entitled "Zoning By -Law" enacted on the fifteenth
day of December, A.D. 2014, is hereby amended as
follows:

"Bulk Hydrogen Storage Depot" means a facility
for the storage and distribution of hydrogen in bulk
quantities, which may include storage tanks,
distribution infrastructure, and tanker vehicle
access, but does not include retail sales, on -site

"Data Centre" means a facility used primarily for
the storing, management, and operation of
computer servers and associated equipment for the

digital data. A data centre may include ancillary
offices, maintenance areas, backup power systems,

does not include facilities intended primarily for
personal or public use, such as internet cafes.

"Electrical Generation Station" means a facility for
the generation of electricity, together with all the
ancillary structures, equipment, and infrastructure
necessary for generation, storage, transmission,

"Hydrogen Manufacturing" means a heavy
industrial use involving the generation, storage, and
distribution of hydrogen. The use may include
associated infrastructure such as compression
systems, storage vessels, and ancillary support
buildings, but does not include retail sales or on -

"Project Accommodation" means a residential
complex used to house workers on a temporary
basis. Project Accommodations are usually made
up of mobile units and used for sleeping, eating,
and other basic needs. These units can be taken

"Timber Processing Facility" means a building
used for the milling, planing, shaping, or finishing
of timber, where all processing activities and the
storage of woodchips or wood by-products are fully

12.8 Spruce Lake Industrial Zone (SLI)
Municipal Plan Context
The Spruce Lake Industrial (SLI) zone
accommodates a mix of light, medium and limited
large-scale heavy industrial uses within the
expansion area of Spruce Lake Industrial Park. The
zone allows for a range of industrial uses with
additional zone standards to reduce the impact on
the nearby residential community.
The Spruce Lake Industrial (SLI) zone is intended
for land inside or outside of the Primary
Development Area that is designated Heavy

12.8(2) Prohibited Uses
The following uses are not permitted in the Spruce
Lake Industrial Zone:
• Asphalt Plant;
• Cement Plant;
• Concrete Plant;
• Fertilizer Manufacture and Storage, as per
the volatile industrial use;
• Forestry Use (including lumber mill);
• Petroleum Refinery, as per the volatile
industrial use;
• Pulp and Paper Mill, as per the offensive
industrial use;
• Recycling Facility;
• Scrap or Salvage Yard.
12.8(3) Conditions of Use
(a) Unless otherwise specified, those uses
which are secondary or accessory to the
principal use of the lot within the Spruce
Lake Industrial zone will be permitted
anywhere within the zone, provided they
are a minimum distance of 150 metres
from an existing residential property line.
This is identified on Schedule K as areas
A, B and C. These include site
development and buildings or structures
that include, but are not limited to, the
following:
• Accessory building
• Business Administration and/or
Offices
• Food Service
• Meeting Facility
• Outdoor Storage
• Parking
• Project Accommodation
• Training Facility
(b) Outdoor storage permitted as a main use at
subsection 12.8(1) or as an accessory or
secondary use to a main use, shall be
subject to the following when located less
than 150 metres from a street:
(i) the yard shall not occupy any
required front or flankage yard, or
any area required for parking;
(ii) the yard shall be completely

12.8(3) Conditions regissant les usages
a) Sauf indication contraire, ces usages qui
sont secondaires ou accessoires par rapport

b) L'entreposage A fair Libre permis en taut
qu'usage principal par le
paragraphe 12.8(1) ou en tant qu'usage

usage principal est subordonne aux
conditions suivantes lorsqu'il est situe a
mains de 150 metres d'une rue:
(i) la cour d'entreposage ne doit pas

structures, berms, and landscaping;
and
(iv) when the yard is developed within
15 metres of an abutting lot in a
Residential zone, the yard shall
also be in accordance with section
5.5.
(c) Project Accommodation is permitted at c)
subsection 12.8(1) subject to a
Development Permit reviewed and
approved by the Development Officer
detailing:

accommodation or additional beds
(for expansions) and the number of
proposed beds intended for
construction, operational, and
camp staffing requirements;
(ii)
a phasing plan that indicates
which, if any, areas are to be
cleared, where accommodations
are to be developed, and their
associated timelines of
construction and occupancy;
(iii)
the location and dimensions of all
existing and proposed buildings,
their distance to the property lines,
as well as the dimension and
location of all property lines;
(iv)
proposed parking areas, bus
loading and unloading areas,
location of barrier free stalls,
entrances and exits to municipal
roads, fire department access
routes and off-street loading areas;
(v)
floor plans showing the layout and
dimensions of the interior spaces
including labeling their uses and
the number of proposed beds;
(vi)
a list of all amenities, including but
not limited to, health facilities and
recreation facilities;
(vii)
the method of supplying water,
sewage and waste collection to the
accommodation, and if not
connecting to municipal
infrastructure, a detailed servicing

