A BY-LAW RESPECTING THE
PREVENTION OF EXCESSIVE NOISE
IN THE CITY OF SAINT JOHN
Be it enacted by the Common Council of
The City of Saint John as follows:
A By-Law of The City of Saint John
entitled "Saint John Noise Bv-Law" enacted on the
18th day of May, A.D. 2005: is hereby amended as
follows:

Par les presentes, l' arrete de The City of
Saint John intitule "Arrete de Saint John
concernant Ie bmit" edicte Ie 18 may 2005 est
modifle comme suit:
1 Section 3 IS repealed and the following IS 1 L'aliicle 3 est aborge et remplace par ce qui
substituted: suit:
3(1) No person shall during the times set out in
subsection 3(3) make a noise which results from an
action listed therein if the noise is clearly audible
on a street and is likely to cause a public nuisance
or otherwise disturb one or more inhabitants of the
City.
3(2) No person shall during the times set out in
subsection 3(3) permit to be made on propeliy
which is owned by him or is leased by him a noise
which results from an action listed therein if the
noise is clearly audible on a street and is likely to
. .
cause a public nuisance or otherwise disturb one or
more inhabitants of the City.
3(3) The actions and times relating to this By-Law
are:
a) The racing of any motor vehicle other than
in a racing event regulated by law, at any
time:
b) The operation of a motor vehicle in such a
way that the tires squeal, at any time:
c) The unneceSSalY idling or revving of a
motor vehicle engine, at any time:
d) The operation of a motor vehicle horn or
any other warning device, at any time
except where required or authorized by law
or in accordance with good safety
3(1) II est interdit, pendant les heures indiquees au
paragraphe 3(3), d'emettre un ou des sons
decoulant d \me des actions emllnerees audit
paragraphe 3(3), sons parfaitement audibles dans
une me et qui causent ou pourraient causer une
nuisance publique ou qui pourraient derangeI' un ou
plus d'un citoyen de la ville.
3(2) II est interdit, pendant les heures indiquees au
paragraphe 3(3), au proprietaire ou au locataire
d'une propriete de permettre que soit emis de sa
propriete ou de son loyer un ou des sons decoulant
d'une des actions enumerees audit paragraphe 3(3),
sons parfaitement audibles dans une me et qui
causent ou pourraient causer une nuisance publique
ou qui pourraient derangeI' un ou plus d'un citoyen
de la ville.
3(3) Les actions et les heures qui s'appliquent au
present arrete sont les suivants :
a) a tout moment, faire une course de vehicules a
moteur, sauf dans une competition regie par la loi;
b) a tout moment, conduire un vehicule a moteur de
fayon a faire crisser les pneus:
c) a tout moment, faire tourner inutilement Ie
moteur d'un vehicule au ralenti ou donneI' des
coups de gaz;
d) a tout moment, sauf dans les cas 011 la loi l' exige
ou l' autorise ou confonnement aux regles en
matiere de securik utiliser l'aveliisseur d'un
vehicule a moteur ou un autre dispositif

e) The operation of any combustion engine or
pneumatic device without an effective
exhaust or intake muffling device in good
working order and in constant operation, at
any time:
f)
The operation of any item of constmction
equipment without an effective muffling
device in good working order and in
constant operation, at any time;
g) By yelling, shouting, hooting, or
unreasonably loud whistling or singing, at
any time;
h) The operation of domestic outdoor power
tools, between the hours of 9: 00 0' clock in
the evening and 7:00 o'clock of the
following morning:
i)
The operation of constmction equipment,
between the hours of 9:00 o'clock in the
evening and 7:00 o'clock of the following
morlllng:
j)
The operation of a combustion engine
which is used in or is intended for use in a
toy or a model or replica of any device
which model or replica has no function
other than amusement and which is not a
conveyance, between the hours of 7:00
o'clock in the evening and 9:00 o'clock of
the following morning:
k) The detonation of fire works or explosive
devices not used in construction, at any
time:
1) The discharge of fire arms, at any time:
m) The operation of any public address
system, gramophone, radio or other device
or apparatus for reproducing or amplifying
sound. at any time.

silencieux d' echappement ou d' admission efficace
en bon etat de marche et fonctionnant de fac;on

f) a tout moment, utiliser des engins de chantier

marche et fonctiOlmant de fac;on continue;
g) a tout moment, crier, hueI', siffler ou chanter a
tue-tete:
h) entre 21 heures et 7 heures Ie lendemain, utiliser
des outils electriques domestiques exterieurs:
i) entre 21 heures et 7 heures Ie lendemain, utiliser
des engins de chantier:
j) entre 19 heures et 9 heures Ie lendemain, faire
fonctionner un moteur a combustion utilise ou
destine a etre utilise dans un jouet, un modele ou
une replique d'un dispositif ne servant pas de
moyen de transpOli et n'ayant d'autre utilite que
celle de diveliir:
k) a tout moment, faire exploser des pieces
d'aliifice ou des dispositifs explosifs ne servant pas
ala constmction:
1) a tout moment, decharger une anne a feu:
m) a tout moment, utiliser un systeme de
sonorisation, un tourne-disque, une radio ou un
autre dispositif ou appareil pour reproduire ou
amplifier Ie son.
2 Section 5 is repealed and the following IS 2 L'aliicle 5 est abroge et remplace par ce qui
substituted: suit:
5(1) Members of the Saint Jolm Police Force are
authorized to enforce this By-Law.
5(1) L'application du present arrete releve du
service de police de The City of Saint John.

5(2) Informations with respect to violations of this
By-Law may be laid in the Provincial Comi by the
Common Clerk or by such other persons as may be
designated by Common Council.
5(2) Toute denonciation relative a une infraction
au present arrete est deposee a la Cour Provinciale
par Ie greffier communal ou par toute autre
personne designee par Ie Conseil Communal.
3 Section 6 is repealed and the following IS 3 L' aliicle 6 est abroge et remplace par ce qui
substituted: suit:
6. A person who violates any provision of this By-
Law is guilty of an offence and is liable on
summary conviction to a fine of not less than Two
Hundred Fifty Dollars ($250.00) and not more than
One Thousand and Seventy Dollars ($1,070.00).
IN WITNESS WHEREOF The City of Saint John
has caused the Corporate Common Seal of the said
City to be affixed to this by-law the 24th day of
April, A.D. 2006 and signed by:
6. Quiconque enfreint Ie present arrete commet
une infraction et est pas sible, sur declaration de
culpabilite par procedure sommaire, d'une amende
d'au moins deux cents cinquante dollars (250,00$)
et d'au plus mille soixante-dix dollars (1 070,00$).
