1. Call to Order
1.1 Land Acknowledgement
Councillor Sullivan read aloud the Land Acknowledgement and called for a moment of
reflection.
“The City of Saint John/Menaquesk is situated is the traditional territory of the
Wolastoqiyik/Maliseet.The Wolastoqiyik/Maliseet along with their Indigenous Neighbours,
the Mi’Kmaq/Mi’kmaw and Passamaquoddy/Peskotomuhkati signed Peace and Friendship
Treaties with the British Crown in the 1700s that protected their rights to lands and
resources.”

RESOLVED that the agenda of July 6, 2026, be approved.

3. Disclosures of Conflict of Interest

4. Consent Agenda
4.1 RESOLVED that the minutes of June 15, 2026, be approved.
4.2 RESOLVED that as recommended in the submitted report M&C 2026-153:
Rockwood Park Endowment Fund, the City approve the Resolution of the Administrators
attached to M&C No. 2026-153, for the purpose of amending the Deed of Gift dated
November 28, 2008; and that the Mayor and Clerk be authorized to execute the said
Resolution of the Administrators and any other documents necessary to effect the changes
to the Deed of Gift described in this report.
4.3 RESOLVED that as recommended in the submitted report M&C 2026-154: Fleet
Replacement Procurement - July 2026, Common Council award the purchase of four (4)
Trackless MT7 Municipal tractors and attachments at a total cost of $882,249.00 plus HST
to Saunders Equipment LTD. via The Canoe Procurement Group of Canada.
4.4 RESOLVED that as recommended in the submitted report M&C 2026-150: Glen
Road (Simpson Drive to Connaught Avenue) - Street Reconstruction, Contract No. 2025-
17, Glen Road (Simpson Drive to Connaught Avenue) - Street Reconstruction, be awarded
to the low tenderer, Galbraith Construction Ltd., at their tendered price of $1,136,044.75

(including HST), as calculated based on estimated quantities, and that the Mayor and City
Clerk be authorized to execute the necessary contract documents.
4.5 RESOLVED that as recommended in the submitted report M&C 2026-157:
Designation of By-law Enforcement Officer - Public Works, Common Council adopt the
following:
1. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, and
amendments thereto (the “Local Governance Act”), including A By-law respecting
Flyer Distribution in The City of Saint John, By-law Number LG-20 (the “Flyer
Distribution By-Law”), and all amendments thereto, and it may from time to time
be necessary to commence proceedings in the Provincial Court of the Province of
New Brunswick, when a person has violated or failed to comply with said By-law;
AND WHEREAS section 72 of the Local Governance Act provides
that a council may appoint by-law enforcement officers for the
local government and may determine their terms of office;
AND WHEREAS subsection 150(1) of the Local Governance Act
provides that proceedings for breach of a by-law shall be
commenced in the name of the clerk of the local government or
such other person as is designated for that purpose by the
council;
NOW THEREFORE BE IT RESOLVED that Brent Clemmer is
hereby appointed as by-law enforcement officers with
respect to the enforcement of the Flyer Distribution By-Law,
effective immediately, and this appointment shall continue
until they cease to be contracted by The City of Saint John
or until it is rescinded by Common Council, whichever
comes first;
AND BE IT FURTHER RESOLVED that Brent Clemmer is
hereby designated and authorized to lay Informations in the
Provincial Court of the Province of New Brunswick for
breach of the Flyer Distribution By-Law, effective
immediately, and this designation and authorization shall
continue until they cease to be contracted by The City of
Saint John or until it is rescinded by Common Council,
whichever comes first.
2. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, and
amendments thereto (the “Local Governance Act”), including A By-law Respecting
Clearance and Removal of Snow and Ice from the Public Streets in The City of
Saint John, By-law Number LG-22 (the “Snow Removal By-Law”), and all
amendments thereto, and it may from time to time be necessary to commence

