A BY-LAW RESPECTING THE
PREVENTION OF EXCESSIVE NOISE
IN THE CITY OF SAINT JOHN
ARRETE NO M-22
ARRETE CONCERNANT LA PREVENTION
DE BRUIT EXCESSIF DANS
THE CITY OF SAINT JOHN
Be it enacted by the Common Council of Le conseil communal de The City of Saint John
The City of Saint John as follows: edicte :
1 This by-law may be cited as the "Saint
John Noise By-law ".

In this by-law:
"Chief of Police" means the Chief of Police
for The City of Saint John and, in his
absence, includes the Deputy Chief of
Police; (chef de police)
"City" means The City of Saint John;
(municipalite')
"Council" means Common Council of The
City of Saint John; (conseil)
"motor vehicle" includes a motor vehicle or
a motor cycle or motor driven cycle;
(vehicule a moteur)
"public address system" means any system
of loud speakers. amplifiers, microphones,
or reproducers, or any combination of any
such equipment. used in the reproduction
or amplication of music, speech, or other
sounds, when used for communication to
or otherwise addressing or entertaining a
person or persons; (systeme de
sonorisation)
"street" includes the entire width between
the boundary lines of every street. road,
lane, alley, park, parking lot, drive-in
theatre, school yard, picnic site, beach.
square, sidewalk, bridge, or footway within
the City; (rue)
The words <<motor vehicle >>, <<motor
cycle >>, and <<motor driven cycle>> when
used in this by-law shall have the same
meaning as set out in the definition section
of the Motor Vehicle Act of the Province

informer, avertir ou divertir une ou
plusieurs personnes. (public address
system)
<< vehicule a moteur>> S'entend notamment
d'un vehicule a moteur. d'une
motocyclette ou d'un cyclomoteur. (motor
vehicle)
Les termes << vehicule a moteur >>,
<< motocyclette >> et <( cyclomoteur >>,
lorsqu'ils sont utilises dans Ie present
arrete, ont la meme signification que celie
qui leur est attribuee dans ('article
of New Brunswick.
3 No person shall within the City during the
times set forth herein emit or cause or permit the
emission of sound or sounds resulting from an act
listed herein, which sound is clearly audible on a
street and which disturbs or would tend to disturb
the peace and tranquility of two or more persons
using the street or living in separate houses or
separate apartments or flats close to the street:
(a) the racing of any motor vehicle other
than in a racing event regulated by law - at
any time;
(b) the operation of a motor vehicle in such
a way that the tires squeal - at any time;
(c) the unnecessary idling or revving of a
motor vehicle engine - at any time;
(d) the operation of a motor vehicle horn or
any other warning device - at any time
except where required or authorized by law
or in accordance with good safety
practices;
(e) the operation of any combustion engine
or pneumatic device without an effective
exhaust or intake muffling device in good
working order and in constant operation -
at any time;
(f) the operation of any item of
construction equipment without an
effective muffling device in good working
order and in constant operation - at any
time;
(g) by yelling, shouting, hooting, or
unreasonably loud whistling or singing -- at
any time;
(h) the operation of domestic outdoor
power tools - between the hours of nine
o'clock in the evening and seven o'clock of
the following morning;

3 II est interdit, dans la municipalite, pendant
les heures indiquees dans Ie present arrete,
d'emettre, de faire emettre ou de permenre que soit
emis un ou des sons decoulant d'une des actions
enumerees ci-dessous, sons parfaitement audibles
dans une rue et qui troublent ou pourraient troubler
la paix et la tranquillite de deux ou plusieurs
personnes qui font usage de la rue ou qui vivent
dans des maisons, appartements ou logernents
distincts proches de la rue :
a) a tout moment, faire une course de
vehicules a moteur, sauf dans une
competition regie par la loi;
b) a tout moment, conduire un vehicule a
moteur de fa90n a faire crisser les pneus;
c) a tout moment, faire tourner inutilement
Ie moteur d'un vehicule au ralenti ou
donner des coups de gaz;
d) a tout moment, sauf dans les cas oil la
loi l'exige ou l'autorise ou conformement
aux regles en matiere de securite, utiliser
I'avertisseur d'un vehicule a moteur ou un
autre dispositif d'avertissement;
e) it tout moment, utiliser un moteur it
combustion ou un dispositif pneumatique
non muni d'un silencieux d'echappement
ou d'admission efficace en bon etat de
marche et fonctionnant de fa90n continue;
f) a tout moment, utiliser des engins de
chantier non munis d'un silencieux efficace
en bon etat de marc he et fonctionnant de
fa90n continue;
g) a tout moment, crier, huer, siffler ou
chanter it tue-tete:
h) entre 21 heures et 7 heures Ie lendemain,
utiliser des outils electriques domestiques
exterieurs;

