A LAW RELATING TO THE PUBLIC
STREETS IN THE CITY OF SAINT JOHN
AND TO PREVENT CERTAIN NUISANCES
IN THE SAID CITY
Be it ordained by the Mayor, Alderman and
Commonalty of The City of Saint John, in
Common Council convened, as follows:
1 The term "street", in this law, shall include
public streets, alleys, lanes and thoroughfares
within The City of Saint John.
2 No person shall put, lay, or place, or cause
to be put, laid, or placed, in or upon any street
within this City, any timber or lumber of any kind,
or any stone, brick, lime, or material for building
purposes, or any earth, rubbish or ashes of any sort
except the same be placed in barrels, boxes or other
suitable receptacles, and in which case they must
be removed forthwith, or any encumbrance or
obstruction whatsoever, without having first
obtained permission in writing so to do, as
hereinafter in this section provided, under the
penalty of two dollars for every such act. Provided,
that permission may be given to persons who are,
or may be, erecting or repairing any building, to
occupy or encumber a space on any street not more
than one-third part of the width of any such street,
and not extending farther than the breadth of the lot
on which the building is being erected, such
permission to be granted by the Commissioner of
Municipal Operations for the time being or other
person authorized by the Common Council, the
permit to state the space of the street permitted to
be so occupied, and the time during which the
occupation shall continue. Every person obtaining
such permission shall, at his own expense, cause
such building materials to be enclosed with a
sufficient fence, and shall keep the same so
enclosed; and shall, also, place suitable and
sufficient lights upon the said building materials,
and keep the lights burning from twilight through
every night, to prevent injury to persons passing on
the street; and shall not riddle or slack any lime, or
mix any mortar, or cut, or dress any stone or timber
on the space of the street permitted to be occupied,
or do any work to the annoyance or disturbance of
persons passing on the street; and shall remove all

Le maire, et les autres membres du conseil
communal de The City of Saint John, reunis en
conseil communal, edictent :
1 Lorsqu'il est utilise dans le present arrete,
le mot « rue » s'entend egalement des rues, allees,
ruelles et routes publiques dans The City of
Saint John.
2 Il est interdit de poser, de placer ou de faire
poser ou placer, dans ou sur une rue de la
municipalite, du bois d'oeuvre quel qu'il soit, ou de
la pierre, de la brique, de la chaux, des materiaux
de construction, ou de la terre, des ordures et des
cendres de quelque nature que ce soit, sauf dans des
barils, boites ou autres recipients convenables, qui
doivent etre enleves sans delai, ou toute
obstruction, quelle qu'elle soit, sans avoir
prealablement obtenu une permission ecrite a cet
egard conformement aux dispositions qui suivent
du present article, sous peine d'une amende de
deux dollars pour chaque manquement de cette
nature. Il demeure entendu qu'une permission peut
etre accordee aux personnes qui construisent ou
reparent un immeuble ou qui sont susceptibles de le
faire les autorisant a occuper un espace ne pouvant
depasser le tiers de la largeur de cette rue ni
s'etendre au-dela de la largeur du lot sur lequel
1'immeuble est construit, lequel permis est accorde
par le commissaire aux Travaux municipaux ou la
personne habilitee a cette fin par le conseil
communal et indique 1'espace dans la rue qui peut
etre occupe et la periode au cours de laquelle
1'occupation se poursuivra. La personne qui obtient
une telle permission fait entourer, a ses propres
frais, les materiaux de construction d'une cloture
suffissante qu'elle garde fermee, y place des
appareils d'eclairage appropries en nombre
suffisant et veille a ce qu'ils soient allumes de la
tombee du jour a 1'aube afin de prevenir que les
personnes passant sur la rue ne se blessent. La
personne qui obtient la permission ne peut
detremper ou tamiser de la chaux, melanger du
mortier, couper du bois ou tailler des pierres dans
1'espace de la rue dont 1'occupation est permise ni

obstructions from the street on the expiration of the
time of the permit, and clear away all rubbish, and
leave the street in good order and condition, under
the penalty of eight dollars for every breach of any
regulation on which said permit is authorized.
3 Every such encumbrance or obstruction,
unlawfully being on any street, shall be forfeited to
the City Corporation, and, in addition to the
penalties hereinbefore provided, it shall and may be
lawful for the Mayor, the Board of Public Works,
the Commissioner of Municipal Operations, or the
Superintendent of Streets, or any person authorized
by the Common Council at any time, to remove, or
cause to be removed from any street, any such
encumbrance or obstruction placed there without
permission as contained in the last section, or
remaining on any such street after the permission
has expired, and to cause the same to be conveyed
away, and, if of sufficient value, to pay the expense
of sale, to be sold at public auction to the highest
bidder, or to be sold on the spot for the purpose of
removal. Provided, however, that before any such
encumbrance or obstruction be sold, as aforesaid,
three days' public notice of such sale be first given
by advertisement in a public newspaper in The City
of Saint John; and the person or persons owning
such encumbrance or obstruction may at any time
previous to such sale take away the same upon
payment of all expenses incurred on account
thereo£ The proceeds of any such sale shall be
applied so far as the same may extend, to the
payment of the expenses of such removal and sale,
and of any penalty imposed under this law relating
to such encumbrance or obstruction, rendering the
over-plus, if any, on demand to the person whose
ownership in such encumbrance or obstruction may
have been forfeited hereunder.
4 No person shall unload, put, or place, or
cause to be placed, any firewood or coals upon the
foot-path or sidewalk of any street, under the
penalty of two dollars for every such act. All
firewood or coals unladen in any street shall be
placed outside of the curbing or sidewalk along the
street from the gutter outwards; and all firewood so
unladen shall be immediately piled within two feet
of the curbing toward the middle of the street, and
in not more than one tier along the length of the
street. No wood or coals shall be suffered to

