The Mayor called the Committee of the Whole meeting to order.

RESOLVED that the public be excluded from the meeting for the duration
of the discussion on the following matters: 1. Approval of Minutes, September 27, 2010; 1.0

The Committee of the Whole open session reconvened at 6:45 in the 8 th floor boardroom, City

RESOLVED that the City Solicitor or his designate is hereby authorized to
disclose in the form of an affidavit by an officer of the municipality filed with the Court of Appeal
of New Brunswick in Court File No. 73- 10 -CA, any documentation or minutes of the Committee
of the Whole closed session which relate to the involvement of the City of Saint John Pension
Board in the City's decision making process leading to the petition to the legislature of New
Brunswick for the enactment of the City of Saint John Pension Act Chapter C- 112- SNB1994 as
well as to the petitions for amendments thereto, which documentation or minutes in the City
Solicitor's opinion are relevant to the contra proferentem interpretive issue in this case.
Question being taken, the motion was carried with Councillors Higgins and Farren voting nay.
The meeting was adjourned at 6:45 p.m.
