OR DEPOSITING OF LITTER IN THE CITY
OF SAINT JOHN

ARRÊTÉ INTERDISANT DE JETER OU DE
DÉPOSER DES ORDURES DANS THE CITY
OF SAINT JOHN
Be it enacted by the Common Council of Le conseil communal de The City of Saint

"litter" includes
(i) putxasoibla animal and
vegetable wastes resulting from the
handling, preparation, cooking and
consumption of food;

(ii) solid wastes, garbage, rubbish,
ashes, dead animals, abandoned

wastes; and

consisting of both combustible and
non-combustible wastes, such as
paper, wrappings, cigarettes,
cardboard, tin cans, yard clippings,
leaves, wood, glass, bedding,
crockery and similar materials.

"street" means a highway and sidewalk as
defined by the Motor Vehicle Act, as well
as any road, lane, alley, public square and
public parking lot within The City of Saint
John. (rue)
3 No person shall throw or deposit litter upon
any street except in public receptacles provided for
that purpose or in a public dump established under

qu'en donne la Loi sur les véhicules à
moteur, de même que tout chemin, voie,
ruelle, place publique et parc de
stationnement public se trouvant sur le
territoire de The City of Saint John. (street).
3 Il est interdit de jeter ou de déposer des
ordures sur une rue, sauf dans des contenants
publics fournis à cette fin ou dans un dépotoir
the provisions of "A Law to Provide for the
Collection of Garbage in The City of Saint John.
4 No person shall sweep into or deposit on
any street the accumulation of litter from any
building, lot, private sidewalk or driveway.
5 The owner of any building, lot, private
sidewalk or driveway shall not allow litter to
accumulate thereon so that it is likely to be blown
or scattered on any street.
6 No person, while operating a motor vehicle
in The City of Saint John, shall throw or deposit, or
cause or allow to be thrown or deposited from the
motor vehicle, litter upon any street.
7 No person shall operate a truck or other
motor vehicle within The City of Saint John unless
such vehicle is so constructed or loaded as to
prevent any load contents or litter from being
blown or deposited upon any street.
8 Any person who violates any of the
provisions of this By-Law is guilty of an offence
and liable to a penalty of not less the Twenty-Five
Dollars ($25.00) nar more than Fifty Dollars
($50.00).
(a) Notwithstanding Section 8, a person
who violates any provision of this by-law
may pay an amount equal to the minimum
penalty imposed under that section to the
Chief of Police on any person authorized
by him to act under this section either
before or after the institution of
proceedings against a person for violation
of the by-law and upon such payment the
person committing the violation is not
liable to further prosecution therefor.
9 A by-law of The City of Saint John enacted
on the twenty-second day of July, 1968 entitled "A
By-law Prohibiting The Throwing Or Depositing
Of Litter On Streets In The City of Saint John" and
all amendments thereto is repealed on the coming

4 Il est interdit de balayer dans la rue ou d'y
déposer l'accumulation d'ordures provenant soit
d'un bâtiment ou d'un terrain, soit d'un trottoir ou
d'une allée pour voitures privés.
5 Le propriétaire d'un bâtiment ou d'un
terrain ou d'un trottoir ou d'une allée pour voitures
privés ne peut laisser s'y accumuler des ordures de
telle sorte que le vent risque de les faire voler ou de
les disperser sur une rue.
6 Nul ne peut, en conduisant un véhicule à
moteur dans The City of Saint John, jeter ou
déposer, ou faire en sorte ou permettre que soient
jetées du véhicule ou déposées depuis celui-ci, des
ordures sur une rue.
7 Nul ne peut conduire un camion ou autre
véhicule à moteur dans The City of Saint John, sauf
si ce véhicule est construit ou chargé de telle sorte à
empêcher que volent ou que soient déposés sur une
rue le contenu de sa charge ou des ordures.
8 Quiconque enfreint le présent arrêté est
coupable d'une infraction et passible d'une amende
a'au moins de vingt-cinq et d'au plus cinquante
dollars.
a) Par dérogation à Particle 8, la
personne qui enfreint une disposition
quelconque du présent arrêté peut payer au
chef de police ou à la personne qu'il
autorise à agir au titre du présent article
une somme égale à l'amende minimale
infligée en vertu de cette disposition soit
avant, soit après l'introduction d'une
instance engagée contre elle pour violation
de l'arrêté, et, sur remise de ce paiement,
Pauteur de Pinfraction n'est passible
d'aucune autre poursuite à cet égard.
9 L'arrêté de The City of Saint John édicté le
22 juillet 1968 et intitulé A By-law Prohibiting The
Throwing Or Depositing Of Litter On Streets In
The City ofSaint.Iohn, ensemble ses modif~ications,
est abrogé dès l'entrée en vigueur du présent arrêté.

has caused the Corporate Common Seal of the said
City to be affixed to this by-law the 21st day of
November, A.D. 2005 and signed by:
