Debt the PC can borrow with the permission of the City. The PC will repay the debt incurred to build the garage with revenues it derives from parking fees. The PC aiso has a cash reserve it can draw on if it does not raise sufficient funds in any year. The City is exposed to risk in so much that if sufficient revenues are not generated to cover the debt then the City would be obligated to cover the debt. This is high!y unlikely. Property Tax Rebate the PC is owned by the City. The Parking Commission via the Parking Commission Act is not required to pay the City of Saint John property taxes based on Section 13. The Act references the payments are payments "in lieu of" municipal property taxes. The PC will pay municipal property taxes to the City and the City will rebate the taxes to the PC. In this regard, the City and the PC will be in the same financial position after construction of the garage as before le the City does not have a tax revenue from the PC and the PC does not have a tax expense to the City. In other words it 15 a wash. Council Decision(s) the key decision that Council will be asked to make is whether or not it wants to authorize the PC to borrow the funds needed to construct the garage. Based on the PC Act, the City of Saint John would need to pass a resoution to guarantee a loan. Council will also have to determine the extent of the tax rebate that it is prepared to offer the PC in any given year. For example a good year for revenues may limit the need for a full rebate.
