city living inconvenient and unsafe for many of us who rely on street parking. We have to deal with these regulations every single day, so please understand the severity of these regulations. People should not have to choose between city living and car ownership. If the city does not want to make parking on its streets possible, then I believe people will get fed up and move out of the city. That is exactly what Saint John does not need. In addition, difficult parking situations certainly will not attract new residents. The first issue I have with these new regulations is the snow removal. Residents must park on the same side of the street for 15 consecutive days. Throughout these 15 days, any snowfall does not get properly plowed on this side of the street. This results in huge ice blocks taking up already scarce parking spots, and potentially harming vehicles who may attempt to drive over these ice blocks in an attempt to legally park. One might suggest that if every person shoveled around their vehicle that this would not be an issue. I can not think of a way to ensure that every single on street parker does so. This is unfair to the residents who do shovel around their vehicle only to return to their shoveled spot taken by another person. Not only that, after some time (say- a work day), in the cold temperatures the snow is not possible to shovel any longer and requires heavy equipment to move. With the previous parking regulations, there was always plenty of opportunity to get both sides of the street thoroughly plowed, ensuring more available parking spots and also ensuring a wider street which is great for allowing big vehicles to pass through like fire trucks and ambulances. The second issue I have is, with the snow removal issue in mind, these new regulations may result in even more overnight parking bans in order to get at the un -plowed side of the street. Overnight parking bans are an inconvenience for everyone involved, especially on the lower west side where we do not have parking lots dedicated to giving us a place to park. Overnight parking bans could have been virtually completely avoided with the ample opportunity our previous parking regulations gave us to get at both sides of the street. The third issue I find with these new regulations is the unfairness they show towards lawful SUBMISSION TO COUNCIL FORM the City of Saint gahn residents. According to a ward representative, the regulations were changed because of numerous complaints about tickets. Giving in to such behaviour is not a good call and is in fact unfair to the residents who had no issue moving their vehicle daily (which is a law in itself that any vehicle parked on -street for longer than 24hrs is considered abandoned.). The new regulations give ample opportunity for unlawful residents to take up parking spots for 2 weeks at a time when our parking is already scarce as it is. We did not have to change the parking regulations on the lower west side, we had to enforce the efficient, resident -friendly regulations we already had. One might call this new change "Fixing something that isn't broken.". The fourth and final issue I see with these new parking regulations is the fact that they now take place 24hrs/day, all year round. If these regulations really were changed because of complaints about tickets, how is more than doubling the actual time our parking is being regulated going to help in any way? I see no reason why we need to have our parking regulated in the warmer months when the streets are even busier than usual. Some planning and communication could ensure efficient street sweeping and construction when needed. Do not regulate our parking all year round as it is completely unnecessary. I can understand how 15 consecutive days could be less confusing for some residents, however, it is clear now that these new regulations are not resident -friendly and do not allow for proper snow removal. The lower west side is a very unique, strictly residential area, and I believe it should be treated as such. In order to keep our residents happy with city living, we should not be afraid of different parking regulations across ward 3, even if it means better planning and communication. Please listen to the people who matter - the people who live in this neighbourhood and call it home. Please consider my possible solutions below. Possible Solutions (in order of most wanted) Solution 1: Revert to the previous parking regulations. On -street parking regulated from midnight -7:00 AM, rotating on a daily basis (with the exception being Friday/Saturday), only in the winter months (November 15th - April 15th). These types of interactions on social media misplace the focus of interaction on attacking individuals rather than engaging in constructive discussion or debate. This manner of communication is inconsistent with the Code of Conduct and unbecoming of