1.1 Land Acknowledgement
The Mayor read aloud the Land Acknowledgement and called for a moment of reflection.
“The City of Saint John/Menaquesk is situated is the traditional territory of the
Wolastoqiyik/Maliseet.The Wolastoqiyik/Maliseet along with their Indigenous Neighbours,
the Mi’Kmaq/Mi’kmaw and Passamaquoddy/Peskotomuhkati signed Peace and Friendship
Treaties with the British Crown in the 1700s that protected their rights to lands and
resources.”

RESOLVED that the agenda of May 4, 2026 with the addition of items 17.1 Recommended
Appointments to Committees; 17.2 P.R.O. Kids Saint John Program Evaluation Report; 17.3
Renovation at Stalls 4, 5 and 6 at the City Market; 17.4 Jeremiah’s Lease Renewal - City
Market; and 17.5 Multipurpose Recreational Facility - Project Implementation Plan, be
approved.

5. Consent Agenda
5.1 RESOLVED that as recommended in the submitted report M&C 2026-099: Contract
2025-07 - Kennedy Street Combined Sewer Outfall Upgrade, Contract No 2025-07:
Kennedy Street Combined Sewer Outfall Upgrade be awarded to the low tenderer, L.
Sanford and Sons Ltd., at their tendered price of $791,263.98 (including HST) as calculated
based on estimated quantities, and further that the Mayor and City Clerk be authorized to
execute the necessary contract documents.
5.2 RESOLVED that as recommended in the submitted report M&C 2026-109: Contract
2025-14: Canterbury Street (Princess Street to Queen Street) Storm Sewer Installation and
Street Reconstruction, the contract be awarded to the low tenderer, Galbraith Construction
Ltd., at their tendered price of $1,483,500.00 (including HST) as calculated based on
estimated quantities, and further that the Mayor and City Clerk be authorized to execute the
necessary contract documents.
5.3 RESOLVED that as recommended in the submitted report M&C 2026-112: Contract
2025-26 Millidgeville Wastewater Treatment Facility UV Disinfection System Upgrades, the
project be awarded to the low tenderer, Fairville Construction Ltd., at their tendered price
of $3,360,300.00 (including HST) as calculated based on estimated quantities, and further
that the Mayor and City Clerk be authorized to execute the necessary contract documents.
5.4 RESOLVED that as recommended in the submitted report M&C 2026-125: Supply,
Planting and Maintenance of Trees - Award of Contract, Common Council award the tender
for Supply, Planting and Maintenance of Trees to Dowd Roofing Inc. at a total cost of
$275,250.00 plus HST.
5.5 RESOLVED that as recommended in the submitted report M&C 2026-130: Fleet
Replacement Procurement - May 2026, Common Council award the purchase of five (5)
Tandem Axle 68,000 Lb. Cab & Chassis (Plow Trucks) and attachments at a total cost of
$2,039,143.75 plus HST to Phil Larochelle Equipment Inc.
5.6 RESOLVED that as recommended in the submitted report M&C 2026-107: License
for Loyalist Day Military Gun Salute at Fort Howe, the City of Saint John enter into the
License Agreement with His Majesty The King In Right Of Canada, as represented by the
Minister of National Defence, in the form as attached to M&C 2026-107, for the purpose of
conducting a Loyalist Day 21 Gun Salute on a portion of PID 414276 being Fort Howe, and
that the Mayor and City Clerk be authorized to execute the said License Agreement.
5.7 RESOLVED that as recommended in the submitted report M&C 2026-097: Saint
John Community Arts Spring/Summer 2026 Funding Program:
1. Common Council receive and file the Saint John Community Arts Board’s letter
supporting the granting of funding to the successful applicants for the 2026
Spring/Summer Small Grants Funding; and
2. The Chief Financial Officer facilitates payment to the successful organizations.
5.8 RESOLVED that as recommended in the submitted report M&C 2026-093: 2026
Community Grant Top-Ups, Common Council allocate the remaining $6,000 from the 2026
Community Grant funding envelope to the two applicants selected by the Community Grants
Committee and listed in M&C 2026-093 and direct the Chief Financial Officer to facilitate
payment to the successful organizations.
5.9 RESOLVED that as recommended in the submitted report M&C 2026-110: External
Community Centre Funding, Common Council direct the Chief Financial Officer to disburse
2026 funding to external community centres as outlined in M&C 2026-110.
5.10 RESOLVED that as recommended in the submitted report M&C 2026-122:
Community Resilience Fund - Grants Approval 1st round 2026, Common Council award the
successful applicants of the Community Resilience Fund grant program 2026 – first round,
as listed in M&C 2026-122, and direct the Chief Financial Officer to facilitate payment to the
successful organizations.
5.11 RESOLVED that as recommended in the submitted report M&C 2026-118: Disaster
Mitigation and Adaptation Fund (DMAF) - Amending Agreement No.1 For Saint John Flood
Mitigation Strategy Project, the City enter into the Amending Agreement No. 1 for the Saint
John Flood Mitigation Strategy Project in the form as attached to M&C No. 2026-118 with
