2003-05-12_Minutes--Procès-verbal 2003-13 Minutes of the portion of the Committee of the Whole meeting open to the public Monday, May 12, 2003, 5:00 o'clock p.m., 8th Floor Boardroom, City Hall. present Mayor McAlary Deputy Mayor White and Councillors Ball, Chase, Court, Desmond, Fitzgerald, Fitzpatrick, Teed, Titus and Trites - and - Messrs. 1. Totten, City Manager; J. Nugent, City Solicitor; A. Beckett, Commissioner of Finance and Commissioner of Corporate Services; and P. Woods, Common Clerk and Deputy City Manager; and Ms. C. Mosher, Assistant Common Clerk. 1. MeetinQ Called To Order The Mayor called the Committee of the Whole meeting to order, Councillor Titus having voted "nay" on the motion in this regard on the basis of his view that the item listed on the agenda as discussion of a confidential nature should have been placed on the agenda for debate and vote by Council in open session as to why it should be discussed in closed session. Mr. Nugent spoke to the process in terms of the requirement for Council to convene publicly and, if any member of the Committee wished to deal with an item in discussion from which the public would be excluded, there should be a resolution to do so, indicating the item as well as the category in the legislation into which the item fit as appropriate for discussion excluding the public. It was noted that Mr. Woods would be making a presentation in open session of Council later this date on the recent amendments to the Municipalities Act. The Mayor indicated her intent to comment in open session of Council later this date on the matter of the Province's funding commitment of $2.5 million in 2003 of its four-year commitment of funding to do work on Rothesay Avenue, Loch Lomond Road and Fairville Boulevard in conjunction with the City, noting that while there was no written agreement on the four-year funding, the Premier made the announcement at a news conference. The matter of the tender for the work on Rothesay Avenue was broached during which time Mr. Nugent advised of the Legal Department's review of a tender on the extent of its completeness. The Mayor also advised of receipt, in writing, of the Province's commitment of $400,000 with respect to the Sandy Point Road/Kennebecasis Bay area development project recently presented to Council, and that it was her understanding that Commissioner of Municipal Operations Paul Groody was in receipt of UNB's letter committing $400,000 to this project. 2003-14 Public Committee of the Whole May 12, 2003 2. Discussion Of Confidential Matters On motion of Councillor Ball Seconded by Deputy Mayor White RESOLVED that the public be excluded from the meeting for the duration of the discussion on the following matters: 2(a) offers to purchase property -10.2(4)(d). Question being taken, the motion was carried with Councillor Titus voting "nay". The meeting adjourned.