3 Chaque article qui constitue une
obstruction et qui se trouve illegalement sur une rue
est confisque au profit de The City of Saint John et,
en plus d'imposer les amendes prevues ci-dessus, il
est loisible au maire, a la commission des Travaux
publics, au commissaire aux Travaux municipaux,
au directeur de la voirie ou a toute personne ainsi
autorisee par le conseil communal d'enlever ou de
faire enlever I'article qui y est place sans avoir
obtenu la permission prevue a I'article 2 ou qui y
reste apres 1'expiration du permis, de le faire
transporter et, si la valeur est suffisante, de payer
les frais de la vente, de le faire vendre dans le cadre
d'une vente aux encheres publique consentie au
plus haut soumissionnaire, ou encore de le faire
vendre sur place afin qu'il soit enleve. Il demeure
toutefois entendu que, avant que I'article
constituant cette obstruction ne soit vendu de la
fa~on susmentionnee, un avis public de trois jours
de la vente doit paraitre dans un journal public dans
The City of Saint John et la personne a qui

4 Il est interdit de decharger, de placer ou de
faire placer du bois de chauffage ou du charbon sur
le trottoir ou la voie pietonniere d'une rue, sous
peine d'une amende de deux dollars pour chaque
manquement de cette nature. Le bois de chauffage
ou le charbon decharge sur une rue est place a
1'exterieur de la bordure de chaussee ou du trottoir
le long de la rue a partir du caniveau; le bois de
chauffage ainsi decharge est immediatement empile
a moins de deux pieds de la bordure de chaussee,
vers le milieu de la rue, et dispose de fa~on a

remain on any street for any longer time than may
be necessary for the immediate removal of the
same after being unladen, under the penalty of two
dollars for every load not so immediately removed,
to be paid by the person for whom the same may
have been unloaded; and the further penalty of one
dollar each hour, for every hour the same may be
allowed to remain on any street after two hours,
from the time when the same may have been
unladen.
5 No person shall saw or split any firewood
upon any foot-path or sidewalk of any street, nor
place the same thereon, or stand upon any such
foot-path or side-walk, with a wood-saw or horse,
under the penalty of two dollars for every such act.
Firewood may be sawed on a street outside of the
curbstone and gutter within one-half of the space
toward the middle of the street, provided that the
firewood is removed from the street as fast as it is
sawed, and the sawdust removed and the street
there cleaned up without delay, under the penalty
of two dollars for every neglect.
6 Any firewood or coals suffered to remain
on any street, after notice from the Chief of Police,
or any policeman, for the removal thereof, may be
dealt with as an encumbrance or obstruction under
the third section of this law.
7 No lime shall be slacked or riddled on any
street, or on any part of any public square in this
City, under the penalty of eight dollars for every
such act.
8 No person or persons, bodies corporate or
otherwise, shall dig up or excavate, or cause to be
dug up or excavated, any part of any street or
sidewalk, or any part of any public square, or to
remove any pavement whatever of the streets of the
said City, for any purpose, without first procuring a
permit from Municipal Operations of the said City,
under the penalty of twenty dollars, said permit
shall be given under the hand of the Commissioner
of the Department, and the person applying for
such permit shall, before obtaining the same,
deposit with the said Commissioner the sum of ten
dollars as security that the street, sidewalk or

5 Il est interdit de scier, de fendre ou de
placer du bois de chauffage sur le trottoir ou la voie
pietonniere d'une rue ou de s'y tenir avec une scie
a buches ou un chevalet de sciage, sous peine d'une
amende de deux dollars pour chaque manquement
de cette nature. Il est permis de scier du bois de
chauffage sur une rue, a 1'exterieur des bordures et
caniveaux, jusqu'a la moitie de Pespace vers le
milieu de la rue, pourvu que le bois de chauffage
soit enleve de la rue des qu'il est scie et que la
sciure et la rue soient nettoyees sans delai, sous
peine d'une amende de deux dollars pour chaque
cas de negligence.
6 Le bois de chauffage ou le charbon qui
reste sur une rue apres que le chef de police ou un
policier a donne un avis visant son enlevement peut
etre considere comme une obstruction
conformement a 1'article 3 du present arrete.
7 Il est interdit de detremper ou de tamiser de
la chaux sur une rue ou sur toute partie d'une place
publique de la municipalite, sous peine d'une
amende de huit dollars pour chaque manquement
de cette nature.
8 Il est interdit a toute personne, physique ou
morale, d'excaver ou de faire excaver toute partie
d'une rue, d'un trottoir ou d'une place publique, ou
d'enlever un revetement quelconque d'une rue de
la municipalite, peu importe le but, sans avoir
d'abord obtenu un permis aupres du service des
Travaux municipaux signe par le commissaire du
service, sous peine d'une amende de vingt dollars,
et sans avoir depose aupres du commissaire un
montant de dix dollars en garantie du fait que la
rue, le trottoir ou la place sera remis dans un aussi
bon etat que celui dans lequel il se trouvait au
moment de la demande de permis. Lorsque cette

