King Square By-law BY-LAW NUMBER C-3 A BY-LAW IN RELATION TO THE KING SQUARE, IN THE CITY OF SAINT JOHN Be it ordained by The City of Saint John, m Common Council, as follows: 1 Any person other than a CIVIC employee in performance of some duty thereon, who shall walk or be in or upon any portion of the King Square, on the eastern side of the Harbour, except the walks there laid out, or tamper with any of the flower beds or plants, or who shall injure or deface any of the trees in the said Square, or any of the benches placed thereon, shall be liable to a penalty of four dollars for each and every offence. 2 All fines, penalties and forfeitures imposed by this By-law shall and may be sued for, prosecuted and recovered, with costs, in the name of the Chamberlain of The City of Saint John for the time being, before the Police Magistrate of The City of Saint John, or Sitting Magistrate at the Police Office, as provided by the laws of this Province, to be paid and applied according to law and the Charter of the City, or by action of debt in any Court of competent jurisdiction; and shall be levied by distress and sale of the goods and chattels of the person upon whom the penalty shall be imposed, and for want of goods and chattels whereon to levy, the person shall be imprisoned in the Common Gaol of the City and County of Saint John for the space often days. Repeal 3 A by-law of The City of Saint John enacted on the third day of August, 1908 entitled "A Law In Relation To The King Square, In The City Of Saint John" and all amendments thereto is repealed on the coming into force of this by-law. IN WITNESS WHEREOF The City of Saint John has caused the Corporate Common Seal of the said City to be affixed to this by-law the ih day of November, A.D. 2005 and signed by: ARRETE NUMERO C-3 ARRETE CONCERNANT LA PLACE APPELEE KING SQUARE DANS THE CITY OF SAINT JOHN Le conseil communal de The City of Saint John edicte : 1 Toute personne, autre qu'un employe municipal dans l'exercice de ses fonctions, qui marche ou se trouve sur une partie de la place appelee King Square, du cote est du port, sauf aux promenades y amenagees, ou qui endommage ou degrade les plates-bandes, les arbres ou les bancs qui s'y trouvent est passible d'une amende de quatre dollars pour chaque infraction. 2 Toutes les amendes, peines et confiscations prevues au present arrete peuvent etre et doivent etre recouvrees - notamment par voie d'action - avec depens au nom du tresorier actuel de The City of Saint John, devant Ie magistrat de police de The City of Saint John ou devant Ie magistrat saisi au poste de police, conformement aux lois du Nouveau-Brunswick, en vue de leur paiement et de leur affectation en conformite avec les regles de droit et la charte de The City of Saint John, ou par voie d'action en recouvrement de creance intentee devant tout tribunal competent; elles peuvent egalement etre per9ues par voie de saisie et de vente des biens personnels de la personne a qui la peine est imposee et, si elle ne possede aucun bien personnel saisissable, elle sera incarceree dans la prison commune de The City of Saint John, comte de Saint John, pour une periode de dixjours. Abrogation 3 L'arrete de The City of Saint John edicte Ie 3 aout 1908 et intitule A Law In Relation To The King Square, In The City Of Saint John, ensemble ses modifications, est abroge des l'entree en vigueur du present arrete.