His Majesty the King in Right of Canada, as represented by the Minister of Housing,
Infrastructure and Communities for funding under the Disaster Mitigation and Adaptation
Fund for the project entitled “Saint John Flood Mitigation Strategy Project” and that the
Mayor and City Clerk be authorized to execute said Agreement.
5.12 RESOLVED that as recommended in the submitted report M&C 2026-120:
Designation of a By-law Enforcement Officer - Christopher Bauer, Common Council adopt
the following resolution appointing Christopher Bauer as a by-law enforcement officer for
various City By-laws:
1. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, and
amendments thereto (the “Local Governance Act”), including the Saint John Unsightly
Premises and Dangerous Buildings and Structures By-law, By-law Number M-30, and
amendments thereto (the “Saint John Unsightly Premises and Dangerous Buildings and
Structures By-law”), and it may from time to time be necessary to commence proceedings
in the Provincial Court of the Province of New Brunswick, when a person has violated or
failed to comply with the said By-law;
AND WHEREAS section 72 of the Local Governance Act provides that a council may appoint
by-law enforcement officers for the local government and may determine their terms of
office;
AND WHEREAS subsections 132(1) and 132(2) of the Local Governance Act provide that
an officer appointed by council may notify the owner or occupier of premises, a building or
structure by notice in the form prescribed by regulation when a condition exists pursuant to
subsections 131(1), 131(2) or 131(3) of the said Act;
AND WHEREAS subsection 150(1) of the Local Governance Act provides that proceedings
for breach of a by-law shall be commenced in the name of the clerk of the local government
or such other person as is designated for that purpose by the council;
NOW THEREFORE BE IT RESOLVED that Christopher Bauer is hereby appointed as a by-
law enforcement officer with respect to the enforcement of the Saint John Unsightly
Premises and Dangerous Buildings and Structures By-law, effective immediately, and this
appointment shall continue until they cease to be an employee of the Growth and
Community Services department of The City of Saint John or until it is rescinded by
Common Council, whichever comes first;
AND BE IT FURTHER RESOLVED that Christopher Bauer is hereby appointed and
authorized to notify owners and occupiers with respect to premises, buildings or structures
that are unsightly; buildings or structures that are a hazard to the safety of the public by
reason of being vacant or unoccupied; buildings or structures that are a hazard to the safety
of the public by reason of dilapidation or unsoundness of structural strength, as set out in
the Saint John Unsightly Premises and Dangerous Buildings and Structures By-law,
effective immediately, and this appointment and authorization shall continue until they cease
to be an employee of the Growth and Community Services department of The City of Saint
John or until it is rescinded by Common Council, whichever comes first;
AND BE IT FURTHER RESOLVED that Christopher Bauer is hereby designated and
authorized to lay informations in the Provincial Court of the Province of New Brunswick for
breach of the Saint John Unsightly Premises and Dangerous Buildings and Structures By-
law, effective immediately, and this designation and authorization shall continue until they
cease to be an employee of the Growth and Community Services department of The City of
Saint John or until it is rescinded by Common Council, whichever comes first.
2. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, and
amendments thereto (the “Local Governance Act”), including the Saint John Unsightly
Premises and Dangerous Buildings and Structures By- law, By-law Number M-30 and
amendments thereto (the “Saint John Unsightly Premises and Dangerous Buildings and
Structures By-law”), and it may from time to time be necessary to make inspections for the
administration and enforcement of the By-law;
AND WHEREAS section 72 of the Local Governance Act provides that a council may appoint
by-law enforcement officers for the local government and may determine their terms of
office;
AND WHEREAS subsection 144(2) of the Local Governance Act provides that a council may
authorize officers enter the land, building or other structure at any reasonable time, and
carry out the inspection after giving reasonable notice to the owner or occupant of the land,
building or other structure to be entered;
NOW THEREFORE BE IT RESOLVED that Christopher Bauer, by-law enforcement officer,
is hereby appointed as an inspection officer and authorized to enter at all reasonable times
upon any property within the territorial boundaries of the City of Saint John for the purpose
of making any inspection that is necessary for the administration and enforcement of the
Saint John Unsightly Premises and Dangerous Buildings and Structures By-law which