time of applying for the permit. The Commissioner
shall pay over to the Chamberlain every week the
moneys thus received by him, and the Chamberlain
shall return the same to the person or persons who
made the deposit, upon receiving a certificate from
the Superintendent of Streets of the said City that
the street, sidewalk or square is left in as good
condition as the same was in before such opening
or excavation was made. Whenever such
permission shall have been given the work
permitted shall be proceeded with without delay,
and the street, sidewalk or square left in as good
condition as the same was in before such opening
or excavation, under the penalty of eight dollars
each day for every day the street or square may be
allowed to remain in an unfinished and incomplete
condition.
9 No person shall ride, drive, or lead any
horse or other beast, or drive, wheel, or draw any
coach, cart, hand-cart, hand-barrow, carriage, or
conveyance of any kind, except hand-carriages
conveying children only and drawn by hand, upon
any foot-path or sidewalk of any street or square,
unless for the purpose of going directly across any
such foot-path or sidewalk into a yard, or permit
any horse or other beast, in his care or charge, to
stand upon any foot-path or sidewalk, under the
penalty of two dollars for every such act. If any
person shall break into, or otherwise injure or
damage any foot-path or side-walk, or the curbing
of the same, he shall forthwith cause the same to be
repaired and amended, under the penalty of eight
dollars for every neglect, and the further penalty of
four dollars each day for every day during which
such damage shall continue without sufficient
repair and amendment.
10 No person shall drive, or permit his horse
or horses in any hackney carriage, wagon, carriage,
vehicle, or conveyance, whether on wheels or
runners, to go at a rate of speed faster than a
moderate trot in any street or square, or to go
otherwise than on a walk on the North Market
Wharf in King's Ward, or on the South Market
Wharf in Queen's Ward, or upon the Public Pier in
Duke's Ward, or in turning the corner of any street,
under the penalty of two dollars for every breach of
permission est accordee, il est procede sans delai

les travaux ou dans un meilleur etat, sous peine
d'une amende de huit dollars pour chaque jour au

Le commissaire remet chaque semaine au tresorier
les sommes ainsi re~ues et le tresorier les
rembourse aux personnes qui les ont versees sur
reception d'un certificat dans lequel le directeur de
la voirie de Saint John atteste que la rue, le trottoir
ou la place a ete remis dans 1'etat dans lequel il se
trouvait avant 1'excavation en question ou dans un
meilleur etat.
9 Il est interdit de chevaucher, de conduire
ou de diriger un cheval ou une autre bete ou encore
de conduire, de faire rouler ou de tirer une voiture,
un chariot, une charrette a bras, une civiere ou un
autre moyen de transport de quelque nature qu'il
soit, sauf un chariot qui sert uniquement au
transport des enfants et qui est tire a la main, sur un
trottoir ou une voie pietonniere d'une rue ou d'une
place, sauf dans le but de traverser directement ce
trottoir ou cette voie pour se rendre dans une cour,
ou de permettre qu'un cheval ou une autre bete
dont il est responsable reste sur un trottoir ou une
voie pietonniere, sous peine d'une amende de deux
dollars pour chaque manquement de cette nature.
Toute personne qui endommage un trottoir, une
voie pietonniere ou une bordure de chaussee le fait
reparer sans delai, sous peine d'une amende de huit
dollars pour chaque cas de negligence a cet egard,
et d'une autre amende de quatre dollars pour
chaque journee au cours de laquelle le trottoir, la
voie ou la bordure demeure endommage sans etre
repare de fa~on satisfaisante.
10 Il est interdit de conduire un cheval ou de
permettre a un cheval tirant un fiacre, un wagon,
une voiture, un vehicule ou un autre moyen de
transport, sur roues ou sur lames, d'avancer a une
vitesse superieure a un trot modere sur une rue ou
dans une place ou d'avancer autrement qu'au pas
sur le quai North Market Wharf dans le quartier
King's Ward, sur le quai South Market Wharf dans
le quartier Queen's Ward ou sur le quai public dans
le quartier Duke's Ward, ou encore au moment de

any provision of this section.
11 No person shall ride any horse at a faster
rate of speed than a moderate trot, or be guilty of
any disorderly riding in any street or square, under
the penalty of two dollars for every such act.
12 No person shall leave any horse standing
on any street or square without same adult person
in charge or care of the same, or without being
sufficiently secured to prevent its running away,
under the penalty of eight dollars, to be paid by the
owner of the horse or the person who may have so
improperly left the same.
13 No person shall suffer or permit any horse,
or any cow or other cattle, known as meat cattle, or
any goat, or swine, or goose, to run or to go at large
in any street or square, under the penalty of two
dollars, to be paid by the owner or person having
the care or charge of any such animal.
14 No person shall drive or use any sleigh,
sled, conveyance, or vehicle upon runners on any
street or square without having four bells attached
to the harness of each horse drawing such
conveyance, under the penalty of two dollars, to be
paid by the owner or driver of such sleigh, sled, or
other conveyance.
15 No coach, wagon, carriage, hackney
carriage, vehicle, or other conveyance of any kind,
whether on wheels or runners, shall be placed, left,
or permitted to stand or be upon any street, square
or public thoroughfare within the City, when not
actually in use, with horse or other power for
drawing the same attached thereto, except in cases
where the horse is taken out for the purpose of
being shod or a vehicle is to be repaired, and there
is not sufficient room in the blacksmith's or
wheelwright's shop to place such vehicle, when the
Police may permit the same to remain opposite
such shop for a reasonable time, under the penalty
of four dollars for every time every such
conveyance shall be so left standing or being on
any such street, square, or thoroughfare, to be paid
by the owner or person having the care or charge of
any such conveyance, or by the person who may

