A BY-LAW IN RELATION TO THE KING
SQUARE, IN THE CITY OF SAINT JOHN
Be it ordained by The City of Saint John, in
Common Council, as follows:
1 Any person other than a civic employee in
performance of some duty thereon, who shall walk or be
in or upon any portion of the King Square, on the eastern
side of the Harbour, except the walks there laid out, or
tamper with any of the flower beds or plants, or who
shall injure or deface any of the trees in the said Square,
or any of the benches placed thereon, shall be liable to a
penalty of four dollars for each and every offence.
2 All fines, penalties and forfeitures imposed by
this By-law shall and may be sued for, prosecuted and
recovered, with costs, in the name of the Chamberlain of
The City of Saint John for the time being, before the
Police Magistrate of The City of Saint John, or Sitting
Magistrate at the Police Office, as provided by the laws
of this Province, to be paid and applied according to law
and the Charter of the City, or by action of debt in any
Court of competent jurisdiction; and shall be levied by
distress and sale of the goods and chattels of the person
upon whom the penalty shall be imposed, and for want
of goods and chattels whereon to levy, the person shall
be imprisoned in the Common Gaol of the City and
County of Saint John for the space of ten days.
Repeal
3 A by-law of The City of Saint John enacted on
the third day of August, 1908 entitled "A Law In
Relation To The King Square, In The City Of Saint
John" and all amendments thereto is repealed on the
coming into force of this by-law.
IN WITNESS WHEREOF The City of Saint John has
caused the Corporate Common Seal of the said City to
be affixed to this by-law the 7th day of November, A.D.

Le conseil communal de The City of Saint John
1 Toute personne, autre qu'un employé municipal
dans l'exercice de ses fonctions, qui marche ou se trouve
sur une partie de la place appelée King Square, du côté est
du port, sauf aux promenades y aménagées, ou qui
endommage ou dégrade les plates-bandes, les arbres ou les
bancs qui s'y trouvent est passible d'une amende de quatre
dollars pour chaque infraction.
2 Toutes les amendes, peines et confiscations
prévues au présent arrêté peuvent être et doivent être
recouvrées - notamment par voie d'action - avec dépens
au nom du trésorier actuel de The City of Saint John,
devant le magistrat de police de The City of Saint John ou
devant le magistrat saisi au poste de police, conformément
aux lois du Nouveau-Brunswick, en vue de leur paiement
et de leur affectation en conformité avec les règles de droit
et la charte de The City of Saint John, ou par voie d'action
en recouvrement de créance intentée devant tout tribunal
compétent; elles peuvent également être perçues par voie
de saisie et de vente des biens personnels de la personne à
qui la peine est imposée et, si elle ne possède aucun bien
personnel saisissable, elle sera incarcérée dans la prison
commune de The City of Saint John, comté de Saint John,
pour une période de dix jours.
Abrogation
3 L'arrêté de The City of Saint John édicté le
3 août 1908 et intitulé A Law In Relation To The King
Square, In The City Of Saint .Iohn, ensemble ses
modifications, est abrogé dès l'entrée en vigueur du
présent arrêté.