proceedings in the Provincial Court of the Province of New Brunswick, when a
person has violated or failed to comply with said By-law;
AND WHEREAS section 72 of the Local Governance Act provides that a council
may appoint by-law enforcement officers for the local government and may
determine their terms of office;
AND WHEREAS subsection 150(1) of the Local Governance Act provides that
proceedings for breach of a by-law shall be commenced in the name of the clerk
of the local government or such other person as is designated for that purpose by
the council;
NOW THEREFORE BE IT RESOLVED that Brent Clemmer is

the enforcement of the Snow Removal By-Law, effective
immediately, and this appointment shall continue until they cease

designated and authorized to lay Informations in the Provincial
Court of the Province of New Brunswick for breach of the Snow
Removal By-Law, effective immediately, and this designation and
authorization shall continue until they cease to be contracted by
The City of Saint John or until it is rescinded by Common Council,
whichever comes first.
3. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, and
amendments thereto (the “Local Governance Act”), including A By-law for the
Storage, Collection and Disposal of Solid Waste in The City of Saint John, By-law
Number LG-6 (the “Solid Waste By-Law”), and all amendments thereto, and it may
from time to time be necessary to commence proceedings in the Provincial Court
of the Province of New Brunswick, when a person has violated or failed to comply
with said By-law;
AND WHEREAS section 72 of the Local Governance Act provides
that a council may appoint by-law enforcement officers for the
local government and may determine their terms of office;
AND WHEREAS subsection 150(1) of the Local Governance Act
provides that proceedings for breach of a by-law shall be
commenced in the name of the clerk of the local government or
such other person as is designated for that purpose by the
council;
NOW THEREFORE BE IT RESOLVED that Brent Clemmer is

hereby designated and authorized to lay Informations in the
Provincial Court of the Province of New Brunswick for
breach of the Solid Waste By-Law, effective immediately,
and this designation and authorization shall continue until
they cease to be contracted by The City of Saint John or
until it is rescinded by Common Council, whichever comes
first.
4.6 RESOLVED that as recommended in the submitted report M&C 2026-156:
Designation of a By-law Enforcement Officer - Michael Malone, Common Council adopt
the following:
1. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, and
amendments thereto (the “Local Governance Act”), including the Saint John
Minimum Property Standards By-law, By-law Number M-14, and amendments
thereto (the “Saint John Minimum Property Standards By-law”), and it may from
time to time be necessary to commence proceedings in the Provincial Court of the
Province of New Brunswick, when a person has violated or failed to comply with
the said By-law;
AND WHEREAS section 72 of the Local Governance Act provides
that a council may appoint by-law enforcement officers for the
local government and may determine their terms of office;
AND WHEREAS subsection 25(1) of the Saint John Minimum
Property Standards By-law provides that a by-law enforcement
officer appointed by council may notify the owner or occupier of
premises, dwelling, dwelling unit or structure by issuing an Order
where the condition of the premises, dwelling, dwelling unit or
structure does not comply with said By-law;
AND WHEREAS subsection 150(1) of the Local Governance Act
provides that proceedings for breach of a by-law shall be
commenced in the name of the clerk of the local government or
such other person as is designated for that purpose by the
council;
NOW THEREFORE BE IT RESOLVED that Michael
Malone is hereby appointed as a by-law enforcement

officer with respect to the enforcement of the Saint
John Minimum Property Standards By law, effective
immediately, and this appointment shall continue
until they cease to be an employee of the Growth
and Community Services department of The City of
Saint John or until it is rescinded by Common
Council, whichever comes first;
AND BE IT FURTHER RESOLVED that Michael
Malone is hereby appointed and authorized to notify
owners and occupiers where the condition of the
premises, dwellings, dwelling units or structures
does not comply with the Saint John Minimum
Property Standards By-law, effective immediately,
and this appointment and authorization shall
continue until they cease to be an employee of the
Growth and Community Services department of The
City of Saint John or until it is rescinded by Common
Council, whichever comes first;
AND BE IT FURTHER RESOLVED, that Michael
Malone is hereby designated and authorized to lay
informations in the Provincial Court of the Province
of New Brunswick for breach of the Saint John
Minimum Property Standards By-law, effective
immediately, and this designation and authorization
shall continue until they cease to be an employee of
the Growth and Community Services department of
The City of Saint John or until it is rescinded by
Common Council, whichever comes first.