responsabilite a un adulte ou sans 1'attacher
solidement de fa~on a eviter qu'il s'enfuie, sous
peine d'une amende de huit dollars que devra
acquitter le proprietaire du cheval ou la personne
qui Pa ainsi laisse sans surveillance.
13 Il est interdit de permettre qu'un cheval,
une vache ou un autre bovin, une chevre, un porc
ou une oie circule librement sur une rue ou dans
une place, sous peine d'une amende de deux dollars
que devra acquitter le proprietaire de 1'animal ou la
personne qui en etait responsable.
14 Il est interdit de conduire ou d'utiliser un
traineau, une luge, un moyen de transport ou un
vehicule sur lames sur une rue ou dans une place
sans avoir fixe quatre cloches au harnais de chaque
cheval qui le tire, sous peine d'une amende de deux
dollars que devra acquitter le proprietaire ou le
conducteur du traineau, de la luge ou du moyen de
transport.
15 Il est interdit de placer ou de laisser une
voiture, un wagon, un chariot, un fiacre, un
vehicule ou un autre moyen de transport de quelque
type que ce soit, qu'il soit sur roues ou sur lames,
sur une rue, dans une place ou sur une route
publique de la municipalite, ou de permettre qu'il
s'y trouve, lorsqu'il n'est pas effectivement utilise
et que le cheval ou autre moyen utilise pour le tirer
n'y est pas attache, sauf lorsque le cheval est amene
pour etre ferre ou que le vehicule en question doit
etre repare, qu'il n'y a pas suffisamment d'espace
dans 1'atelier du marechal-ferrant ou du charron
pour placer le vehicule et que la police permet que
celui-ci reste pres de cet atelier pendant une periode
raisonnable, sous peine d'une amende de quatre
dollars pour chaque manquement de cette nature
que devra acquitter le proprietaire du moyen de
transport ou la personne qui en est responsable ou

have left the same so unlawfully on such street,
square or thoroughfare and the further penalty of
one dollar an hour for every hour during which any
such conveyance may be so left on any street,
square or thoroughfare, after notice from the Chief
of Police or from any policeman to the owner or
person in charge of any such conveyance, to
remove the same.
16 No owner or driver of any wagon, sloven,
cart, dray, sled, or other vehicle shall feed his horse
or horses at a public stand for vehicles, or on any
part of a street or square, except in and by a bag
fastened to the head of the animal, under the
penalty of one dollar.
17 No auctioneer or other person shall sell at
auction, or put or expose for sale any cask, crate, or
hogshead, box, bale, or barrel, household furniture,
goods, wares, or merchandise, or any other article
in any street or square, or upon any public wharf or
pier, under the penalty of twenty dollars for every
such act; provided, that this section shall not apply
to the public sales of damaged goods and
Portwardens' sales under the laws of this Province,
which sales may be held on the north side of the
Market Square in King's Ward; and provided, also,
that the Mayor for the time being may grant
permission in his discretion for the use of a part of
the centre of the Market Square for the public sale
of goods, by auction from time to time, and any
person selling by auction, under such permission,
shall be relieved from the penalty in this section.
18 No person shall open, unpack, or discharge
any cask, crate, bale, box, barrel, or other package
of any description, of goods, wares, or
merchandise, or articles, of any kind, on any street
or square, under the penalty of two dollars for
every such package so opened, unpacked, or
discharged, contrary to the provisions of this
section.

conducteur d'un wagon, haquet, charrette, fardier,
luge ou autre vehicule de nourrir son ou ses
chevaux a un endroit public reserve aux vehicules
ou sur une autre partie d'une rue ou d'une place,
sauf en utilisant un sac attache a la tete de Panimal,
sous peine d'une amende d'un dollar.
17 Il est interdit a tout encanteur ou a toute
autre personne de vendre a une vente aux encheres,
de mettre en vente ou d'exposer en vue de la vente
un tonneau, une caisse, une barrique, une boite, un
ballot, un baril, des meubles, des biens, des objets,
des marchandises ou tout autre article sur une rue
ou dans une place ou encore sur un quai public,
sous peine d'une amende de vingt dollars pour
chaque manquement de cette nature; il demeure
entendu que le present article ne s'applique pas aux
ventes publiques de biens endommages ainsi
qu'aux ventes faites par le gardien de port en
application des lois de la province, lesquelles
ventes peuvent avoir lieu du cote nord de la place
Market Square, dans le quartier King's Ward. De
plus, le maire peut, a son appreciation, accorder la
permission d'utiliser une partie du centre de la
place Market Square pour la vente publique de
marchandises par vente aux encheres de temps a
autre, et toute personne qui procede a une vente aux
encheres en vertu de cette permission est degagee
de 1'obligation de verser 1'amende prevue au
present article.
18 Il est interdit d'ouvrir, de deballer ou de
decharger un tonneau, une caisse, un ballot, une
boite, un baril ou un autre colis de quelque nature
que ce soit contenant des biens, des objets ou des
marchandises sur une rue ou dans une place, sous
peine d'une amende de deux dollars pour chaque
colis ainsi ouvert, deballe ou decharge en violation
des dispositions du present article.

persons occupying or in possession of such loft or
upper story; provided, that this section shall not
extend or apply to the Public Pier in Duke's Ward.
20 No goods, wares, or merchandise, or
articles of any description, shall be unladen or
discharged from any vessel, or laden upon any
vessel, by the use or assistance of a horse or other
beast of burden travelling upon and along any part
of either the North Market Wharf, in King's Ward,
or the South Market Wharf, in Queen's Ward (the
Pier Heads only excepted), under the penalty of
eight dollars, to be paid by the person owning or
driving any such horse or animal.
21 No person shall place, or cause to be
placed, or suspend, or cause to be suspended from
any house, store, shop, or place, over any street or
square, within the said City, any goods, wares, or
merchandise whatever, or any other article for
show, or sale, so that the same shall extend or
project from any such house, store, shop, or place
more than one foot into or over the street or square,
under the penalty of four dollars for every such act,
and the further penalty of one dollar each day for
every day the same shall continue.
22 No person shall hang, erect or fasten,
exhibit, maintain, or keep up, or cause or permit to
be erected or fastened, exposed, maintained, or kept
up any swinging-sign, sign-board, sign, show-
board, pole, lamp, or other thing of any description
whatsoever, which shall project or extend from any
building or lot of land within the said City more
than one foot into, over, or upon any part of any
street or square, or any footway or sidewalk of any
street or square or less than eight feet above the
level of the ground or sidewalk, under the penalty

