Your Worship, Deputy Mayor and Councillors:
Subject: Committee of the Whole Resolution Respecting Kennebecassis Park Water
Supply Breach of 1996 Agreement
The Committee of the Whole, having met on February 14th, 2011 adopted the following
resolution:
RESOLVED that Committee of the Whole (Closed Session) recommends to Common Council
that the City Solicitor or his designate be authorized to commence legal proceedings against the
Town of Rothesay before the Court of Queen's Bench of New Brunswick arising from the Town
of Rothesay's breach of a 1996 Agreement between its predecessor, the Village of Renforth,
and The City of Saint John respecting the supply of water by The City of Saint John to the areas
known as Kennebecassis Park and Hastings Cove in the Town of Rothesay, and further, that
the Clerk be directed to add this resolution to Council's open session agenda of February 14,
2011.
