2011-07-25_Minutes--Procès-verbal 1 Committee of the Whole Open Session th July 25, 2011 Minutes of the Portion of the Committee of the Whole Meeting Open to the Public Monday, July 25th, 2011, 5:00 p.m. th 8 Floor Boardroom, City Hall Present: Mayor Ivan Court Deputy Mayor Chase and Councillors Court, Farren, Higgins, McGuire, Mott, Norton, Snook, Sullivan, and Titus. - and – P. Woods, City Manager; G. Yeomans, Commissioner of Finance; J. Nugent, City Solicitor; E. Gormley, Common Clerk and J. Taylor Assistant Common Clerk The Committee of the Whole meeting, convened in public earlier this date, proceeded to deal with the following matters: 1. Meeting Called To Order The Mayor called the Committee of the Whole meeting to order. On motion of Councillor McGuire Seconded by Councillor Titus RESOLVED to suspend the rules of section 8.1 of Council’s Procedural By-Law to allow agenda items 1.0 Little River Reservoir Park and 1.3 Mispec Park Agreement to be added to the Special Committee of the Whole meeting. Question being taken, the motion was carried. 1.0 Little River Reservoir Park On motion of Councillor Titus Seconded by Councillor Court RESOLVED that the City Manager be directed to allow Irving Oil to begin preliminary work on the Little River Reservoir Park before the submitted formal Maintenance Agreement is finalized, provided that Irving Oil has first delivered the required insurance documentation to the City. This will be in anticipation of the matters being dealt with by Council at the next open session meeting of Council. Question being taken, the motion was carried. 1.3 Mispec Park Agreement On motion of Councillor Titus Seconded by Councillor McGuire 2 Committee of the Whole Open Session th July 25, 2011 RESOLVED that the City Manager be directed to allow Repsol Canada Ltd to begin work on the stairs at Mispec Park before the submitted formal Maintenance Agreement is finalized, provided that Repsol Canada has first delivered the required insurance documentation to the City. This will be in anticipation of the matters being dealt with by Council at the next open session meeting of Council. Question being taken, the motion was carried. 2. Discussion of Confidential Matters Responding for a request to clarify why the closed session Committee of the Whole meeting was scheduled, the City Manager stated that NB Power has made a request to the City to secure access to a right-of-way in which the City has interests, noting that this was a land or property negotiation matter. He noted that the outcome of this meeting would eventually be discussed in open session of Council. On motion of Councillor McGuire Seconded by Councillor Titus RESOLVED that the public be excluded from the meeting for the duration of the discussion on the following matter: 1.1 Land Matter 10.2(4)(c) Question being taken, the motion was carried. Record Pursuant to Section 10.2(4) The meeting of the Committee of the Whole of Common Council held on July 25, 2011 was closed to the public pursuant to Section 10.2(4) of the Municipalities Act during the Committee's discussion of the following matter: 1.1 Land Matter 10.2(4)(c) Common Clerk