20 Il est interdit de decharger des biens,
objets, marchandises ou articles de toute
description d'un bateau ou de charger des objets,
marchandises ou articles de toute description sur un
bateau en utilisant un cheval ou une autre bete de
somme, ou avec Paide d'un tel animal, le long du
quai North Market Wharf, dans le quartier King's
Ward, ou du quai South Market Wharf, dans le
quartier Queen's Ward, ni sur ces quais, (sauf en
tete de quai), sous peine d'une amende de huit
dollars que devra acquitter la personne qui est
proprietaire de ce cheval ou de cet animal ou qui le

21 Il est interdit de placer ou de suspendre ou
de faire placer ou suspendre depuis une maison, un

22 Il est interdit de suspendre, d'installer, de
fixer, de montrer ou de maintenir, ou de permettre
que soit suspendu, installe, fixe, montre ou
maintenu une enseigne, une enseigne pendante, un
panneau indicateur, un panneau-reclame, un
poteau, un dispositif d'eclairage ou un autre objet
de quelque description que ce soit depuis un
immeuble ou terrain de la municipalite de fa~on
qu'il farme une saillie de plus d'un pied dans une
rue ou une place ou sur un trottoir ou une allee
pietonniere d'une rue ou d'une place ou a moins de

of twenty dollars for every offence, and the further
penalty of twenty dollars each day for every day
that any such swinging-sign, sign-board, sign,
show-board, lamp or other thing shall be permitted
to continue, to be paid by the person or persons
who shall have erected the same, or caused the
same to be placed or continued, or the owner or
occupier of the premises upon or in front of which
the same shall be fastened or exposed; provided,
that this section shall not apply to awnings erected
under the provisions of the next section of this law,
or to lamps affixed to buildings, and used for the
purpose of giving light at night in that part of the
City on the western side of the harbour.
23 It shall be lawful to place or continue to
maintain awnings and shades before any house,
shop or store in any street upon the terms and under
the regulations mentioned in this section; provided,
that the Common Council, as to particular buildings
or streets, may order that no awnings or shades
shall be erected. Namely, awnings or shades
lawfully erected shall be securely fixed and
supported from the front of any building fronting a
street, in such manner as not to interfere with
passengers, and so that the lowest part thereof shall
not be less than eight feet in height above the
sidewalk or street, and in no case to extend beyond
the outer line of the sidewalk; and the person so
placing or continuing to maintain the same shall
conform to any direction in relation to the materials
and the construction and maintenance thereof
which shall be given by the Common Council.
Any person violating any of the provisions of this
section, or any such direction of the Common
Council, shall forfeit and pay a penalty of twenty
dollars, and a further penalty of twenty dollars a
day for every day any such awning or shade shall
be continued in violation of this section.
24 No paper, shavings, dirt, dust, or rubbish of
any kind whatsoever, shall be thrown, cast, or
swept from any house, warehouse, store, shop, or
other building, or from any stoop, step, platform, or
erection, of any description, or from any yard, lot,
or piece of land into or upon any street, square, or
wharf, within the said City, or any part thereof,
under the penalty of two dollars for every such act,
to be paid by the person or persons offending, or by
the owner or occupier of the house, warehouse,

municipalite se trouvant du cote ouest du port.
23 Il est permis de placer ou de maintenir des
auvents et des stores devant une maison, une
boutique ou un magasin dans toute rue
conformement aux conditions et reglements
enonces au present article. Il demeure entendu que
le conseil communal peut interdire 1'installation
d'auvents ou de stores relativement a certaines rues
ou a certains batiments. Plus precisement, les
auvents ou stores autorises sont fixes solidement et
soutenus depuis 1'avant de tout batiment donnant
sur une rue de fa~on a ne pas nuire aux passagers et
de fa~on que la partie inferieure ne soit pas situee a
moins de huit pieds au-dessus de la rue ou du
trottoir et ne depasse en aucun cas la ligne
exterieure du trottoir; la personne qui installe les
stores et auvents ou qui les maintient se conforme
aux directives que donne le conseil communal
relativement aux materiaux, a la construction et a
1'entretien s'y rapportant. Toute personne qui
contrevient aux dispositions du present article ou
aux directives du conseil communal paie une
amende de vingt dollars ainsi qu'une autre amende
de vingt dollars par jour pour chaque jour ou
1'auvent ou le store reste installe en violation des
dispositions du present article.
24 Il est interdit de jeter ou de balayer sur une
rue, dans une place ou sur un quai dans la
municipalite du papier, des copeaux, de la terre, de
la poussiere ou des detritus de quelque nature qu'ils
soient depuis une maison, un entrepot, un magasin,
une boutique ou un autre batiment, une veranda,
une marche, une plate-forme ou une construction
de toute nature ou encore une cour, un lot ou une
parcelle, sous peine d'une amende de deux dollars
pour chaque manquement de cette nature, que