that a council may appoint by-law enforcement officers for the
local government and may determine their terms of office;
AND WHEREAS subsection 144(2) of the Local Governance Act
provides that a council may authorize by-law enforcement
officers to enter the land, building or other structure at any
reasonable time, and carry out the inspection after giving
reasonable notice to the owner or occupant of the land, building

or other structure to be entered;
NOW THEREFORE BE IT RESOLVED that Michael
Malone, by-law enforcement officer, is hereby
appointed as an inspection officer and authorized to
enter at all reasonable times upon any property
within the territorial boundaries of the City of Saint
John for the purpose of making any inspection that
is necessary for the administration and enforcement
of the Saint John Minimum Property Standards By-
law which received first and second reading by
Common Council on September 10, 2018 and third
reading on September 24, 2018, being enacted
upon approval by the Minister of Local Government,
and/or the Local Governance Act effective
immediately, and this authorization shall continue
until they cease to be an employee of the Growth
and Community Services department of The City of
Saint John or until rescinded by Common Council,
whichever comes first.
3. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, and
amendments thereto (the “Local Governance Act”), including the Saint John
Unsightly Premises and Dangerous Buildings and Structures By-law, By-law
Number M-30, and amendments thereto (the “Saint John Unsightly Premises and
Dangerous Buildings and Structures By-law”), and it may from time to time be
necessary to commence proceedings in the Provincial Court of the Province of
New Brunswick, when a person has violated or failed to comply with the said By-
law;
AND WHEREAS section 72 of the Local Governance Act provides
that a council may appoint by-law enforcement officers for the
local government and may determine their terms of office;
AND WHEREAS subsections 132(1) and 132(2) of the Local
Governance Act provide that an officer appointed by council may
notify the owner or occupier of premises, a building or structure
by notice in the form prescribed by regulation when a condition
exists pursuant to subsections 131(1), 131(2) or 131(3) of the
said Act;
AND WHEREAS subsection 150(1) of the Local Governance Act
provides that proceedings for breach of a by-law shall be
commenced in the name of the clerk of the local government or
such other person as is designated for that purpose by the
council;

NOW THEREFORE BE IT RESOLVED that Michael Malone
is hereby appointed as a by-law enforcement officer with
respect to the enforcement of the Saint John Unsightly
Premises and Dangerous Buildings and Structures By-law,
effective immediately, and this appointment shall continue
until they cease to be an employee of the Growth and
Community Services department of The City of Saint John
or until it is rescinded by Common Council, whichever
comes first;
AND BE IT FURTHER RESOLVED that Michael Malone is
hereby appointed and authorized to notify owners and
occupiers with respect to premises, buildings or structures
that are unsightly; buildings or structures that are a hazard
to the safety of the public by reason of being vacant or
unoccupied; buildings or structures that are a hazard to the
safety of the public by reason of dilapidation or unsoundness
of structural strength, as set out in the Saint John Unsightly
Premises and Dangerous Buildings and Structures By-law,
effective immediately, and this appointment and
authorization shall continue until they cease to be an
employee of the Growth and Community Services
department of The City of Saint John or until it is rescinded
by Common Council, whichever comes first;
AND BE IT FURTHER RESOLVED that Michael Malone is
hereby designated and authorized to lay informations in the
Provincial Court of the Province of New Brunswick for
breach of the Saint John Unsightly Premises and Dangerous
Buildings and Structures By-law, effective immediately, and
this designation and authorization shall continue until they
cease to be an employee of the Growth and Community
Services department of The City of Saint John or until it is
rescinded by Common Council, whichever comes first.