the office that Members hold. 8.8 No Member of Council shall make a statement with the intent to mislead Council or members of the public. On March 11th, 2020, Councilor David Hickey made a post on his own personal Facebook page about the decision of Mayor Don Darling to not run again for the office which he currently holds. There were many comments, both positive and negative, yet my comment in particular was singled out by Mayor Don Darling to instigate a string of postings which could serve no purpose but to harm me personally and very publicly. Reference my comment: "Ihri'IcslP�lher Ihscsnne I wish him well in his new endeavors, but he was not right for the position which he held. For two years in a row SJ was voted worst out of 133 cities for transparency in local governance." The intensity of the onslaught began with the Mayor questioning the validity of a reference I made to the recent article on 'Linked In' written by columnist Herb Duncan. In this article, Mr. Duncan made reference to a 2011 listing of our city being rated last out of 133 cities for transparency. Personally, after reading that article I agreed with Herb Duncan's assessment, in that things have not improved much under our current leadership, and referenced the most recent incident where the report on city employees was withheld by the city manager. Mayor Don Darling also labelled the report as 'a dumb 2011 report', demeaning the work that the organization has done in the past. The LG -05 By -Law states that "Members of Council are expected to perform their duties in a manner that will bear close public scrutiny..." By citing Herb Duncan's article and bringing up the withholding of this report to the mayor as evidence that the transparency was still imperfect, it set off a chain of intense comments from the mayor and a couple of other people. Rather than calm the discussion with more appropriate comments, the Mayor only inflamed the situation, using his words to incite hatred towards me personally. He seemed to take pleasure and be buoyed by and encouraged by others who then joined in the attacks against me. I am not a public official in a position of trust. Yet the man who is, Mayor Don Darling, believes only those who are in such positions have any right to speak on issues such as this. I am being told in one post by Mayor Don Darling that he wants tMee my name on a ballot in the next election, thus essentially telling me to shut up. As someone who was bullied to the point of suicide in my grade school days this does not sit well with me as an adult. Mayor Don Darling called me 'in-mature'(sic), 'uncaring', 'rude', a 'conspiracy theorist' and the slander continued on in that same vein. At one point an image of a man wearing tinfoil on his head was posted by another commenter named James Stewart, and then Mayor Don Darling shot out 'Who's your ideal, Donald Trump?'. There was no effort made by either Mayor Don Darling or Councilor David Hickey to caution people to have a civil discussion. Below I have inserted a direct quote from the Mayor's postings (see screenshots below) to Councilor David Hickey's Facebook page: "Doan ICDarluin I;hristopher Osborne this is really strange and in -mature behaviour. Is it because you didn't get funding for your heritage home, are you running with the so called citizens coalition and have bought fully into the conspiracy theories or are you just a really uncaring and rude person. Again throwing out unsubstantiated bull , doesn't make it right. For this city to achieve its full potential, citizens need to demand more. Have a wonderful day and I hope you'll choose to be a better leader and citizen" Then this response from Glen Hicks: "Mein IHicks Don Darling thank you for exposing this guy. We need to all be responsible and rat these wing nuts out as they incent anger and confusion amongst citizens to what agenda I am not sure. Perhaps for their own sadistic pleasure. It is certainly not for the benefit of citizens of Saint John" Later I followed it up: " Ihriistol13lher Osborne Carol Black Glen Hicks Don Darling Kevin Merzetti Now I am being sworn at by our Mayor, that's pretty sad. All I have ever asked for is a reason why this report was withheld if things are truly transparent, you did not provide that answer. I am shocked that instead of just doing what is right...... " In the above quote and others Mayor Don Darling is accusing me of being part of a big conspiracy against him, among other ludicrous things. In the second quote from Mr. Glen Hicks I demonstrate that clearly people reading his comments are now believing what the Mayor is saying about me. I was further accused of not being a leader, simply a writer of essays. I, personally never claimed to be a leader; I am a taxpayer, questioning actions or inaction that I see in a public institution completely funded by our tax dollars. What 'leader' would use his