store, shop, or other building, stoop, step, platform,
or other erection, yard, lot or piece of land from
which the same may be thrown, cast, or swept, as
aforesaid.
25(1) No slop, wash, foul or dirty water of any
description shall be thrown, or shall be allowed to
fall, flow, or ooze into, over or upon any gutter of a
street or any part of any street or square, under the
penalty of two dollars, to be paid by the person
offending, or by the owner or occupier of the
house, shop, or premises from which the same may
have been thrown, or been allowed to fall, flow, or
ooze as aforesaid; and the further penalty of two
dollars each day for every day any such nuisance
may be permitted to continue to fall, flow, or ooze,
as aforesaid.
25(2) No parson shall at any tima wash any
motor vehicle or any other kind of vehicle on any
public street or square in The City of Saint John.
25(3) No person shall at any time make use of
any public street or square in The City of Saint
John for the purpose of overhauling or repairing
any motor vehicle, or any other kind of vehicle, or
for changing or repairing a tire or tires on any
vehicle, except in a case of temporary repairs in a
case of emergency.
25(4) Eox avaxy violation of subsaotions (2) and
(3) of this section, there shall be a minimum
penalty of five dollars ($5.00) and a maximum
penalty of ten dollars ($10.00).
26 No person shall carry or convey upon any
street or square any wooden chips or shavings
made from any work of wood, unless the same be
enclosed in a bag or basket, or otherwise well
secured, so as to prevent them being strewed or
scattered about, under the penalty of two dollars;
and no carpenter, cooper, joiner, or other artisan
carrying on any trade or occupation by which
wooden chips or shavings, are made; or other
person, being in the occupation or having charge of
any shop, building, or other place where any chips
or shavings may be, shall suffer or permit any such
chips or shavings to be taken away from such shop,
building, or other place, unless enclosed in a bag or
basket, or otherwise well secured, so as to prevent
them being strewed or scattered about, under the

reparation temporaire en cas d'urgence.
25(4) Quioonqua oommat una infraotion au
paragraphe (2) ou (3) du present article est passible
d'une amende d'au moins cinq dollars et d'au plus
dix dollars.
26 Il est interdit de transporter des copeaux de
bois sur une rue ou dans une place a moins qu'ils
ne se trouvent dans un sac ou un panier ou qu'ils ne
soient bien retenus d'une autre maniere afin
d'empecher qu'ils ne se repandent ou qu'ils ne se
dispersent, sous peine d'une amende de deux
dollars; de plus, aucun charpentier, tonnelier,
menuisier ou autre artisan exer~ant un metier ou
une occupation qui donne lieu a la production de
copeaux de bois non plus qu'aucune autre personne
ayant la responsabilite d'un atelier, d'un batiment
ou d'un autre endroit ou il peut y avoir des copeaux
de bois, ou y exer~ant son occupation, ne peut
permettre ou tolerer que ces copeaux soient
transportes a 1'exterieur de cet endroit, a moins
qu'ils ne se trouvent dans un sac ou un panier ou

27 No person shall put or place, or cause to be
put or placed upon any sidewalk or footpath of any
street or square, any cask, crate, bale, box, barrel,
trunk, or other package or description of goods,
wares, or merchandise, or article of any kind, or
permit any such thing to remain or be upon any
sidewalk or foot path of any street or square for a
longer space of time than may be necessary for the
transfer or carrying of any such thing to, or for the
purpose of having any such thing conveyed away
from any house, store, premises, or place of
business, under the penalty of two dollars for every
act or default, and the further penalty of one dollar
an hour for every hour any such thing may be
permitted so unlawfully to remain upon or
encumber or obstruct any such sidewalk or
footpath.
28 No person shall blast any rock, stone, or
earth, on or near to any street or square, without
providing, and at all times using a proper and
sufficient shield, guard, and covering, to prevent
any part or parts of such rock, stone, or earth from
being thrown by the explosive force into, over, or
upon any street or square, under the penalty of
twenty dollars for every default.
29 If any parts or pieces of rock, stone, or
earth shall at any time be thrown into, over, or upon
any street or square by the blasting of any rock,
stone, or earth, upon any street or square, or upon
any lot adjoining or near thereto, and it shall appear
that the same was occasioned by the want of using
a sufficient shield, guard, or covering, or from the
making use of a larger quantity of explosive force
than was necessary for the proper executing of the
work of blasting, the master workman, foreman, or
person having the charge or superintendence of the
work shall, in any such case, be liable to a penalty
of twenty dollars.
30 No person shall throw, put, deposit, or
place, or cause to be thrown, put, deposited, or
placed, or permit to fall or flow in or upon any
street or square of the City, or on any part of the

d'une autre amende d'un dollar par heure pour
chaque heure au cours de laquelle il est permis a la
chose de s'y trouver, d'obstruer ou d'encombrer le
trottoir ou la voie pietonniere, en violation du
present article.
28 Il est interdit de faire sauter de la roche, de
la pierre ou de la terre dans une rue ou une place ou
pres de celle-ci sans installer et utiliser en tout
temps des dispositifs de revetement et de protection
suffisants pour empecher que des eclats de roche,
de pierre ou de terre soient projetes par la force
explosive dans ou sur une rue ou une place ou au-
dessus de celle-ci, sous peine d'une amende de
vingt dollars pour chaque manquement de cette
nature.
29 Si des eclats de roche, de pierre ou de terre
sont projetes dans ou sur une rue ou une place ou
au-dessus de celle-ci ou sur un terrain adjacent ou a
proximite par suite du dynamitage et qu'il semble
que la cause en soit le defaut d'utiliser un dispositif
de revetement ou de protection suffisant ou
Pemploi d'une force explosive superieure a celle
qui etait necessaire pour 1'execution des travaux de
dynamitage, le maitre artisan, le contremaitre ou la
personne ayant la responsabilite ou le controle des
travaux sera, dans chaque cas, passible d'une
amende de vingt dollars pour chaque manquement
de cette nature.
30 Il est interdit de jeter, de placer ou de
deposer, de faire jeter, placer ou deposer ou de
permettre que tombent ou que ne s'ecoulent dans
ou sur une rue ou une place de la municipalite, ou