AND WHEREAS section 72 of the Local Governance Act provides
that a council may appoint by-law enforcement officers for the
local government and may determine their terms of office;

AND WHEREAS subsection 144(2) of the Local Governance Act
provides that a council may authorize officers enter the land,
building or other structure at any reasonable time, and carry out
the inspection after giving reasonable notice to the owner or
occupant of the land, building or other structure to be entered;
NOW THEREFORE BE IT RESOLVED that Michael Malone,
by-law enforcement officer, is hereby appointed as an
inspection officer and authorized to enter at all reasonable
times upon any property within the territorial boundaries of
the City of Saint John for the purpose of making any
inspection that is necessary for the administration and
enforcement of the Saint John Unsightly Premises and
Dangerous Buildings and Structures By-law which received
first and second reading by Common Council on May 22,
2018 and third reading on June 4, 2018, being enacted upon
approval by the Minister of Local Government, and/or the
Local Governance Act effective immediately, and this
authorization shall continue until they cease to be an
employee of the Growth and Community Services
department of The City of Saint John or until rescinded by
Common Council, whichever comes first.
5. WHEREAS subsection 135(4) of the Local Governance Act, S.N.B. 2017 c.18, and
amendments thereto, provides that within thirty days after the terms of a notice
have been complied with or a debt due to a local government or due to the Minister
of Finance, as the case may be, is discharged, the local government shall provide
a certificate in the form prescribed by regulation which requires that the corporate
seal of the local government be affixed;
NOW THEREFORE BE IT RESOLVED that Jonathan A. Taylor,
City Clerk, is hereby authorized to affix the corporate seal of The
City of Saint John to a Certificate of Discharge that is issued by
Michael Malone under the Saint John Unsightly Premises and
Dangerous Buildings and Structures By-law, and such
authorization shall continue until Jonathan A. Taylor ceases to be
the City Clerk of The City of Saint John or until it is rescinded by
Common Council, whichever comes first.
6. WHEREAS, the Common Council of The City of Saint John has enacted certain
bylaws pursuant to the authority of the Community Planning Act, S.N.B 2017, c. 19,
and amendments thereto, (the “Community Planning Act”), including The Zoning
By-law, By-law Number C.P. 110, including all amendments thereto, and it may
from time to time be necessary to commence proceedings in the Provincial Court
of the Province of New Brunswick, when a person has contravened or failed to
comply with these By-laws;
AND WHEREAS paragraph 137(a) of the Community Planning

Act provides that no person shall violate or fail to comply with a
provision of a by-law made under this Act;
AND WHEREAS section 139 of the Community Planning Act
provides that proceedings for an offence under this Act shall be
commenced in the name of the Minister or the clerk of the local
government or any other person who is designated for that
purpose by the council;
NOW THEREFORE BE IT RESOLVED that Michael Malone
is hereby designated and authorized to lay informations in
the Provincial Court of the Province of New Brunswick for
breach of The Zoning By-law, effective immediately, and this
appointment and authorization shall continue until they
cease to be an employee of the Growth and Community
Services department of The City of Saint John or until it is
rescinded by Common Council, whichever comes first.
7. WHEREAS the Common Council of The City of Saint John has enacted a by-law
pursuant to the authority of the Building Code Administration Act, S.N.B. 2020, c.
8, and amendments thereto, (the “Building Code Administration Act”), namely the
Building By-law, By-law Number BC-1 and amendments thereto (the “Building
Bylaw”), and it is necessary to appoint building inspectors, acting building
inspectors, deputy building inspectors and city inspectors for the administration
and enforcement of this By-law;
NOW THEREFORE BE IT RESOLVED that Michael Malone
is hereby appointed as a city inspector, effective
immediately, and this appointment shall continue until they
cease to be an employee of the Growth and Community
Services department of The City of Saint John or until
rescinded by Common Council, whichever comes first.
8. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Building Code Administration Act, S.N.B 2020,
c. 8, and amendments thereto, (the “Building Code Administration Act”) including
the Building By-law, By-law Number BC-1, and amendments thereto, and it may
from time to time be necessary to make orders for the administration of these By-
laws;
AND WHEREAS subsection 134(1) of the Building Code
Administration Act provides that a council may authorize persons
to, when a development is undertaken in violation of the Building
Code Administration Act, a by-law or regulation under the
Building Code Administration Act, a by-law or terms and
conditions imposed on the development, order the cessation of
the development, alteration of such development so as to remove
the violation, or the doing of anything required to restore the land,