power and influence to attack those without power in society? noun noun: bully; plural noun: bullies 1. a person who habitually seeks to harm or intimidate those whom they perceive as vulnerable. Mayor Don Darling has a much bigger following and 'friends' list than I as a citizen could ever have, for obvious reasons, he is a public figure. The actions of Mayor Don Darling are not befitting of the office which he currently holds. The excessive abuse of power shown in this very personal attack on Facebook is unacceptable. Regardless of whatever stresses the position may cause on him, he has no right to attack a taxpayer, particularly not in this way and certainly not in a very public forum with the use of foul language and name calling. Anyone who has known me understands that I am a passionate advocate for our local history and the protection of our built heritage. My personal application for Heritage status for our property on the West side of the city has been working its way through the channels in city hall for over two years. This application has nothing to do with Mayor Don Darling, yet during this series of intense back and forth posts, Mayor Don Darling even brought the application which my wife and I made for heritage designation into his attacks, claiming that I am upset with him personally over it. He is ill informed; and I responded by telling him that the application is currently with the heritage department and the department is presently awaiting my input. The application is in fact not finished or denied, and it has absolutely nothing to do with the Mayor. The fact that this application was even brought up troubles me greatly, as it had absolutely nothing to do with the question at hand and it did not require any action or cor§Aent from the Mayor. As you go through the attached screenshots, Mayor Don Darling steps far outside his role as our Mayor to attack me personally, yet refuses to be accountable over the mistake which was made by the City Manager. He instead attempted to divert the attention from the real issue. Mayor Don Darling, by his own statement in the postings below says that it was a mistake made by the City Manager, yet won't answer what he will do to ensure this does not reoccur. In all this, Mayor Don Darling had every opportunity to end the discussion, and could have told me that he would investigate the matter further and come back later with a response as to why the report was withheld and what would be done to ensure this would not happen again in the future. This is something I would normally expect of our elected officials, but instead Mayor Don Darling purposefully used this opportunity to incite hatred, embarrass and demean me in front of a wide audience. I was left feeling belittled, demeaned and bullied, something I had not felt since my days as a child in public school. I have personally suffered public humiliation, caused by the direct actions of Mayor Don Darling in his responses. And yet, Mayor Don Darling has the audacity to accuse everyone who questions or criticizes him of being a bully. I am the Father of two very young children. Mr. Hicks, in the conspiratorial nature of McCarthyism, apparently wants to "rat out these wingnuts" (individuals who have exercised their right as citizens to hold the Mayor to account for his actions), as if they are somehow 'enemies of the state'. As a member of this 'gang' of citizens that Mayor Darling so callously dismisses as being unworthy; let me take a moment to say that I am a senior citizen and homeowner who, like many in Saint John is struggling to pay the highest property taxes in New Brunswick and the most egregious water rates in Canada. I work 12 hours a day, 6 days a week, running a small business. I deal with a chronic illness that leaves me fatigued. I am also the only lifeline for a young Syrian refugee with severe mental health issues, who has been all but abandoned by the government(s) who brought her to Saint John and dumped her into a drug -infested corner of the old north end with little or no concern for her well-being. It is so easy for Mayor Darling to dismiss good citizens like me, isn't it? So easy for people like Mr. Hicks to describe good citizens like me as a 'wingnut' who has to be 'ratted out'. So easy for a senior member of city staff to applaud this venomous vitriol against those who pay his 6 -figure salary. Shame on all members of Common Council for allowing this to happen. Mayor Darling is not a candidate for re-election, but he is still the Mayor of the City of Saint John and, as such, he has a sworn duty to act in the best interests of ALL citizens until, like Richard Nixon, he too waves a humiliating goodbye to his political career on his last day in office. It is not the Mayor's role to stir up hatred within the community out of bitterness or an apparent need for vengeance. Mr. Darling's behaviour is unbecoming to the office of the Mayor. This is far from being a 'frivolous' or'vexatious' concern, as Mr. Darling would no doubt suggest in his dictatorial effort to silence anyone with an opposing viewpoint on matters of public interest. It is a brutal slap to the face of democracy. 