A LAW TO AMEND THE
MUNICIPAL PLAN BY-LAW
Be it enacted by The City of Saint John
in Common Council convened, as follows:
The Municipal Plan By-law of The
City of Saint John enacted on the 30th day of
January, A.D. 2012 is amended by:
1. Deleting Policy LU-95 and replacing it
with the following:
"Policy LU-95 Create the Rural Resource
Area designation on the Future Land Use map
(Schedule B). Council intends that land within
the Rural Resource Area designation shall
generally remain in their natural state, or,
subject to regulation and required approvals, be
used for appropriate resource uses including
forestry operations, wind and solar energy
development, agriculture uses including
livestock operations and the fishery, and
extraction activities, including pits and
quarries.
Provide that wind and solar energy
developments may be located in the Rural
Resource Area designation. Wind energy
development shall be permitted provided that
the land is rezoned to the Green Energy zone,
and solar energy development shall be
permitted in both the Rural and Green Energy
zones. The Green Energy zone defines the
specific performance standards for their
operation, and the rehabilitation of operative
and inoperative wind and solar energy
developments. In considering applications to
rezone a property to the Green Energy Zone,
Council shall ensure the proposed use can
demonstrate compliance with the following:
a) The proposal is in conformity with the
goals, policies and intent of the
Municipal Plan;
b) Compatibility with and/or minimal
impact on existing adjacent land uses;
c) Submission of measures to mitigate
storm water drainage, noise, and other
impacts;
d) Where appropriate, the provision of
visual screening for solar energy
developments;
e) Shall not be located within municipally
owned Parks including, but not limited
to Rockwood Park;
f) All application policies from Section I-2.

rurales demeurent generalement a leur etat

liees aux ressources, y cornpris les
operations forestieres, les pares eoliens et
solaires, des utilisations agricoles - y
cornpris les fermes d'elevage et la peche -
et des activites d'extractions - y cornpris
les carrieres et les ballastieres.
Prevoir que les parts eoliens et solaires
peuvent titre exploites dans la designation
de secteur de ressources rurales. Les pares
eoliens peuvent titre exploites pourvu
qu'ils soient rezones zone d'energie verte,
et les pares solaires peuvent etre exploites
pourvu qu'ils soient rezones zone rurale
ou zone d'energie verte. La zone d'energie
verte prescrit les normes specifiques de
rendement de leur exploitation et la remise
en etat des pares eoliens et solaires
exploites ou non. Lorsqu'il etudie les
demandes visant a rezoner une propriete
en zone d'energie verte, le Conseil
s' assurera qu' i l poun a titre demontre que

a) La proposition est conforme aux
objectifs, aux politiques et a
l'intention du plan municipal;
b) La compatibilite avec les
utilisation actuelles des sols
adjacents et une incidence minimale
sur celles-ci;

niveau du drainage des eaux pluviales
et du bruit;
d) La ou ils conviennent, la presence