building or structure to its condition immediately prior to the
undertaking of such development;
NOW THEREFORE BE IT RESOLVED that Michael Malone
is hereby authorized to, when a development is undertaken
in violation of the Building Code Administration Act, the
Building By-law or the terms and conditions imposed on the
development, order the cessation of the development,
alteration of such development so as to remove the violation,
or the doing of anything required to restore the land,
building or structure to its condition immediately prior to the
undertaking of such development, effective immediately,
and this authorization shall continue until they cease to be
an employee of Growth and Community Services of The City
of Saint John or until rescinded by Common Council,
whichever comes first.
9. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Building Code Administration Act, S.N.B 2020,
c. 8, and amendments thereto (the “Building Code Administration Act”), including
the Building By-law, By-law Number BC-1, and amendments thereto, and it may
from time to time be necessary to commence proceedings in the Provincial Court

is hereby designated and authorized to lay informations in
the Provincial Court of the Province of New Brunswick for
breach of the Saint John Building By-law, effective
immediately, and this appointment and authorization shall
continue until they cease to be an employee of Growth and
Community Services of The City of Saint John or until it is
rescinded by Common Council, whichever comes first.
4.7 RESOLVED that as recommended in the submitted report M&C 2026-151: Referral
of Items to PAC and July Public Hearings, Common Council refer the following applications
to the Planning Advisory Committee and set the date for the public hearings to be held at
the meeting of Council scheduled for Monday, July 27, 2026, commencing at 6 PM, for a

rezoning for 459 Woodville Road and 400 Lowell Street (PIDs 00394940 and a portion of
00471540) from applicant Canterbury Developments Ltd, on behalf of Belyea Village Ltd.;
a Section 59 amendment at 151 and 155 Sandy Point Road and a third parcel without a
civic address, PIDs 55150718 (151), 55150700 (155), and 00023945 (without a civic
address), from applicant Jack A. W. Long (Lawson Creamer Lawyers); and a Text
Amendment to Amend the Zoning By-law by (1) adding a provision to count basements as
storeys and apply the new provision and (2) revising two definitions from applicant City of
Saint John, to be held in the Council Chamber, City Hall 2nd floor, 15 Market Square, Saint
John, NB.
4.8 RESOLVED that as recommended in the submitted report M&C 2026-152: Referral
of Items to PAC and August Public Hearings, Common Council refer the following
applications to the Planning Advisory Committee and set the date for the public hearings
to be held at the meeting of Common Council scheduled for Monday, August 17, 2026,
commencing at 6 PM, for a rezoning for a parking area behind 145 Landsdowne Ave and
along Harrington / Sears Streets (portion of PIDs 55236491 and 00370973) from applicant
Rob LeBlanc, Partner and Founder of Fathom Studio; a rezoning for 2100 Mackay Highway
(PID 00418046) from applicant Catherine Guitard, P.Eng., Dept of Transportation &
Infrastructure, NB; and a rezoning for 615/631 Loch Lomond (PID 00317248) from
applicant 733988 New Brunswick Inc., to be held in the Council Chamber, City Hall 2nd
floor, 15 Market Square, Saint John, NB.
4.9 RESOLVED that the Letter of Thanks from the NB Youth Orchestra be received
for information.
4.10 RESOLVED that the correspondence from S. McCausland re: Stop the Spray
Canada - End Forest Herbicide Spraying be received for information.
4.11 RESOLVED that the correspondence from D. Alexander re: Data Centres be
received for information.
4.12 RESOLVED that the correspondence from C. Watson re: Simpson Scrap Metal
EIA - Request for Council Action on Lorneville Impacts be received for information.

RESOLVED that Common Council conduct a Public Presentation for this item, thereby
formally initiating the required 30-day public comment period for a proposed Municipal
Plan Amendment.