received first and second reading by Common Council on May 22, 2018 and third reading
on June 4, 2018, being enacted upon approval by the Minister of Local Government, and/or
the Local Governance Act effective immediately, and this authorization shall continue until
they cease to be an employee of the Growth and Community Services department of The
City of Saint John or until rescinded by Common Council, whichever comes first.
3. WHEREAS subsection 135(4) of the Local Governance Act, S.N.B. 2017 c.18, and
amendments thereto, provides that within thirty days after the terms of a notice have been
complied with or a debt due to a local government or due to the Minister of Finance, as the
case may be, is discharged, the local government shall provide a certificate in the form
prescribed by regulation which requires that the corporate seal of the local government be
affixed;
NOW THEREFORE BE IT RESOLVED that Jonathan A. Taylor, City Clerk, is hereby
authorized to affix the corporate seal of The City of Saint John to a Certificate of Discharge
that is issued by Christopher Bauer under the Saint John Unsightly Premises and Dangerous
Buildings and Structures By-law, and such authorization shall continue until Jonathan A.
Taylor ceases to be the City Clerk of The City of Saint John or until it is rescinded by
Common Council, whichever comes first.
4. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, including the
Saint John Dog Control By-law, By-law Number M-13, and the Mobile Home Parks By-law,
By-law Number M-20, including all amendments thereto, and it may from time to time be
necessary to commence proceedings in the Provincial Court of the Province of New
Brunswick, when a person has contravened or failed to comply with these By-laws;
AND WHEREAS section 72 of the Local Governance Act provides that a council may appoint
by-law enforcement officers for the local government and may determine their terms of
office;
AND WHEREAS section 150(1) of the Local Governance Act provides that proceedings for
breach of a by-law shall be commenced in the name of the clerk of the local government or
such other person as is designated for that purpose by the council;
NOW THEREFORE BE IT RESOLVED that Christopher Bauer is hereby appointed as by-law
enforcement officer with respect to the enforcement of the Saint John Dog Control By-law
and the Mobile Home Parks By-law, effective immediately, and this appointment shall
continue until he ceases to be an employee of Growth and Development Services of The
City of Saint John or until it is rescinded by Common Council, whichever comes first;
AND BE IT FURTHER RESOLVED that Christopher Bauer is hereby designated and
authorized to lay informations in the Provincial Court of the Province of New Brunswick for
breach of the Saint John Dog Control By-law and the Mobile Home Parks By-law, effective
immediately, and this appointment and authorization shall continue until he ceases to be an
employee of Growth and Community Services of The City of Saint John or until it is
rescinded by Common Council, whichever comes first.
5. WHEREAS the Common Council of The City of Saint John has enacted certain
bylaws pursuant to the authority of the Community Planning Act, S.N.B 2017, c. 19, and
amendments thereto, (the “Community Planning Act”), including The Zoning By-law, By-law
Number C.P. 110, including all amendments thereto, and it may from time to time be
necessary to commence proceedings in the Provincial Court of the Province of New
Brunswick, when a person has contravened or failed to comply with these By-laws;
AND WHEREAS paragraph 137(a) of the Community Planning Act provides that no person
shall violate or fail to comply with a provision of a by-law made under this Act;
AND WHEREAS section 139 of the Community Planning Act provides that proceedings for
an offence under this Act shall be commenced in the name of the Minister or the clerk of
the local government or any other person who is designated for that purpose by the council;
NOW THEREFORE BE IT RESOLVED that Christopher Bauer is hereby designated and
authorized to lay informations in the Provincial Court of the Province of New Brunswick for
breach of The Zoning By-law, effective immediately, and this appointment and authorization
shall continue until they cease to be an employee of the Growth and Community Services
department of The City of Saint John or until it is rescinded by Common Council, whichever
comes first.
6. WHEREAS the Common Council of The City of Saint John has enacted a by-law
pursuant to the authority of the Building Code Administration Act, S.N.B. 2020, c. 8, and
amendments thereto, (the “Building Code Administration Act”), namely the Building By-law,
By-law Number BC-1 and amendments thereto (the “Building Bylaw”), and it is necessary
to appoint building inspectors, acting building inspectors, deputy building inspectors and
city inspectors for the administration and enforcement of this By-law;
NOW THEREFORE BE IT RESOLVED that Christopher Bauer is hereby appointed as a city
