A BY-LAW RESPECTING PUBLIC BEACHES IN
THE CITY OF SAINT JOHN
MADE UNDER THE AUTHORITY OF SECTION
183 OF THE
MUNICIPALITIES ACT AND AMENDMENTS
THERETO
Be it enacted by the Common Council of The
City of Saint John as follows:
1 This By-law may be cited as the "Public Beaches
By-law".

edicte :
1 Le present arrete peut etre cite sous Ie titre:

3 For the purpose of this by-law public beach
includes the adjacent parking lot, canteen, picnic site,
playground area, bathing houses, roadways and paths.
4(1) No person shall between the hours of 10 o'clock
in the evening and 5 o'clock of the following morning
during the months of June to September inclusive
(a) remain at a public beach
(b) enter a public beach, or
(c) swim or utilize the water at a public beach
unless special permission is granted by the Leisure
Services of The City of Saint John.
4(2) During the months of October to May, inclusive,
the public beach shall be open to the public from 8:00
a.m. to 6:00 p.m. daily unless Leisure Services provides
otherwise.
5 No person shall deface, remove, disturb or
otherwise interfere with any building, fence, beach, or
other structure, apparatus, emergency equipment or other
property at a public beach.

l'aire de pique-nique, Ie terrain de jeu, les cabines de
bains, les voies de circulation et les sentiers attenants.
4(1) A moins d'avoir obtenu une permission speciale
du service des loisirs de la ville de Saint John, il est
interdit, entre 22 h et 5 h Ie lendemain, de juin a
septembre inclusivement :
a) de demeurer sur une plage publique;
b) d' entrer sur une plage publique;
c) de se baigner a une plage publique ou d'utiliser
l'eau de la plage.
4(2) La plage publique est ouverte au public d' octobre
a mai inclusivement, de 8 h a 18 h tous les jours, a moins
que Ie service des loisirs n' en dispose autrement.

10 Any person failing to comply with the provisions
of this by-law commits an offence and shall be liable
upon summary conviction to a fine of not less than Five
($5.00) Dollars and not more than Fifty ($50.00) Dollars.
11 Any person failing to comply with the provisions
of this by-law may be ordered by the authorized City
Official to leave the public beach and such refusal to
leave shall constitute an offence under this by-law.
12 A by-law of The City of Saint John enacted on
the twenty-ninth day of June, 1970 entitled "A By-law
Respecting Public Beaches In The City Of Saint John
Made Under The Authority Of Section 183 Of The
Municipalities Act 1966 And Amendments Thereto" is
repealed on the coming into force of this by-law.
IN WITNESS WHEREOF The City of Saint John has
caused the Common Corporate Seal of the said City to be
affixed to this by-law the 5th day of July, AD. 2004 and
signed by

11 Le fonctionnaire municipal autorise peut
ordonner a toute personne qui omet de se conformer aux
dispositions du present arrete de quitter la plage publique
et tout refus d' obtemperer a un tel ordre constitue une
infraction au present arrete.
12 L'arrete de The City of Saint John edicte Ie
29 juin 1970 et intitule A By-law Respecting Public
Beaches In The City Of Saint John Made Under The
Authority Of Section 183 Of The Municipalities Act 1966
And Amendments Thereto est abroge des l'entree en
vigueur du present arrete.
EN FOI DE QUOI The City of Saint John a fait apposer
son sceau communal sur Ie present arrete Ie 5 juillet 2004,