Chief Development and Community Officer Poffenroth gave a public presentation for a
proposed Municipal Plan Amendment for 0 Rex Hurley Boulevard / 0 Glen Road (PIDs
55246706 and a portion of PID 00302778). Earlier this year, Council amended the
designated land use in the Municipal Plan for the subject property along with rezoning the
property. On the day before the City filed its documentation for recordation, the Province
independently filed a new subdivision for the same property. Due to the subdivision filing,
a new PID was assigned to the property. This new PID does not match the original PID in
the City’s documents. As a result, the Province has requested that the land use designation
process and rezoning be re-started with the new PID. Other than the PID, the application
itself has not changed from what was previously approved by Council. To re-start the
Municipal Plan Amendment, the first step is to conduct a Public Presentation that
announces a proposed amendment will be considered. This Public Presentation also
serves as the formal initiation of the required 30-day public comment period.

résolution des administrateurs ainsi que tout autre document nécessaire pour apporter à
l’acte de donation les modifications décrites dans le présent rapport.

municipal attribue le contrat pour l’achat de quatre (4) tracteurs municipaux
Trackless MT7 et de leurs accessoires, au coût total de 882 249,00 $ plus TVH, à
Saunders Equipment Ltd., par l’intermédiaire de The Canoe Procurement Group of
Canada.
4.4 IL EST RÉSOLU que, comme recommandé dans le rapport M&C 2026-150, intitulé
« Chemin Glen (de promenade Simpson à avenue Connaught) – Reconstruction de rue,

« Désignation de l’agent d’application des règlements municipaux – Travaux publics », le
Conseil municipal adopte ce qui suit :

en vertu de la Loi sur la gouvernance locale, L.N.-B. 2017, ch. 18, dans sa version
modifiée (la « Loi sur la gouvernance locale »), notamment l’arrêté relatif à la

Saint John »), et qu’il peut être nécessaire d’engager des procédures devant la
Cour provinciale du Nouveau-Brunswick lorsqu’une personne a contrevenu audit
arrêté ou omis de s’y conformer;
ET CONSIDÉRANT QUE l’article 72 de la Loi sur la gouvernance
locale prévoit qu’un conseil peut nommer des agents chargés de
l’application des règlements municipaux pour l’administration
locale et fixer les modalités de leur mandat;

contravention à un arrêté sont intentées au nom du greffier de
l’administration locale ou de toute autre personne désignée à
cette fin par le Conseil;

Malone, agent d’application de règlements
municipaux, soit, par les présentes, nommé agent
d’inspection et autorisé à pénétrer, à tout moment
raisonnable, sur tout bien-fonds situé dans les limites
territoriales de la Ville de Saint John afin d’effectuer
toute inspection nécessaire à l’administration et à
l’application du règlement sur les normes minimales
relatives aux propriétés de Saint John, adopté en
première et deuxième lectures le 10 septembre

par le Conseil municipal, puis promulgué après
l’approbation du ministre des Gouvernements

autorisation demeure en vigueur jusqu’à ce qu’il
cesse d’être employé du service de la Croissance et
des services communautaires de la Ville de Saint
John ou jusqu’à sa révocation par le Conseil