inspector, effective immediately, and this appointment shall continue until they cease to be
an employee of the Growth and Community Services department of The City of Saint John
or until rescinded by Common Council, whichever comes first.
7. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Building Code Administration Act, S.N.B 2020, c. 8, and
amendments thereto, (the “Building Code Administration Act”) including the Building By-
law, By-law Number BC-1, and amendments thereto, and it may from time to time be
necessary to make orders for the administration of these By-laws;
AND WHEREAS subsection 134(1) of the Building Code Administration Act provides that a
council may authorize persons to, when a development is undertaken in violation of the
Building Code Administration Act, a by-law or regulation under the Building Code
Administration Act, a by-law or terms and conditions imposed on the development, order
the cessation of the development, alteration of such development so as to remove the
violation, or the doing of anything required to restore the land, building or structure to its
condition immediately prior to the undertaking of such development;
NOW THEREFORE BE IT RESOLVED that Christopher Bauer is hereby authorized to, when
a development is undertaken in violation of the Building Code Administration Act, the
Building By-law or the terms and conditions imposed on the development, order the
cessation of the development, alteration of such development so as to remove the violation,
or the doing of anything required to restore the land, building or structure to its condition
immediately prior to the undertaking of such development, effective immediately, and this
authorization shall continue until they cease to be an employee of Growth and Community
Services of The City of Saint John or until rescinded by Common Council, whichever comes
first.
8. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Building Code Administration Act, S.N.B 2020, c. 8, and
amendments thereto (the “Building Code Administration Act”), including the Building By-
law, By-law Number BC-1, and amendments thereto, and it may from time to time be
necessary to commence proceedings in the Provincial Court of the Province of New
Brunswick, when a person has violated or failed to comply with the said By-law;
AND WHEREAS paragraph 137(a) of the Building Code Administration Act provides that no
person shall violate or fail to comply with a provision of a by-law made under this Act;
AND WHEREAS section 139 of the Building Code Administration Act provides that
proceedings for an offence under this Act shall be commenced in the name of the Minister
or the clerk of the local government or any other person who is designated for that purpose
by the council;
NOW THEREFORE BE IT RESOLVED that Christopher Bauer is hereby designated and
authorized to lay informations in the Provincial Court of the Province of New Brunswick for
breach of the Saint John Building By-law, effective immediately, and this appointment and
authorization shall continue until they cease to be an employee of Growth and Community
Services of The City of Saint John or until it is rescinded by Common Council, whichever
comes first.
5.13 RESOLVED that as recommended in the submitted report M&C 2026-121:
Designation of By-law Enforcement Officers - Community Safety Services, Common Council
adopt the following resolution appointing City Staff and Community Safety Services (CSS)
Team members as by-law enforcement officers under the City’s Nuisance By-law:
1. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, and
amendments thereto (the “Local Governance Act”), including the Saint John Nuisance By-
law, By-law Number LG-24, and amendments thereto (the “Saint John Nuisance By-law”),
and it may from time to time be necessary to commence proceedings in the Provincial Court
of the Province of New Brunswick, when a person has violated or failed to comply with the
said By-law;
AND WHEREAS section 72 of the Local Governance Act provides that a council may appoint
by-law enforcement officers for the local government and may determine their terms of
office;
NOW THEREFORE BE IT RESOLVED that Benn Purinton is hereby appointed as a by-law
enforcement officer with respect to the enforcement of the Saint John Nuisance By-law,
effective immediately, and this appointment shall continue until they cease to be an
employee of the Growth and Community Services department of The City of Saint John or
until it is rescinded by Common Council, whichever comes first.
AND BE IT FURTHER RESOLVED that Benn Purinton is hereby designated and authorized
to lay informations in the Provincial Court of the Province of New Brunswick for breach of
the Saint John Nuisance By-law, effective immediately, and this designation and
authorization shall continue until they cease to be an employee of Growth and Community
Services of The City of Saint John or until it is rescinded by Common Council, whichever
comes first.

