Bureau de l'Avocat Municipal MEMORANDUM TO: Committee of the Whole FROM: John Nugent, City Solicitor DATE: October 24, 2011 The alyy of saint John RE: Item 5.5 on the Common Council Agenda for October 24, 2011 This item recommends that an amendment to the City's Traffic By -Law be prepared to change the speed on a portion of Main Street and the Viaduct from 50 km/hr to 601an/hr. This stretch of highway is a portion of a Provincial Highway as the latter term is defined in the Motor Vehicle Act. The Motor Vehicle Act provides that the speed limit on Provincial Highways is a matter exclusively within the jurisdiction of the Province. A Municipal By -Law that purports to establish a speed limit for that portion of roadway is beyond the Municipality's jurisdiction and is of no force or effect. Consequently, the recommendation at Item 5.5 should be simply that the report be received and filed. John L.