4. CONSIDÉRANT QUE le Conseil municipal de la Ville de Saint John adopte divers
arrêtés en vertu des pouvoirs que lui confère la Loi sur la gouvernance locale, L.N.-
B. 2017, ch. 18, avec ses modifications (la « Loi sur la gouvernance locale »),
notamment l’Arrêté concernant les locaux inesthétiques et les bâtiments et
constructions dangereux de Saint John, arrêté no M-30, avec ses modifications
(l’« Arrêté concernant les locaux inesthétiques et les bâtiments et constructions
dangereux de Saint John »), et qu’il peut être nécessaire d’effectuer des
inspections aux fins de l’administration et de l’application de cet arrêté;
ET CONSIDÉRANT QUE l’article 72 de la Loi sur la gouvernance
locale prévoit qu’un conseil peut nommer des agents chargés de
l’application des règlements municipaux pour l’administration
locale et fixer les modalités de leur mandat;
ET CONSIDÉRANT QUE le paragraphe 144(2) de la Loi sur la
gouvernance locale prévoit qu’un conseil peut autoriser des
agents à pénétrer, à tout moment raisonnable, dans un bien-
fonds, un bâtiment ou toute autre construction et à y effectuer
une inspection, après avoir donné un préavis raisonnable au
propriétaire ou à l’occupant du bien-fonds, du bâtiment ou de
toute autre construction;
QU’IL SOIT DÈS LORS RÉSOLU que Michael Malone, agent
d’application de règlements municipaux, soit, par les
présentes, nommé agent d’inspection et autorisé à pénétrer,
à tout moment raisonnable, sur tout bien-fonds situé dans
les limites territoriales de la Ville de Saint John afin
d’effectuer toute inspection nécessaire à l’administration et
à l’application de l’Arrêté concernant les locaux
inesthétiques et les bâtiments et constructions dangereux

de Saint John, adopté en première et deuxième lectures le
22 mai 2018 et en troisième lecture le 4 juin 2018 par le
Conseil municipal, puis promulgué après l’approbation du
ministre des Gouvernements locaux, et/ou de la Loi sur la
gouvernance locale, avec prise d’effet immédiate, et que
cette autorisation demeure en vigueur jusqu’à ce qu’il cesse
d’être employé du service de la Croissance et des services
communautaires de la Ville de Saint John ou jusqu’à sa
révocation par le Conseil municipal, selon la première
éventualité.
5. CONSIDÉRANT QUE le paragraphe 135(4) de la Loi sur la gouvernance locale,
L.N.-B. 2017, ch. 18, avec ses modifications, prévoit que, dans les trente jours
suivant l’exécution des exigences énoncées dans un avis ou l’acquittement d’une
dette envers une administration locale ou le ministre des Finances, selon le cas,
l’administration locale doit délivrer un certificat établi selon la forme prescrite par
règlement et portant le sceau de l’administration locale;
QU’IL SOIT DÈS LORS RÉSOLU que Jonathan A. Taylor, greffier
municipal, soit, par les présentes, autorisé à apposer le sceau de
la Ville de Saint John sur tout certificat délivré par Michael
Malone en vertu de l’Arrêté concernant les locaux inesthétiques
et les bâtiments et constructions dangereux de Saint John, avec
prise d’effet immédiate, et que cette autorisation demeure en
vigueur jusqu’à ce que Jonathan A. Taylor cesse d’exercer les
fonctions de greffier municipal de la Ville de Saint John ou jusqu’à
sa révocation par le Conseil municipal, selon la première
éventualité.
6. CONSIDÉRANT QUE le Conseil municipal de la Ville de Saint John a adopté divers
arrêtés en vertu des pouvoirs que lui confère la Loi sur l’urbanisme, L.N.-B. 2017,
ch. 19, avec ses modifications (la « Loi sur l’urbanisme »), notamment l’Arrêté de
zonage, arrêté no C.P. 110, avec ses modifications, et qu’il peut être nécessaire
d’engager des poursuites devant la Cour provinciale du Nouveau-Brunswick
lorsqu’une personne contrevient à ces arrêtés ou omet de s’y conformer;
ET CONSIDÉRANT QUE l’alinéa 137(a) de la Loi sur l’urbanisme
interdit à quiconque de contrevenir aux dispositions d’un arrêté
pris en vertu de cette loi ou d’omettre de s’y conformer;
ET CONSIDÉRANT QUE l’article 139 de la Loi sur l’urbanisme
prévoit que les poursuites pour une infraction à cette loi sont
intentées au nom du ministre, du greffier de l’administration
locale ou de toute autre personne désignée à cette fin par le
Conseil;
QU’IL SOIT DÈS LORS RÉSOLU que Michael Malone soit,
par les présentes, désigné et autorisé à déposer des