until it is rescinded by Common Council, whichever comes first.
AND BE IT FURTHER RESOLVED that Christopher McKiel is hereby designated and
authorized to lay informations in the Provincial Court of the Province of New Brunswick for
breach of the Saint John Nuisance By-law, effective immediately, and this designation and
authorization shall continue until they cease to be an employee of Growth and Community
Services of The City of Saint John or until it is rescinded by Common Council, whichever
comes first.

AND BE IT FURTHER RESOLVED that Lauren Williams is hereby designated and authorized
to lay informations in the Provincial Court of the Province of New Brunswick for breach of
the Saint John Nuisance By-law, effective immediately, and this designation and
authorization shall continue until they cease to be an employee of Growth and Community
Services of The City of Saint John or until it is rescinded by Common Council, whichever
comes first.

Saint John Nuisance By-law, effective immediately, and this designation and authorization
shall continue until they cease to be an employee of Growth and Community Services of

employee of the Growth and Community Services department of The City of Saint John or
until it is rescinded by Common Council, whichever comes first.
AND BE IT FURTHER RESOLVED that Pamela Bentley is hereby designated and authorized
to lay informations in the Provincial Court of the Province of New Brunswick for breach of
the Saint John Nuisance By-law, effective immediately, and this designation and
authorization shall continue until they cease to be an employee of Growth and Community
Services of The City of Saint John or until it is rescinded by Common Council, whichever
comes first.

Staff Presentation - North End Plan (1st and 2nd Reading)
Commissioner Poffenroth provided an introduction for the Municipal Plan Amendment to
adopt the North End Neighbourhood Plan (The Plan), a 20–25-year secondary municipal
plan developed under the Community Planning Act and in fulfilment of both the City's 10-
Year Strategic Plan and its Housing Accelerator Fund Action Plan. The Plan covers
approximately 926 hectares across six distinct character areas and identifies the capacity
to accommodate between 6,000 and 11,800 new homes on currently vacant or underutilized
land, supported by detailed land use designations, built form guidelines, and eight catalyst
sites illustrating the type of mixed-use, transit-oriented development envisioned.
Implementation will be advanced through a non-binding 5-year action schedule, coordinated
infrastructure and transportation studies anticipated by end of 2026, and a new
Beautification Program to support the revitalization of building and street appearance along
key corridors.

2026, Common Council:
1. Adopt the recommendations in the 2026 P.R.O. Kids Saint John Program

2. Direct the CAO to implement the recommendations outlined in the P.R.O. Kids
Program Evaluation Report and that the CAO have discretion in addressing
program needs through a permanent staffing model.

said Agreement.

au plus bas soumissionnaire conforme, soit Galbraith Construction Ltd., pour le montant
soumis de 1 483 500,00 $ (TVH comprise), calculé selon les quantités estimatives, et que
la mairesse et le greffier municipal soient autorisés à signer tous les documents
contractuels nécessaires.
5.3 IL EST RÉSOLU que, conformément à la recommandation formulée dans le
rapport M&C 2026-112 intitulé « Contrat 2025-26 – Amélioration du système de
désinfection par ultraviolets à la station d’épuration des eaux usées de Millidgeville », le
contrat soit attribué au plus bas soumissionnaire conforme, soit Fairville Construction Ltd.,
pour le montant soumis de 3 360 300,00 $ (TVH comprise), calculé selon les quantités
estimatives, et que la mairesse et le greffier municipal soient autorisés à signer tous les
documents contractuels nécessaires.
5.4 IL EST RÉSOLU que, conformément à la recommandation formulée dans le
rapport M&C 2026-125 intitulé « Approvisionnement, plantation et entretien des arbres –
Attribution du contrat », le Conseil municipal attribue le contrat d’approvisionnement, de
plantation et d’entretien des arbres à Dowd Roofing Inc. pour un montant total de
275 250,00 $, plus la TVH.
5.5 IL EST RÉSOLU que, conformément à la recommandation formulée dans le
rapport M&C 2026-130 intitulé « Approvisionnement pour le remplacement du parc
automobile – Mai 2026 », le Conseil municipal approuve l’achat de cinq (5) camions de
déneigement à cabine et châssis, à essieu tandem, d’un poids nominal de 68 000 lb, ainsi
que des accessoires connexes, auprès de Phil Larochelle Equipment Inc., pour un montant
total de 2 039 143,75 $, plus la TVH.
5.6 IL EST RÉSOLU que, conformément à la recommandation formulée dans le
rapport M&C 2026-107 intitulé « Permis relatif à la salve d’honneur de 21 coups de la
Journée des Loyalistes à Fort Howe », la Ville de Saint John conclue une entente de
licence avec Sa Majesté le Roi du chef du Canada, représentée par le ministre de la
Défense nationale, essentiellement selon la forme jointe au rapport M&C 2026-107, afin
de permettre le tir d’une salve d’honneur de 21 coups à l’occasion de la Journée des
Loyalistes sur une partie du NID 414276, soit Fort Howe, et que la mairesse et le greffier
municipal soient autorisés à signer ladite entente de licence.
5,7 IL EST RÉSOLU que, conformément à la recommandation formulée dans le
rapport M&C 2026-097 intitulé « Programme de financement des arts communautaires de
Saint John – Printemps/été 2026 » :
1. le Conseil municipal reçoive et dépose la lettre du Conseil des arts
communautaires de Saint John appuyant l’octroi de fonds aux bénéficiaires
retenus dans le cadre du programme de petites subventions du printemps/été
2026;

