September 10, 2008 Mayor and Council City of Saint John Saint John N.B. Mayor and Councillors, I am writing with regard to a rezoning application concerning Mountain View Drive in Forest Hills. This plan has passed First and Second Reading due to a flawed process. I am asking that this issue be reopened for Public Hearings so that the process can begin again and all due consideration be given before a final decision is reached. Two years ago, people in Forest Hills and High Meadow Park met with the Planning Advisory Committee and the developer voicing our many concerns about a proposed development on Mountain View Drive, which would see the construction of three three- storey apartment buildings. An agreement was made whereby the area would not be rezoned and garden homes (presently still under construction) would be built instead. This summer a new development was proposed for the opposite side of Mountain View Drive on an even larger scale than the one proposed two years ago . As it was advertised at the height of the summer season and notices were only provided to the residents of Myles Subdivision., Highmeadow Park and half of the residents on Carlisle Crescent, most of the concerned citizens from two years ago were unaware of the application. It was even noted at the meeting between the developer and the residents of Myles Subdivision and Highrneadow Park that there was no one in attendance from elsewhere in Forest Hills. I believe this points to a flawed process. I also feel that the Planning Advisory Committee has an obligation to plan neighbourhoods and other areas of the city respecting established patterns, i.e. residential, industrial, etc.. In this instance they should have referred to the issues already raised and resolved two years ago and proceeded accordingly. I respectively submit that the process used in moving this, development to the current stage was flawed and the matter should be reopened. That was done and the Saint John Police Force in turn asked the RCMP to respond. We have received advice from the RCMP that they will not undertake an investigation at this time, providing as their reason that the City has not yet suffered any loss and until that can be shown an investigation is premature, Respectfully Submitted, John .
