2012-04-23_Minutes--Procès-verbal 1 Committee of the Whole Open Session April 23, 2012 Minutes of the Portion of the Committee of the Whole Meeting Open to the Public Monday, April 23, 2012 at 5:00 p.m. th 8 Floor Boardroom, City Hall Present: Mayor Ivan Court Deputy Mayor Chase and Councillors Court, Farren, Higgins, McGuire, Norton, Snook, Sullivan and Titus - and – W. Edwards, Commissioner of Transportation and Environmental Services/ Acting City Manager; J. Nugent, City Solicitor; G. Yeomans, Commissioner of Finance and Administrative Services; E. Gormley, Common Clerk and J. Taylor, Assistant Common Clerk 1. Meeting Called To Order The Mayor called the Committee of the Whole meeting to order. The Clerk advised that staff has requested the following items be added to the agenda: Pension Reform Update; Alternate for City Manager on Pension Board of Trustees; 1.6b) Regulation Respecting Processions and Assemblages on Public Streets Some Council members expressed the view that pension reform update should be given in open session of Council. Mr. Yeomans stated that the City Manager requested that he provide Council with a pension update in closed session, noting that should this be discussed in open session it could result in a financial loss to the City. He added that the Superintendent of Pensions and the Deputy Minister of Justice and have advised him that it was their understanding that all pension discussions would be taking place in closed session. On motion of Councillor Titus Seconded by Councillor McGuire RESOLVED that the public be excluded from the meeting for the duration of the discussion on the following matters: 1.0 (a,b) 10.2(4); 1.1 Nominating Committee 10.2(4)(b); 1.2 Employment Matter 10.2(4)(j); 1.3 Land Matter 10.2(4)(c,d); 1.4 Employment Matter 10.2(4)(f); 1.5 Personal Matter 10.2(4)(b); 1.6 Legal Opinion 10.2(4)(f); 1.7 Land Matter 10.2(4)(c,f) Deputy Mayor Chase proposed an amendment to the motion, seconded by Councillor Higgins, to remove the Pension Update from the closed session agenda. Question being taken on the amendment, the motion was carried with the Mayor and Councillors Court, McGuire, and Sullivan voting nay. 2 Committee of the Whole Open Session April 23, 2012 The Mayor objected to discussing the pension reform in open session of Council. The Mayor withdrew from the meeting. Councillor Titus and Councillor McGuire withdrew the main motion. The Clerk advised that the floor is open if a council member would like to make a motion. Councillor Titus withdrew from the meeting. Deputy Mayor Chase replaced the Mayor as Chair of the meeting. On motion of Councillor Sullivan Seconded by Councillor Snook RESOLVED that the email from the Mr. Woods requesting that Council appoint a designate for the City Manager on the Pension Board be referred to the Nominating Committee. Question being taken, the motion was carried. 2. Discussion of Confidential Matters On motion of Councillor Sullivan Seconded by Councillor Snook RESOLVED that the public be excluded from the meeting for the duration of the discussion on the following matters: 1.0 (a,b) Approval of Minutes; 1.1 Nominating Committee 10.2(4)(b); 1.2 Employment Matter 10.2(4)(j); 1.3 Land Matter 10.2(4)(c,d); 1.5 Personal Matter 10.2(4)(b); 1.6 Legal Opinion 10.2(4)(f); 1.7 Land Matter 10.2(4)(c,f) Question being taken, the motion was carried.