2. Le directeur financier soit autorisé à effectuer les paiements aux organismes
retenus.
5.8 IL EST RÉSOLU que, conformément à la recommandation formulée dans le
rapport M&C 2026-093 intitulé « Suppléments aux subventions communautaires 2026 »,
le Conseil municipal alloue le solde de 6 000 $ de l’enveloppe de financement des
subventions communautaires de 2026 aux deux organismes retenus par le Comité des
subventions communautaires, conformément aux recommandations figurant dans le
rapport M&C 2026-093, et que le directeur financier soit autorisé à effectuer les paiements
aux organismes retenus.
5.9 IL EST RÉSOLU que, conformément à la recommandation formulée dans le
rapport M&C 2026-110 intitulé « Financement des centres communautaires externes », le
Conseil municipal autorise le directeur financier à verser les fonds prévus pour 2026 aux
centres communautaires externes, conformément aux recommandations figurant dans le
rapport M&C 2026-110.
5.10 IL EST RÉSOLU que, conformément à la recommandation formulée dans le
rapport M&C 2026-122 intitulé « Fonds de résilience communautaire – Approbation des
subventions, premier tour de 2026 », le Conseil municipal approuve l’octroi des
subventions aux organismes retenus dans le cadre du premier tour du programme de
subventions du Fonds de résilience communautaire 2026, conformément aux
recommandations figurant dans le rapport M&C 2026-122, et que le directeur financier
soit autorisé à effectuer les paiements aux organismes retenus.
5.11 IL EST RÉSOLU que, conformément à la recommandation formulée dans le
rapport M&C 2026-118 intitulé « Fonds d’atténuation et d’adaptation en matière de

catastrophes (FAAC) – Entente de modification n 1 relative au projet de stratégie
o
d’atténuation des inondations à Saint John », la Ville conclue l’entente de modification n 1
relative au projet de stratégie d’atténuation des inondations à Saint John, essentiellement
selon la forme jointe au rapport M&C 2026-118, avec Sa Majesté le Roi du chef du Canada,
représentée par le ministre du Logement, de l’Infrastructure et des Collectivités, afin
d’obtenir un financement dans le cadre du Fonds d’atténuation et d’adaptation en matière
de catastrophes pour le projet intitulé « Projet de stratégie d’atténuation des inondations
à Saint John », et que la mairesse et le greffier municipal soient autorisés à signer ladite
entente.
5.12 IL EST RÉSOLU que, conformément à la recommandation formulée dans le
rapport M&C 2026-120 intitulé « Désignation d’un agent d’application des règlements
municipaux – Christopher Bauer », le Conseil municipal adopte la résolution suivante afin
de nommer Christopher Bauer à titre d’agent chargé de l’application de divers règlements
municipaux :
1. CONSIDÉRANT QUE le Conseil municipal de la Ville de Saint John a adopté divers
arrêtés en vertu des pouvoirs que lui confère la Loi sur la gouvernance locale, L.N.-B.
2017, ch. 18, avec ses modifications (la « Loi sur la gouvernance locale »), notamment
l’Arrêté concernant les locaux inesthétiques et les bâtiments et constructions dangereux