(d) Heavy Industrial Use is permitted at
section 12.8(1) provided a main use does
not result in the discharge of air pollutants.
Such pollutants include, but are not limited
to:
• Particulate Matter (PM)
• Ground -level Ozone (03)
• Nitrogen Dioxide (NO2)
• Sulphur Dioxide (SO2)
• Volatile Organic Compounds
(VOCs)
(e) An Electrical Generation Station is a
permitted use at subsection 12.8(1)
provided it is smaller than 300MW, and
non-nuclear. Notwithstanding paragraph
12.8(3)(d), an Electrical Generation Station
that is fueled by natural gas or hydrogen,
and is smaller than 300MW, shall be
permitted as long as it is located a
minimum of 1,000 metres from a
residential property line.
(f) Any use involving the manufacturing,
storage, or delivery of bulk hydrogen
permitted at subsection 12.8(1) shall be
subject to a risk assessment pursuant to
subsection 12.8(4). For greater clarity,
Hydrogen Manufacturing or a Hydrogen
Bulk Storage Depot are generally
considered to be a Heavy Volatile Use.

e) Une centrale de production d'dlectricitd est
un usage permis par le paragraphe 12.8(1),
A condition qu'elle soit non nucldaire et de
puissance infdrieure a 300 MW. Malgrd
1'alin6a 12.8(3)(d), une centrale de
production d'dlectricitd alimentde au gaz
naturel ou a 1'hydrogene et de puissance
infdrieure a 300 MW est permise, a
condition de se situer a une distance
minimale de 1 000 metres d'une limite de
propridtd rdsidentielle.
f) Tout usage comportant la production, le
stockage ou la livraison d'hydrogene en
vrac permis par le paragraphe 12.8(1) doit
faire I'objet d'une dvaluation des risques
conforme au paragraphe 12.8(4). Il est
entendu que la production d'hydrogene et
les entrepots d'hydrogene en vrac sont
gdndralement considerds comme des
usages d'industrie lourde — dldments
volatils.
(g) A Timber Processing Facility is permitted
provided any uses involving the milling, g)
planing, or shaping of wood are contained
within a building. The storage of
woodchips must be contained within a
building.
12.8(4) Risk Assessment
(a) The Development Officer shall require a
risk assessment as part of a Development
Permit or Building Permit application for a

12.8(4) Evaluation des risques
a) L'agent d'amdnagement doit exiger la
rdalisation d'une dvaluation des risques
dans le cadre d'une demande de permis

(i) which, as per the "volatile industrial use"
definition, involves the use,
manufacturing, storage, or transportation
of chemicals and materials which may be
harmful or detrimental to a person's
health or property; and
(ii) which relate to the following uses:
• Bulk Fuel Storage Depot;
• Bulk Hydrogen Storage Depot; or
• Hydrogen Manufacturing.
(b) The Development Officer may require a
risk assessment as part of Development
Permit or Building Permit application for
any Industrial Use involving a
manufacturing process which could be
hazardous or injurious to a person's health,
prejudices the character of the surrounding
area, or interferes with the normal
enjoyment of land, buildings or structures.
(c) The Risk Assessment shall:
(i) be prepared by a qualified professional
who specializes in risk assessment;
(ii) be prepared to the satisfaction of the
Development Officer and the Fire Chief or
Director of Saint John Emergency
Management Organization;
(iii) include a site plan identifying the
location of all uses and the distances from
the closest residentially zoned properties;
and
(iv) include mitigation recommendations.
(d) The Development Officer shall:
(i) consider the recommendation of the risk
assessment prior to rendering a decision on
a Development Permit or Building Permit
application; and
(ii) in consultation with the appropriate
City Service Areas, may impose any
conditions on the Development Permit or
Building Permit necessary to implement
any of the mitigation recommendations
identified in the risk assessment.
12.8(5) Zone Standards
(a) Minimum Lot Area
For a Volatile Heavy Industrial Use:
10,000 square metres
For an Industrial Use: 4,000 square metres
Other Uses: 4,000 square metres

prejudiciable a la sante d'une personae, de
nuire au caractere du voisinage ou de nuire
A la jouissance normale des terrains, des
batiments et des constructions.
c) L'dvaluation des risques :
(i) est realisee par un professionnel

the Commercial zone requirement of a tree
or shrub per 45 square metres of required
front yard, provided 50% of the plantings
are trees.