71 As such, I am once again requesting that this Common Council introduce and pass a motion of censure against Mr. Darling for his abusive behaviour against citizens on social media, a clear violation of Article 8.7 of the Code of Conduct, which states that, "Members of Council shall not engage in or encourage bullying, flaming, or shaming of any other social media users. These types of interactions on social media misplace the focus of interaction on attacking individuals rather than engaging in constructive discussion or debate. This manner of communication is inconsistent with the Code of Conduct and unbecoming of the office that members hold." These are not my words, they are yours. This Common Council voted unanimously to approve this bylaw, which it has since not had the courage to enforce. If this council wishes to end its term as hypocrites or worse, it will again just pay lip service to its own declared code of conduct by receiving and filing this complaint along with all the others which it has ignored in recent months; a disturbing pattern of behaviour by men and women who hold positions of trust in society. On the other hand, if it wishes to set an example for others and send a positive and hopeful message to citizens by adhering to society's highest ethical standards, it will introduce and pass a motion of censure against Mayor Darling. EXECUTIVE SUMMARY The purpose of this report is to amend the option agreement to provide more time to finalize and execute the terms of the ground lease. Additional time is required due to the ongoing Provincial review of the Fundy Quay infrastructure application and challenges associated with the Covid 19 outbreak. PREVIOUS RESOLUTION At it's December 2nd meeting, Common Council approved the following resolution: That the City of Saint John enter into an Option Agreement with Fundy Quay Developments Inc. regarding the site known as Fundy Quay in the form as attached to this M. + C. No. 2019-333; and liFP 3 -2- 2. That the Mayor and Common Clerk be authorized to execute said Option Agreement. REPORT At its December 2nd 2019 meeting, Common Council approved an Option Agreement and appended Ground Lease for the Fundy Quay site. At this time, the rent for the Ground Lease and the pricing structure for the Option to Purchase therein were predicated on the City delivering a development ready site to Fundy Quay Developments Inc. at the time the Option to Lease is exercised. As the required Provincial infrastructure funding to prepare the site for development was not secured at the time, the option agreement provided additional time for a decision to be made on the City's infrastructure funding applications, and allowing the City and the developer to finalize the terms of the agreement. The option agreement provided an additional three months to complete the terms of the agreement, as at that time, the Regional Development Corporation of the Province had indicated that decisions were planned to be made within the near future. In early March of 2020, the Province provided the City of Saint John with a letter notifying that the Fundy Quay project was not selected in the current round of funding under the Integrated Bi -Lateral Agreement with the Federal government. Since then, the Province has re-engaged the City and Develop Saint John on options to move the project forward. While these discussions are positive, the ultimate decision on infrastructure funding has still yet to be concluded. In light of the recent outbreak of Covid 19 and the challenges facing the Province and all of Canada, it is anticipated that more time will be required to finalize a decision. While both parties have agreed in principle on the final terms of ground lease, until there is clarity on the Provincial decision regarding the infrastructure funding for the Fundy Quay, the final version of the ground lease cannot be completed. For this reason, an extension to the timelne is being requested. STRATEGIC ALIGNMENT The development of the Fundy Quay is aligned with Council's priorities of Fiscal Responsibility, Growth and Propserity, and Vibrant Safe City. It is also a strategic Growth Concept identified in the City's Central Peninsula Neighbourhood Plan. Saint John Water is mindful of the period of uncertainty that we are in at this time due to COVID-19, the coronavirus. It is recognized that this virus will cause financial hardship on many citizens and for this reason it is important to highlight the actions being taken and the options available to address concerns that ratepayers might have. Flat Rate bills were just mailed the first week