Brunswick lorsqu’une personne contrevient à cet arrêté ou omet de s’y conformer;
ET CONSIDÉRANT QUE l’article 72 de la Loi sur la gouvernance locale prévoit qu’un
conseil peut nommer des agents chargés de l’application des règlements municipaux pour
l’administration locale et fixer les modalités de leur mandat;
ET CONSIDÉRANT QUE les paragraphes 132(1) et 132(2) de la Loi sur la gouvernance
locale prévoient qu’un agent nommé par le Conseil municipal peut signifier au propriétaire
ou à l’occupant d’un lieu, d’un bâtiment ou d’une construction un avis établi selon la
formule prescrite par arrêté lorsqu’une situation visée aux paragraphes 131(1), 131(2) ou
131(3) de cette loi existe;
ET CONSIDÉRANT QUE le paragraphe 150(1) de la Loi sur la gouvernance locale prévoit
que les poursuites relatives à une contravention à un arrêté sont intentées au nom du
greffier de l’administration locale ou de toute autre personne désignée à cette fin par le
Conseil;
QU’IL SOIT DÈS LORS RÉSOLU que Christopher Bauer soit, par les présentes, nommé
agent chargé de l’application des arrêtés municipaux aux fins de l’application de l’Arrêté
concernant les locaux inesthétiques et les bâtiments et constructions dangereux de Saint
John, avec prise d’effet immédiate, et que cette nomination demeure en vigueur jusqu’à
ce qu’il cesse d’être employé du service de la Croissance et des services communautaires
de la Ville de Saint John ou jusqu’à sa révocation par le Conseil municipal, selon la
première éventualité.
ET QU’IL SOIT EN OUTRE RÉSOLU que Christopher Bauer soit, par les présentes, nommé
et autorisé à signifier des avis aux propriétaires et aux occupants concernant les locaux,
bâtiments ou constructions qui sont inesthétiques, les bâtiments ou constructions qui
présentent un risque pour la sécurité du public parce qu’ils sont vacants ou inoccupés,
ainsi que les bâtiments ou constructions qui présentent un risque pour la sécurité du public
en raison de leur dégradation ou du mauvais état de leur structure, conformément à
l’Arrêté concernant les locaux inesthétiques et les bâtiments et constructions dangereux
de Saint John, avec prise d’effet immédiate, et que cette nomination et cette autorisation
demeurent en vigueur jusqu’à ce qu’il cesse d’être employé du service de la Croissance
et des services communautaires de la Ville de Saint John ou jusqu’à sa révocation par le
Conseil municipal, selon la première éventualité;
ET QU’IL SOIT EN OUTRE RÉSOLU que Christopher Bauer soit, par les présentes,
désigné et autorisé à déposer des dénonciations devant la Cour provinciale du Nouveau-
Brunswick relativement à toute contravention à l’Arrêté concernant les locaux
inesthétiques et les bâtiments et constructions dangereux de Saint John, avec prise d’effet

bâtiment ou de toute autre construction;
QU’IL SOIT DÈS LORS RÉSOLU que Christopher Bauer, agent d’application de
règlements municipaux, soit, par les présentes, nommé agent d’inspection et autorisé à
pénétrer, à tout moment raisonnable, sur tout bien-fonds situé dans les limites territoriales
de la Ville de Saint John afin d’effectuer toute inspection nécessaire à l’administration et
à l’application de l’Arrêté concernant les locaux inesthétiques et les bâtiments et
constructions dangereux de Saint John, adopté en première et deuxième lectures le
22 mai 2018 et en troisième lecture le 4 juin 2018 par le Conseil municipal, puis promulgué
après l’approbation du ministre des Gouvernements locaux, et/ou de la Loi sur la
gouvernance locale, avec prise d’effet immédiate, et que cette autorisation demeure en
vigueur jusqu’à ce qu’il cesse d’être employé du service de la Croissance et des services
communautaires de la Ville de Saint John ou jusqu’à sa révocation par le Conseil
municipal, selon la première éventualité.
3. CONSIDÉRANT QUE le paragraphe 135(4) de la Loi sur la gouvernance locale,
L.N.-B. 2017, ch. 18, avec ses modifications, prévoit que, dans les trente jours suivant
l’exécution des exigences énoncées dans un avis ou l’acquittement d’une dette envers
une administration locale ou le ministre des Finances, selon le cas, l’administration locale
doit délivrer un certificat établi selon la forme prescrite par règlement et portant le sceau
de l’administration locale;
QU’IL SOIT DÈS LORS RÉSOLU que Jonathan A. Taylor, greffier municipal, soit, par les
présentes, autorisé à apposer le sceau de la Ville de Saint John sur tout certificat délivré
par Christopher Bauer en vertu de l’Arrêté concernant les locaux inesthétiques et les
bâtiments et constructions dangereux de Saint John, avec prise d’effet immédiate, et que
cette autorisation demeure en vigueur jusqu’à ce que Jonathan A. Taylor cesse d’exercer
les fonctions de greffier municipal de la Ville de Saint John ou jusqu’à sa révocation par le

