A BY-LAW RESPECTING POWERS OF ARRfTf, CONCERNANT LES ACTIVITtS
OUTGOING COUNCIL OF THE CITY OF DU CONSEIL SORTANT DE THE CITY OF
SAINT JOHN SAINT JOHN
WHEREAS, paragraph 56(3)(b) of the
Local Governance Act provides that despite
subsections 56(1) and 56(2), an outgoing council
may do those things referred to in subsection 56(1)
if it is authorized by a by-law made before the day
of the general election.
NOW THEREFORE, the Common Council
of The City of Saint John enacts as follows:
1. During the period commencing on the day
of the general municipal election in the year 2026
and ending on the day of the first meeting of the
incoming council, the City of Saint John outgoing
council is authorized to do the following:
(a) Become a party to an agreement, contract,
instrument or other document in respect of
the matters described below:
i. Contribution Agreement with the
Province of New Brunswick under
the Canada Housing Infrastructure
Fund — Charlotte Street
Infrastructure Upgrades
ii. Contract No. 2026-06: Rockwood
Reservoir Rehabilitation
iii. Community Development Funding
Agreements with the Regional
Development Corporation of the
Province of New Brunswick for
various facilities as identified in the
corresponding applications for
funding submitted by the City.
ATTENDU QUE, Valin6a 56(3)b) de la Lai
sur la gouvernance locale pr6voit que par
d6rogation aux paragraphes 56(1) et 56(2), le
conseil sortant peut exercer les pouvoirs 6num6r6s
au paragraphe 56(1) si un arrdt6 pris avant la date
de 1'61ection g6n6rale Fy autorise.
A CES CAUSES, le conseil communal de
The City of Saint John 6dicte :
1. Pendant la p6riode comprise entre la date
des elections municipales g6n6rales de 2026 et celle
de la premi&re reunion du conseil entrant
inclusivement, le conseil sortant de The City of
Saint John est auton* se 'a agir comme suit:
(a) bre partie A une entente, A un accord, A un
contrat, A un instrument ou A tout autre
document relativement aux questions d6crites
ci-apr6s :
(b) Make payments of funds as it relates to the (b)
matters described below:
i. Make advance payments for
approved budgets of City controlled
Agencies, Boards and
Commissions.
ii. Establish, fund and draw upon
Operating and Capital Reserves.
2. A by-law of The City of Saint John enacted
on the 5 1h day of May, 2021 entitled "A By-
law Respecting the Powers of Outgoing
Council of The City of Saint John" is
repealed.
Entente de contribution avec la
province du Nouveau -Brunswick
dans le cadre du Fonds canadien
pour les infrastructures li6es au
logement -- Modernisation des
infrastructures de la rue Charlotte.
ii. Contrat N' 2025-26 : R6habilitati
du r6servoir de Rockwood I
iii. Ententes de financement relatives
au d6veloppement communautaire
avec la Soci6t6 de d6veloppement
regional de la Province du
Nouveau -Brunswick pour diverses
installations comme identifi6 dans
les demandes de financement
correspondantes pr6sent6es par la
municipalit6.
Effectuer des paiements concemant les
affaires d6crites plus bas :
i. Verser des paiements par
anticipation pour les budgets
approuv6s des agences, conseils et
commissions de la municipalit6.
ii. Cr6er, financer les reserves de
fonctionnement et de capital et y
purser.
2. L'arr&6 de la ville de Saint John 6dict& le 5
mai, 2021 et intitul6 << Arr&e concernant les
Activites du conseil de The City of Saint
John>> est abrog&.
