Re: 97 Union Street
By resolution adopted April 23, 2007, Common Council authorized the
acquisition of97 Union Street with a closing by May 31,2007.
This Department is still awaiting notice that the Vendor's solicitor has received
and recorded in the Saint John County Registry Office, certain probate records
issued by the Courts in the State of Massachusetts. The records have, we are
advised, been requested and receipt is anticipated daily.
In the event that the probate records are not recorded by May 31 S\ the sale
cannot be completed. The purpose of this letter is to request that Common
Council extend the closing date to June 29,2007.
We suggest that an appropriate resolution in this case would be as follows:
RESOLVED that the Common Council resolution of April 23,
2007 be amended by deleting "May 31, 2007" and substituting
therefor "June 29,2007".

SUBJECT: CONTRACT 2007-27: ASPHALT CONCRETE RESURFACING 2007
- ADDITIONAL STREET
PURPOSE
The purpose of this report is to recommend the inclusion of an additional street to Contract 2007-
27: Asphalt Concrete Resurfacing 2007.
. Manawagonish Road (Ridge Row to Westgate Drive)
BACKGROUND
M&C 2007-163 is before Council this evening recommending the award of Contract 2007-27:
Asphalt Concrete Resurfacing 2007 for the resurfacing of 18 streets or segments of streets.
Last week, on May 22nd, Council awarded Contract 2007-1 in the amount of$2,850,341
(estimated quantities) for the full reconstruction of Manawagonish Road from Fairville
Boulevard to Ridge Row. There is considerable related underground water, sanitary and storm
sewer construction involved in the contract. The street reconstruction work is being undertaken
through the Municipal Designated Highways (MDH) Grant Program.
Other work slated to complete Manawagonish Road in 2008 with contributions under the
Provincially funded MDH Program (with approximate costs) include:
1. Ridge Row to Westgate Drive
- asphalt cold milling and resurfacing only

2. Westgate Drive to Gault Road
- road widening, storm sewer, curb, sidewalk
(north side) and landscaping
$715,000
The smaller section ($67,500) is planned to be invoiced to the Department of Transportation in
2008, along with work being undertaken this year under Contract 2007-1. The remaining section
($715,000) would be invoiced in 2009.
ANALYSIS
An open house was held on May 9th to provide the public with information on the 2007
Manawagonish Road (Fairville Boulevard to Ridge Row) project. Various questions and
concerns were brought forward by citizens, with the greatest being the street's "truck route"
designation and the noise/vibrations related thereto. Some of the concern relates to the section of
street between Ridge Rowand Westgate Drive.
It has been requested that this section be cold milled and resurfaced this year, instead of waiting
until 2008. People feel that this would address some of the noise/vibration problem. It was
requested that this possibility be discussed with DOT.
After discussing the questions with a representative of the Department of Transportation and
reviewing the 2007 unit price for asphalt under Contract 2007-27, staff is recommending the cold
milling and resurfacing work be undertaken this year. DOT will be invoiced for payment under
the MDH Program this year, in the event funding might be available before 2008.
Staff reminds Council and the public that final surface lift of asphalt for the Fairville Boulevard
to Ridge Row section will only be placed next year in the summer of 2008. All other work on
this major project will be completed in 2007.
FINANCIAL IMPLICATIONS
If the recommendation is approved by Council, the resurfacing work on Manawagonish Road
between Ridge Rowand Westgate Drive will take place in 2007 with the approximate $67,500
cost for the work to be invoiced to the Province no later than 2008.

RECOMMENDATION
It is recommended Council authorize the resurfacing of the section of Manawagonish Road from
Ridge Row to Westgate Drive under Contract 2007-27: Asphalt Concrete Resurfacing 2007 at
an additional cost of $67,500 as calculated based on estimated quantities.
