Meeting Called To Order The Mayor called the Committee of the Whole meeting to order. 2. Discussion of Confidential Matters On motion of Councillor Court Seconded by Councillor Sullivan RESOLVED that the public be excluded from the meeting for the duration of the discussion on the following matters: 1. Approval of Minutes, September 27, 2010; 1.0 Land Matter 10.2(4)(d); 1.1 Litigation 10.2(4)(g); 1.2 Nominating Committee 10.2(4)(b); 1.3 Board Vacancy 10.2(4)(b); 1.4 Land Matter 10.2(4)(d); 1.5 Property Matter 10.2(4)(b,g); 1.6 Litigation 10.2(4)(f,g); 1.7 Legal Matter 10.2(4)(f,g,j); 1.8 Financial Matter 10.2(4)(c); 1.9 Financial Matter 10.2(4)(c) Question being taken, the motion was carried. On motion of Councillor Sullivan Seconded by Councillor McGuire RESOLVED that the meeting reconvene in Committee of the Whole Open Session. Question being taken, the motion was carried. The Committee of the Whole open session reconvened at 6:45 in the 8 th floor boardroom, City Hall. On motion of Councillor Titus Seconded by Councillor McGuire 1 Committee of the Whole Open Session October 12, 2010 1.1 Disability Pension Litigation I.A.F.F Local 771 Court of Appeal Motion for Fresh Evidence Common Clerk 2 Committee of the Whole Open Session October 12, 2010 RESOLVED that the City Solicitor or his designate is hereby authorized to disclose in the form of an affidavit by an officer of the municipality filed with the Court of Appeal of New Brunswick in Court File No. 73- 10 -CA, any documentation or minutes of the Committee of the Whole closed session which relate to the involvement of the City of Saint John Pension Board in the City's decision making process leading to the petition to the legislature of New Brunswick for the enactment of the City of Saint John Pension Act Chapter C- 112- SNB1994 as well as to the petitions for amendments thereto, which documentation or minutes in the City Solicitor's opinion are relevant to the contra proferentem interpretive issue in this case. Question being taken, the motion was carried with Councillors Higgins and Farren voting nay. The meeting was adjourned at 6:45 p.m. Record Pursuant to Section 10.2(4) The meeting of the Committee of the Whole of Common Council held on October 12th, 2010 was closed to the public pursuant to Section 10.2(4) of the Municipalities Act during the Committee's discussion of the following matters: 1.
