RESTRICTIONS
WITHIN THE CITY OF SAINT JOHN
ENACTED
UNDER THE AUTHORITY OF SECTION
262(1) OF
THE MOTOR VEHICLE ACT
Be it enacted by the Common Council of
The City of Saint John, as follows:

Le conseil communal de The City of Saint
John edicte :
1 This By-Law may be cited as the "Saint 1 Le present arrete peut etre cite sous Ie

2 Except as provided herein, vehicles may be
operated within The City of Saint John with each
axle weight not exceeding eighty percent (80%) of
the axle weights permitted under the Motor Vehicle
Act (Chap. M -17) provided that each axle weight
does not exceed that upon which the registered
vehicle weight of the vehicle is based.
3 The weight restnctlOn herein applies
during the weight restriction period or periods of
time specified and published each year by the
Minister of Transportation pursuant to section 36 of
the Highway Act (Chap. H-5) as applicable for
Saint John County.

3 Les limitations de poids ci-prevues

par Ie ministre des Transports en vertu de
l'article 36 de la Loi sur la voirie (chapitre H-5) et
qui s'appliquent au comte de Saint-Jean.

5(a) Where a person operates a motor vehicle
on a highway within The City of Saint John with
respect to which the weight restriction is in effect
and the weight per axle is in excess of the weight
restriction, that person commits an offence.
5(b) A person who commits an offence under
this by-law is liable to a fine of not less than $25.00
and not more than $50.00. He may make a
voluntary payment of the minimum fine to the
Chief of Police any time prior to the laying of the
information and upon such payment is not liable to
be prosecuted therefore.

5(b) Une personne qui commet une infraction
au present arrete est passible d'une amende
minimale de 25 $ et d'une amende maximale de
50 $. Elle peut acquitter volontairement l'amende
minimale aupres du chef de police en tout temps
avant Ie depot de la denonciation, apres quoi elle
n' est plus passible de poursuite a cet egard.

any highway within The City of Saint John, the
Chief City Engineer or someone designated by him
to act on his behalf, may reduce the allowable axle
load or temporarily close the highway to all
trucking by posting on the highway a notice to that
effect.
7 Passenger buses and service vehicles are
exempt from these restrictions.
8 The operator of a vehicle which is found to
have an axle weight exceeding the weight
restriction herein shall not proceed until all axle
weights of the vehicle are within the weight
restrictions herein, either by redistribution of load
or by off-loading onto another vehicle. It is an
offence to fail to comply with this section.
9 A by-law of The City of Saint John enacted
on the eleventh day of March, 1996 entitled "By-
Law Number MV-I21 A By-Law Respecting
Weight Restrictions Within The City Of Saint John
Enacted Under The Authority Of Section 262( I) Of
The Motor Vehicle Act is repealed on the coming
into force of this by-law.
IN WITNESS WHEREOF The City of Saint John
has caused the Corporate Common Seal of the said
City to be affixed to this by-law the 5th day of
April, AD. 2004 and signed by:

la limitation de poids ci-prevue de poursuivre sa
route tant que Ie poids par essieu du vehicule n' est
pas rendu conforme aux limitations de poids
ci-prevues, soit en redistribuant la charge, soit en
en transferant une partie dans un autre vehicule.
Constitue une infraction Ie fait de ne pas se
conformer au present article.
9 L'arrete de The City of Saint John edicte Ie
II mars 1996 et intitule By-Law Number MV-121 A
By-Law Respecting Weight Restrictions Within The
City Of Saint John Enacted Under The Authority Of
Section 262(1) Of The Motor Vehicle Act est abroge
des l'entree en vigueur du present arrete.