of March, with a due date of April 8, 2020, however, given the circumstances relating to the COVID-19 crisis the following are key points for ratepayers (residents and businesses) to be aware of. • Ratepayers, as has been offered in the past, can make payment arrangements with Saint John Water. If a payment arrangement is made, the account will not incur interest as long as the customer adheres to the payment plan. • Despite a due date of April 8, 2020 (for both flat and metered customers) ratepayers who do not make special payment arrangements as described above, will have a period up to May 31, 2020 to make payment and still avoid interest which aligns with other extensions granted as part of the COVID-19 crisis. This provides a grace period extending close to two months beyond the normal grace period. • We will work with all customers to make reasonable payment arrangements that consider enhanced flexibility and staff will be as accommodating as possible. • Ratepayers water and sewer services will not be shut-off/disrupted for non-payment during the COVID-19 crisis. While we are taking extra steps to assist ratepayers at this very challenging time, I would highlight that the utility is ratepayer funded and is required by legislation to charge the users of the utility in order to produce an annually balanced budget. Rates need to be paid by ratepayers to fund utility operations that provide critical high quality safe, clean drinking water to all of its ratepayers while also collecting and treating municipal wastewater to protect public health and the environment. Following the recent recommendations from the Office of the Chief Medical Officer of Health for COVID-19, the City of Saint John Payment Centre is now temporarily closed. EXECUTIVE SUMMARY City staff has had discussions with the proponents of 707990 N.B. Inc., pertaining to the unfortunate circumstances that we find ourselves in regarding the COVID- 19 virus. Mr. Bezeau has confirmed via email his desire to suspend his licence agreement with the City to rent ice and associated rooms at the Stu Hurley arena commencing April 1St. In light of the directive provided by all levels of government to prevent the spread of this virus it has been determined that the seasonal operation of the Stu Hurley arena as per the licence agreement approved by Council on January 27, 2020 must be suspended. PREVIOUS RESOLUTION Common Council, at its meeting on January 27, 2020 approved a seasonal licence for 707990 N.B. Inc. to operate the Stu Hurley Arena for a total of six (6) months, commencing April 1St to September 301h of 2020. 1aD REPORT Further to the above comments contained in the Executive Summary. The proponents understand the circumstances we all find ourselves, in dealing to contain the spread of the COVID-19 virus. To comply with the directive of all three levels of government, the licence agreement for 707990 N.B. Inc. to operate the Stu Hurley arena in 2020 must be suspended. If, at some point prior to the termination date of September 30, 2020 it makes sense to re-establish this agreement, a further report will be presented to Council for their consideration. STRATEGIC ALIGNMENT N/A SERVICE AND FINANCIAL OUTCOMES No ice rental services will be offered at this time. The payment that would have been provided to the City for this six month licence was $142,500.00 plus HST. City staffing of the arena along with maintenance and the payment of utilities would have cost the City close to this amount, with an expected net revenue to the City of a few thousand dollars. The approximate cost for goods/services/energy cost to take out the ice and put it back in is approximately $8,000.00. There would be additional labour costs but this would be considered an "opportunity cost" to other services provided by our service area. South Bay Wellfield Sustainable Yield — Commencement of Action Against BGC Engineering Inc. and Peer Reviewers EXECUTIVE SUMMARY OF COMMITTEE OF THE WHOLE REPORT FOR OPEN SESSION OF COUNCIL At its July 8t", 2019 meeting, Council resolved to terminate its contract with BGC Engineering Inc., and to initiate the Dispute Resolution Process leading to arbitration under the said contract. At its meeting held December 16, 2019, the City resolved to advance claims directly against each of Matt Alexander of Fundy Engineering Inc. and Kenneth Howard of the University of Toronto who peer reviewed BGC's work in relation to the sustainability of the West Wells, and to bring each of them in the BGC Engineering dispute resolution process in this respect. Although efforts were made to seek to resolve out of court the City's claim against BGC and the two peer reviewers, events have arisen that make an early out of court resolution of the City's claim unfeasible. The City must commence formal legal proceedings now, to ensure that the statutory limitation period does not expire.