(i) the operation of construction equipment
- between the hours of 9:00 o'clock in the
evening and 7:00 o'clock of the following
morning;
(j) the operation of a combustion engine
which is or is used in or is intended for use
in a toy or a model or replica of any device
which model or replica has no function
other than amusement and which is not a
conveyance - between the hours of 7:00
o'clock in the evening and 9:00 o'clock of
the following morning;
(k) the detonation of fire works or
explosive devices not used in construction -
at any time;
(I) the discharge of fire arms -- at any time;
(m) the operation of any public address
system, gramophone, radio or other device
or apparatus for reproducing or amplifying
sound -- at any time.
4 The provisions of this by-law which
prohibit excessive noises do not apply to:
(a) employees of the City or of the
Government of Canada or of the
Government of the Province of New
Brunswick when acting in the reasonable
execution of their duties as such an
employee:
(b) a person or an employee of a person
reasonably performing work at the request
of the City;
(c) noises in connection with athletic and
recreational activities in municipal park
areas, arenas, community centres, etc;
(d) noises in relation to traditional, festive,
and religious activities;
(e) noises in relation to parades, street
dances, and other community activities
i) entre 21 heures et 7 heures Ie lendemain,

k) a tout moment. faire exploser des pieces
d'artifice ou des dispositifs explosifs ne
servant pas Ii la construction;
1) it tout moment, de charger une arme it
feu;
m) it tout moment, utiliser un systeme de
sonorisation, un tourne-disque, une radio
ou un autre dispositif ou appareil pour
reproduire ou amplifier Ie son.
4 Les dispositions du present arrete qui
interdisent les bruits excessifs ne s'appliquent pas :
a) aux employes de la municipalite, du
gouvernement du Canada ou du
gouvernement de la province du Nouveau-
Brunswick qui agissent dans I'exercice
normal de leurs fonctions:
b) a une personne ou son employe qui
execute des travaux normalement, a la
demande de la municipalite;
c) aux les bruits produits au COUTS d'une
activite recreative ou sportive qui se
deroule dans un parc municipaL un arena,
un centre communautaire ou un autre
endroit de ce genre;
d) aux les bruits produits a l'occasion
d'une fete - notamment traditionnelle - ou
d'une activite religieuse:
e) aux les bruits produits au cours d'une
parade, d'une danse de rue et autre activite

authorized by the Council;
(f) noises caused by motor vehicles or
equipment being used for emergency
purposes.
5 This by-law shall be enforced by the Police
Department of The City of Saint John. An
information for breach of this by-law shall be laid
in the name of either the Chief By-law
Enforcement Officer of the City or by the Common
Clerk of the City.
6 A person who violates any provision of this
by-law is guilty of an offence and liable on
summary conviction to a fine of not less than Fifty
($50.00) Dollars and not more than Two Hundred
($200.00) Dollars.
REPEAL
7 A by-law of The City of Saint John enacted
on the third day of October, 1983 entitled "A By-
law Respecting The Prevention Of Excessive Noise
In The City Of Saint John" and all amendments
thereto is repealed on the coming into force of this
by-law.

denonciation relative a une infraction au present

communal.
6 Quiconque enfreint Ie present arrete
commet une infraction et est passible, sur
declaration de culpabilite par procedure sommaire,
d'une amende d'au moins cinquante dollars et d'au
plus deux cents dollars.
ABROGATION
7 L'arrete de The City of Saint John intitule
A By-law Respecting The Prevention Of Excessive
Noise In The City Of Saint John, edicte Ie 3
octobre 1983, ensemble ses modifications, est
abroge des l'entree en vigueur du present arrete.