beach or shore of the Harbour of the City, or upon
any of the wharves within the City, any manure,
night soil, excrement, dirt, filth, garbage, offal, or
any offensive part of any animal, or any rotten or
offensive meat, fish, or vegetable, or the carcass of
any dead animal, or any rotten or offensive
substance whatsoever, under the penalty of eight
dollars for every such act, and the further penalty of
four dollars each day for every day anything so
placed or thrown, or permitted to fall or flow, shall
remain on any street, square, beach, shore or wharf.
31 No person shall twitch or drag any timber,
logs, or lumber of any description, iron, stone, or
other heavy article, upon or along any street or
square, or carry or convey any timber, logs or
lumber, iron, stone, or other article, so that the
same, or any part thereof shall drag upon the
surface of any street or square, under the penalty of
four dollars for every such act.
32 No person shall advertise any auction sale,
or any sale of any real estate or personal property,
merchandise, furniture, or any other article, or
advertise any matter or thing by the ringing of any
bell, the blowing of any horn, or by crying, calling,
or making any loud noise in any street or square, or
at the entrance or other part of any house or
premises open to a street or square whereby the
public are liable to be disturbed or annoyed, under
the penalty of two dollars for every such act;
provided, that nothing in this section shall extend to
any person appointed or authorized by the
Common Council as a public crier, or city bellman.
33 Every person owning or interested in any
lands in the said City, which now are or hereafter
may become vacant, situate on either side of any of
the public streets, squares, wharves, highways, or
bridges of the said City, shall erect and keep up a
good and sufficient fence or wall along so much of
the side of any of the said streets, squares, wharves,
highways, or bridges, and so far as the land of such
person so owning or so interested therein may
extend, to be not less than four feet four inches in
height, and of sufficient strength to prevent injury
to the inhabitants of the said City passing and re-

31 Il est interdit de tirer brusquement ou de
trainer du bois de grume, des billes de bois ou du
bois d'aeuvre de toute description, du fer, des
pierres ou d'autres articles lourds sur une rue ou
une place ou le long de celle-ci, ou de les
transporter de fa~on qu'ils trainent en tout ou en
partie sur la surface d'une rue ou d'une place, sous
peine d'une amende de quatre dollars pour chaque
manquement de cette nature.
32 Il est interdit d'annoncer une vente aux
encheres, une vente de biens reels ou personnels, de
marchandises, de meubles ou d'autres articles ou
un autre objet ou evenement en faisant sonner une
cloche ou un klaxon, en criant ou en emettant un
son bruyant dans une rue ou une place ou a 1'entree
ou dans une autre partie d'une maison ou d'un local
donnant sur une rue ou une place de fa~on a risquer
d'ennuyer le public, sous peine d'une amende de
deux dollars pour chaque manquement de cette
nature; il demeure entendu que 1'interdiction
prevue au present article ne s'applique pas aux
personnes nommees ou autorisees par le conseil
communal a titre de crieurs publics ou de sonneurs
de cloche de la municipalite.
33 Tout proprietaire de bien-fonds dans la
municipalite ou toute personne possedant un interet
sur un bien-fonds dans The City of Saint John qui
est ou peut devenir vacant, d'un cote ou de 1'autre
d'une rue, d'une place, d'un quai, d'une route ou
d'un pont publics de la municipalite, construit et
maintient, sur toute la longueur du bien-fonds, une
cloture ou un mur suffisant d'une hauteur minimale
de quatre pieds et quatre pouces le long de la rue,
de la place, du quai, de la route ou du pont en
question, lequel mur ou cloture est assez solide
pour empecher des blessures aux habitants de la

passing and whether walking, riding, or driving in
or over the said streets, squares, wharves,
highways, or bridges; and if such fence or wall
shall not be erected of the height aforesaid, or shall
not be kept at such height when so erected, or shall
not be at all times of sufficient strength to prevent
injury, as aforesaid, such person so owning or
interested in the vacant land as aforesaid, and so
offending against this section, shall forfeit and pay
the sum of twenty dollars for every neglect and
default, and for each and every time any fence shall
be deficient in any of the matters aforesaid, and the
further sum of twenty dollars for every twenty-four
hours any land shall afterwards continue unfenced,
or any fence shall afterwards be suffered to remain
so deficient as aforesaid; provided always, that
such erections shall not be required to be made on
any part of such wharves as are actually used for
loading and discharging goods, chattels, ballast, or
other articles.
34 Every person in meeting and passing
another person on the sidewalk or footpath of any
street or square, shall pass to the right, and every
person overtaking and passing another shall pass on
the right. When a sidewalk or footpath is crowded
with passengers, the persons going along shall go
to the right of the middle of the sidewalk. Any
person wilfully offending against this provision,
whereby any disturbance or confusion is
occasioned, shall be liable to a penalty of four
dollars for every breach of this section.
35 All buildings within that part of the City
lying on the eastern side of the Harbour of Saint
John shall be numbered as hereinafter provided.
Every several tenement now built shall be
numbered by a separate number on each door of
entrance from the street on which such door fronts;
in every case of vacant land intervening between
buildings that are numbered as herein provided,
twenty feet of such space shall be allowed for one
number. The mode of numbering shall be as
follows, namely; in that part of the City fronting on
Union Street and lying south of Union Street, the
numbering in each street lying east and west, shall
be from the west towards the east, the numbers
beginning on the west end of the street, the odd
numbers being on the north side and the even
numbers on the south side; and the numbering in
each street lying north and south shall be from
Union Street southerly, the odd numbers on the
municipalite qui passent a cet endroit, que ce soit a