l’administration et l’application de ce règlement;
QU’IL SOIT DÈS LORS RÉSOLU que Michael Malone soit,
par les présentes, nommé inspecteur municipal, avec prise
d’effet immédiate, et que cette nomination demeure en
vigueur jusqu’à ce qu’il cesse d’être employé du service de
la Croissance et des services communautaires de la Ville de
Saint John ou jusqu’à sa révocation par le Conseil municipal,
selon la première éventualité.
8. CONSIDÉRANT QUE le Conseil municipal de la Ville de Saint John adopte divers
arrêtés en vertu des pouvoirs que lui confère la Loi sur l’administration du Code
du bâtiment, L.N.-B. 2020, ch. 8, avec ses modifications (la « Loi sur l’administration
du Code du bâtiment »), notamment Le Règlement de construction, arrêté no BC-
1, avec ses modifications, et qu’il peut être nécessaire, à l’occasion, de rendre des
ordonnances pour l’administration et l’application de cet arrêté;
ET CONSIDÉRANT QUE le paragraphe 134(1) de la Loi sur
l’administration du Code du bâtiment prévoit qu’un conseil peut
autoriser une personne qui constate qu’un aménagement est
entrepris en contravention de la Loi sur l’administration du Code
du bâtiment, d’un arrêté pris en vertu de cette loi ou d’une
condition imposée à un aménagement, à ordonner la cessation
de l’aménagement, sa modification afin de remédier à la
contravention, ou à prendre toute autre mesure nécessaire pour
remettre le bien-fonds, le bâtiment ou la construction dans l’état
où il se trouvait immédiatement avant le début de
l’aménagement.
QU’IL SOIT DÈS LORS RÉSOLU que Michael Malone soit,
par les présentes, autorisé à ordonner la cessation de tout
aménagement entrepris en contravention de la Loi sur

l’administration du Code du bâtiment, du Règlement de
construction ou des conditions imposées à l’aménagement,
à ordonner la modification d’un tel aménagement afin de

ou la construction dans l’état où il se trouvait immédiatement
avant le début de l’aménagement, avec prise d’effet
immédiate, et que cette autorisation demeure en vigueur
jusqu’à ce qu’il cesse d’être employé du service de la
Croissance et des services communautaires de la Ville de
Saint John ou jusqu’à sa révocation par le Conseil municipal,
selon la première éventualité.

les 151 et 155, chemin Sandy Point, et une troisième parcelle sans adresse municipale,
soit les PID 55150718 (151), 55150700 (155) et 00023945 (sans adresse municipale),

IL EST RÉSOLU que le Conseil municipal organise une présentation publique pour ce
point, lançant ainsi officiellement la période de commentaires publics de 30 jours requise
pour le projet de modification du plan municipal.
LA MOTION EST ADOPTÉE.
A. Poffenroth, directrice générale du Développement et des Services communautaires,
fait une présentation publique sur un projet de modification du plan municipal visant le 0,
boulevard Rex Hurley/0, chemin Glen (NID 55246706 et une partie du NID 00302778).
Plus tôt cette année, le Conseil a modifié l’utilisation désignée des terres dans le plan
municipal pour la propriété en question et a également procédé au rezonage de celle-ci.
La veille du jour où la Ville a déposé ses documents en vue de leur inscription, la Province
a déposé de manière indépendante un nouveau plan de lotissement pour la même
propriété. En raison du dépôt du plan de lotissement, un nouveau NID a été attribué à la
propriété. Ce nouveau NID ne correspond pas au NID d’origine indiqué dans les
documents de la Ville. Par conséquent, la Province demande que le processus de
désignation et de rezonage des terres soit relancé avec le nouveau NID. À l’exception du
NID, la demande elle-même n’a pas changé par rapport à celle qui avait été approuvée
précédemment par le Conseil. Pour relancer le processus de modification du plan
municipal, la première étape consiste à tenir une présentation publique annonçant qu’une
modification proposée sera prise en considération. Cette présentation publique marque
également le début officiel de la période de commentaires publics de 30 jours requise.