T CONSIDÉRANT QUE l’alinéa 137a) de la Loi sur l’urbanisme interdit à quiconque de
contrevenir aux dispositions d’un arrêté pris en vertu de cette loi ou d’omettre de s’y
conformer;
ET CONSIDÉRANT QUE l’article 139 de la Loi sur l’urbanisme prévoit que les poursuites
pour une infraction à cette loi sont intentées au nom du ministre, du greffier de
l’administration locale ou de toute autre personne désignée à cette fin par le Conseil;

aménagement, à ordonner la cessation de l’aménagement, sa modification afin de
remédier à la contravention, ou à prendre toute autre mesure nécessaire pour remettre le
bien-fonds, le bâtiment ou la construction dans l’état où il se trouvait immédiatement avant
le début de l’aménagement.

d’urbanisme et présentation du personnel – Plan d’aménagement du Quartier Nord
(1 ʳᵉ et 2 ᵉ lectures)
La commissaire Poffenroth présente une introduction à la modification du Plan municipal
visant l’adoption du Plan d’aménagement du Quartier nord (le « Plan »), un plan secondaire
d’aménagement d’une durée de 20 à 25 ans élaboré en vertu de la Loi sur l’urbanisme et
en appui au Plan stratégique décennal et à son plan d’action dans le cadre du Programme
du Fonds pour accélérer la construction de logements. Le Plan couvre environ
926 hectares répartis en six secteurs de caractère distincts et prévoit une capacité
d’accueil de 6 000 à 11 800 nouveaux logements sur des terrains actuellement vacants
ou sous-utilisés. Il est appuyé par des désignations détaillées d’utilisation du sol, des lignes
directrices sur la forme bâtie et huit sites catalyseurs illustrant le type d’aménagement à
usage mixte axé sur le transport en commun envisagé.
La mise en œuvre du Plan s’effectuera au moyen d’un calendrier d’action quinquennal
non contraignant, d’études coordonnées sur les infrastructures et les transports devant
être achevées d’ici la fin de 2026, ainsi que d’un nouveau programme d’embellissement
destiné à soutenir la revitalisation des bâtiments et l’amélioration du paysage de rue le
long des principaux corridors.

Le maire adjoint MacKenzie présente une vue d’ensemble en tant que président du Comité
de la croissance.

IL EST RÉSOLU que, conformément à la recommandation du Comité plénier, réuni le
4 mai 2026, le Conseil municipal :
1. Adopte les recommandations énoncées dans le Rapport d’évaluation du
programme P.R.O. Jeunesse de Saint John;
2. Charge l’administrateur en chef de mettre en œuvre les recommandations
énoncées dans le Rapport d’évaluation du programme P.R.O. Jeunesse et lui
confère le pouvoir discrétionnaire de répondre aux besoins du programme au
moyen d’un modèle de dotation permanent.

17.3 Rénovation des bancs 4, 5 et 6 du Marché de la Ville

1. Approuve le devis présenté par ServiceMaster pour les travaux de rénovation des
bancs 4, 5 et 6 du Marché de la Ville;
2. Autorise la mairesse et le greffier municipal à signer tous les documents
nécessaires.

1. Autorise la Ville à conclure un bail, essentiellement selon la forme jointe au rapport
M&C 2026-094, avec RoseLynn Foods Ltd., exerçant ses activités sous le nom de
Jeremiah Deli & Catering, relativement aux bancs S-4, 5 et 6 ainsi qu’aux espaces
connexes du Marché de la Ville;
2. Autorise la mairesse et le greffier municipal à signer tous les documents
nécessaires.

Autorise la Ville à conclure l’accord de mise en œuvre du projet, essentiellement selon la
forme jointe au rapport M&C 2026-117 et jugée acceptable par le chef du contentieux,
avec Greater Saint John Fieldhouse Inc., relativement à la conception, à la construction et
à l’exploitation du nouveau complexe récréatif polyvalent; autorise la mairesse et le greffier
municipal à signer ledit accord.