de biens, de biens meubles, de ballast ou d'autres
articles.
34 Toute personne qui en rencontre ou en
depasse une autre sur le trottoir ou la voie
pietonniere d'une rue ou d'une place passe a droite.
Lorsqu'un trottoir ou une voie pietonniere est
congestionne, les personnes qui y circulent gardent
la droite par rapport au milieu du trottoir. Toute
personne qui contrevient deliberement a la presente
disposition et occasionne de ce fait de la confusion
ou une nuisance est passible d'une amende de
quatre dollars pour chaque manquement.
35 Tous les immeubles situes dans la partie de
la municipalite qui se trouve du cote est du port
municipal sont numerotes de la fa~on indiquee ci-
apres. Chaque immeuble a location individuelle
existant comporte un numero distinct sur chaque
porte d'entree donnant sur la rue; lorsqu'un terrain
vacant separe des immeubles qui sont numerotes
conformement aux dispositions du present article,
un espace de vingt pieds de ce terrain est alloue
pour un numero. Le mode de numerotage est le
suivant : dans la partie de la ville donnant sur la rue
Union et se trouvant au sud de cette rue, le
numerotage de chaque rue possedant un axe
est-ouest se fait d'ouest en est, a partir de
1'extremite ouest, les numeros impairs se trouvant
du cote nord et les numeros pairs, du cote sud; le
numerotage de chaque rue possedant un axe nord-
sud debute de la rue Union vers le sud, les numeros
impairs se trouvant du cote ouest de ces rues et les

west side of such streets and the even numbers on
the east side. In that part of the City lying to the
northward of Union Street, the numbering in each
street running northerly shall be northerly from
Union Street, the odd numbers on the westerly side
and the even numbers on the easterly side of such
streets; and in all streets running easterly and
westerly, the numbering shall be from the west
towards the east, the odd numbers on the northerly
side and the even numbers on the southerly side of
such streets.
36 It shall be the duty of the owner (or in
cases of renewable leases, the tenant of renewable
term) of every building within this City to put up
and exhibit on and affix to the outside of the
buildings so owned or occupied, upon a
conspicuous part of such building near each
entrance thereto on the ground floor fronting on the
street, the proper number assigned for such
building and each entrance thereto, in figures of not
less than one and one-quarter (1'/4) inches in length;
every such number being notified to each owner or
occupier by the City Engineer or other authorized
officer. Any owner or tenant of renewable term as
aforesaid of any building or part of a building who
shall refuse, or who shall, after the space of ten
days from notice, neglect to supply, put up, exhibit,
and affix any such number, shall forfeit and pay the
sum of one dollar for every day during which such
number shall not be exhibited. Any owner or
occupant who shall affix to any building any
number contrary to the direction of the City
Engineer, or other such authorized officer, or any
number other than the number assigned for any
such building, or a part of a building, shall forfeit
and pay the sum of one dollar for every day any
such incorrect number shall be exhibited.
36(1) No person shall deposit or place any paper,
either by itself or in combination with other refuse,
upon any place within the City used as a dump;
either public or private, under the penalty of two
dollars for every such act, to be paid by the person
or persons offending, or by the owner or occupier
of the house, warehouse, store, shop or other
building from which such paper or other refuse
containing paper, shall have been brought to the

rues possedant un axe est-ouest, le numerotage se
fait d'ouest en est, les numeros impairs se trouvant
du cote nord et les numeros pairs, du cote sud des
rues en question.
36 Il incombe au proprietaire (ou, dans le cas
des baux renouvelables, au locataire dont le bail est
renouvelable) de chaque batiment dans la
municipalite de poser et d'exposer a 1'exterieur du
batiment qui lui appartient ou qu'il occupe, a un
endroit bien en vue pres de chaque entree du rez-
de-chaussee donnant sur la rue, le numero attribue
par 1'ingenieur municipal ou un autre agent autorise
a ce batiment et a chaque entree en utilisant des
chiffres d'une longueur d'au moins un pouce et
quart. Tout proprietaire ou locataire decrit ci-dessus
qui refuse ou neglige, apres 1'expiration de dix
jours suivant Pavis qu'il a re~u a ce sujet, de
fournir, de poser et d'exposer ce numero paie la
somme d'un dollar par jour pour chaque jour que le
numero n'est pas expose. Tout proprietaire ou
occupant qui pose sur un batiment un numero non
conforme aux directives de 1'ingenieur municipal
ou de 1'agent autorise ou un numero autre que le
numero attribue pour le batiment ou la partie du
batiment en question paie une somme d'un dollar
par jour pour chaque jour que le numero inexact est
expose.
36(1) Il est interdit de deposer ou de placer du
papier, seul ou avec d'autres ordures, a un endroit
de la municipalite qui est utilise comme depotoir
public ou prive, sous peine d'une amende de deux
dollars pour chaque manquement de cette nature,
amende que devra acquitter le contrevenant ou le
proprietaire ou 1'occupant de la maison, de
Pentrepot, du magasin, de la boutique ou du
batiment d'ou provient le papier ou les ordures
contenant du papier ainsi apportes.

the Chamberlain of The City of Saint John for the
time being, before the Police Magistrate of The
City of Saint John, or sitting Magistrate at the
Police Office in said City, as provided by the laws
of this Province, to be paid and applied according
to law and the Charter of the City; of by action of
debt in any court of competent jurisdiction; and
shall be levied by distress and sale of the goods and
chattels of the person upon whom the penalty shall
be imposed; and for want of goods and chattels
whereon to levy, the person shall be imprisoned in
the common gaol of the City and County of Saint
John for the space of two days when the fine or
sum imposed shall be one dollar; or four days when
the fine or sum shall be two dollars; or ten days
when the fine or sum shall be four dollars; or
twenty days when the fine or sum shall be eight
dollars, or thirty days when the fine or sum shall be
twenty dollars, or shall exceed the sum of twenty
dollars.
38 A by-law of The City of Saint John enacted
on the second day of August, 1876 entitled "A Law
Relating To The Public Streets In The City Of
Saint John And To Prevent Certain Nuisances In
The Said City" and all amendments thereto is
repealed on the coming into force of this by-law
IN WITNESS WHEREOF The City of Saint John
has caused the Corporate Common Seal of the said
City to be affixed to this by-law the 18t'' day of
May, A.D. 2005 and signed by:
