City/Developer Subdivision Agreements to ensure the provision of the required
work and facilities associated with the extension of Jennifer Street.

Renewal of Equinix Data Centre Contract, the City enter into the contract titled
identified as Agreement 246111 and the corresponding Order Form with Equinix
both in the form as attached to M&C 2025-237, for Data Centre Hosting Service, and that
the Mayor and Clerk be authorized to execute the said Universal Terms and Order Form,
and any other documents necessary to facilitate the purchase of the service.
5.6 RESOLVED that as recommended in the submitted report M&C 2025-232: Eastern
WWTF Emergency Rotary Press Channel Purchase, Common Council approve the
allocation of capital reserve funding of $675,096 to the 2025 Utility Fund Capital Reserve
for the purchase of twelve Rotary Press CVH Channels for the Fournier Press at the
Eastern Wastewater Treatment Facility from Fournier Industries Inc. in the amount of
$675,096.00 CAD including tax.
5.7 RESOLVED that the correspondence from A. Andrade re: Enhancing Christmas
Tree Display at City Hall be received for information.

Consideration was given to the submitted report M&C 2025-224: Sydney Street (Broad to
St. James) - Traffic By-Law Amendment. Staff recommend that the Saint John Traffic By-
Law be amended to convert Sydney Street into a one-way street northerly from Broad
Street to St. James Street. This change will support angled street parking to be
implemented along the to be built Central Peninsula School and to connect a new bike
lane from Broad Street to along Sydney as part of the Sydney Street (Broad to St. James
Street) Water, Sanitary and Storm Sewer and Street Reconstruction Project.

of Canadian Municipalities as attached to M&C 2025-235, for the purpose of the City
receiving funding and that the Mayor and Clerk be authorized to sign said Agreement and

EXECUTIVE SUMMARY
Data collected pertaining to Housing for All initiatives will be used to demonstrate
progress, identify emerging trends, and inform decision making.
The infographic includes concise, accessible data and updates. By providing a regular
snapshot, Council will be better equipped to monitor progress, identify areas of need, and
support coordinated efforts with community partners.

Through the Unsheltered Homelessness and Encampment Initiative (UHEI),The City is
receiving $3.4M in Federal funding via the Provincial Government to deliver its Housing
for All Strategy. Key deliverables of the plan involve providing new temporary
transitional housing called Green Zones, an enhanced OutreachTeam tosupport
unhoused individuals and relocation out of high risk, unsafe locations.

RECOMMENDATION

Act.
EXECUTIVE SUMMARY
Uptown Saint John Inc. submitted the proposed 2026Business Improvement Area
(BIA) review. The budget maintains the current BIA levy rate
of16 cents for each one hundred dollars of assessed value on non-residential
property within the designated area.
Common Councilthe corresponding amendment
to the BIA By-Law are necessary steps to enact the 2026 levy rate.
REPORT
A Business Improvement Area (BIA)is a defined geographic area within a
municipalitywhere businesses and commercial property ownerscollaborate
through a formal association. This partnership enables the organization, financing,
and execution of physical improvementsand economic development initiatives to
enhance the areas vitality.
Businesseslocated within the BIA boundaries become members and contribute to
the BIA levy, which is incorporated into their property taxes. This levy provides a
activities.
The BIA By-Law designatesthe specific propertieswithin the BIA, while the BIA
Levy By-Lawsets the levy rate to fund the annual budget.

assessed value.
The funds raised through this levy are administered by Uptown Saint John Inc. and
directed toward marketing, advocacy, beautification, and other initiatives
designed to stimulate business growth within the BIA.

At its Annual Budget meeting on October 9, 2025
Directors and membership approved a proposed 2026 budget totaling
$539,173.92, with the levy rate maintained at 16 cents per $100 of assessed value
on non-residential property with the BIA.
Approval Process
The Business Improvement Areas Act outlines the following process for budget
approval and levy enactment:
Uptown Saint John Inc. develops and approves a budget for the upcoming
calendar year.
The approved BIA budget is submitted to Common Council for
consideration.
Council signals its intent to approve the budget and instructs the Clerk to
publish a public notice.
Non-residential users within the BIA are given a period to submit written
objections to the budget.
Council formally approves the budget and amends the BIA Levy By-Law to
establish the levy rate.
The Minister of Local Government reviews and approves the By-Law
Amendment, facilitating the transfer of levy funds to Uptown Saint John
Inc.
Once Council has signaled its intent to approve the BIA budget, the Clerk prepares
a public notice detailing:
BIA budget.
The levy rate required to support the budget.
The timeframe for submitting written objections.
Written objections from at least on-third of non-residential users, or those
representing one-third or more of the total levy amount, will prevent Council from
approving the budget.

Next Steps
It is recommended that Council indicate its intention to approve the 2026 BIA
budget and direct the Clerk to publish the required notices in the local newspaper,

and on the City website, for the weeks commencing October 20 and October

27, 2025.
BIA budget approval and first and second reading of the BIA Levy By-Law

amendment will be scheduled for the November 17, 2025, Council meeting. The
third and final reading would be scheduled for the next available meeting.

RECOMMENDATION
It is recommended that Common Council adopt the attached resolution
appointing Emmanuel Babatundeas a by-law enforcement officer for various City
By-laws.
EXECUTIVE SUMMARY
The purpose of this report is to designate Emmanuel Babatunde, Assistant
Building Inspector, as a by-law enforcement officer for the various by-laws which
are enforced by the Growth and Community Services department.
In doing so, Mr. Babatundewill be authorized to:
Issue Orders to Comply and Notices to Comply with respect to
enforcement of by-laws that fall within the scope of the Local Governance
Act, the Community Planning Act and the Building Code Administration Act;
Lay informations in Provincial Court with respect to enforcement of by-
laws that fall within the scope of the Local Governance Act, the Community
Planning Act and the Building Code Administration Act; and
Conduct inspections pertaining to enforcement of by-laws that fall within
the scope of the Local Governance Act,the Community Planning Act and
the Building Code Administration Act.

REPORT
Emmanuel Babatunde has been hired as an Assistant Building Inspector for a
period of up to 18 months and will be primarily focused on the Permitting and
Inspection Program with a secondary focus on the Community Standards Program.
In his role, he will be responsible for ensuring that approved building and
development permits meet the requirements of the Saint John Building By-law
and Zoning By-law. When needed, he will also assist with inspections of vacant
and dangerous buildings and structures, unsightly premises and conditions of
minimum standards for occupancy in tenancy residential buildings.
It is necessary to designate Mr. Babatunde as a by-law enforcement officer by
adopting the attached resolution so that he may carry out his duties. By adopting
the attached resolution, Mr. Babatunde will be authorized as a by-law
enforcement officer under the Building By-law, the Zoning By-law, the Saint John
Unsightly Premises and Dangerous Buildings Structures By-law, and the Minimum
Property Standards By-law.

RESOLVED, that as recommended by the Chief Administrative Officer, the following
resolution be adopted:
1. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, and
Local Governance ActSaint John
Minimum Property Standards By-law, By-law Number M-14, and amendments
Saint John Minimum Property Standards By-law, and it may from
time to time be necessary to commence proceedings in the Provincial Court of the
Province of New Brunswick, when a person has violated or failed to comply with
the said By-law;
AND WHEREAS section 72 of the Local Governance Act provides that a
council may appoint by-law enforcement officers for the local government
and may determine their terms of office;
AND WHEREAS subsection 25(1) of the Saint John Minimum Property
Standards By-law provides that a by-law enforcement officer appointed by
council may notify the owner or occupier of premises, dwelling, dwelling
unit or structure by issuing an Order where the condition of the premises,
dwelling, dwelling unit or structure does not comply with said By-law;
AND WHEREAS subsection 150(1) of the Local Governance Act provides
that proceedings for breach of a by-law shall be commenced in the name
of the clerk of the local government or such other person as is designated
for that purpose by the council;
NOW THEREFORE BE IT RESOLVED, that Emmanuel Babatundeis
hereby appointed as a by-law enforcement officer with respect to
the enforcement of the Saint John Minimum Property Standards
By-law, effective immediately, and this appointment shall continue
until they cease to be an employee of the Growth and Community
Services department of The City of Saint John or until it is rescinded
by Common Council, whichever comes first;
AND BE IT FURTHER RESOLVED, that Emmanuel Babatunde is
hereby appointed and authorized to notify owners and occupiers
where the condition of the premises, dwellings, dwelling units or
structures does not comply with the Saint John Minimum Property
Standards By-law, effective immediately, and this appointment and
authorization shall continue until they cease to be an employee of
the Growth and Community Services department of The City of
Saint John or until it is rescinded by Common Council, whichever
comes first;

AND BE IT FURTHER RESOLVED, that Emmanuel Babatunde is
hereby designated and authorized to lay informations in the
Provincial Court of the Province of New Brunswick for breach of the

immediately, and this designation and authorization shall continue
until they cease to be an employee of the Growth and Community
Services department of The City of Saint John or until it is rescinded
by Common Council, whichever comes first.

law enforcement officer, is hereby appointed as an inspection
officer and authorized to enter at all reasonable times upon any
property within the territorial boundaries of the City of Saint John
for the purpose of making any inspection that is necessary for the
administration and enforcement of the Saint John Minimum
Property Standards By- law which received first and second reading
by Common Council on September 10, 2018 and third reading on
September 24, 2018, being enacted upon approval by the Minister
of Local Government, and/or the Local Governance Act effective
immediately, and this authorization shall continue until they cease
to be an employee of the Growth and Community Services
department of The City of Saint John or until rescinded by Common
Council, whichever comes first.

Structures By-law, effective immediately, and this appointment

5. WHEREAS subsection 135(4) of the Local Governance Act, S.N.B. 2017 c.18, and
amendments thereto, provides that within thirty days after the terms of a notice
have been complied with or a debt due to a local government or due to the
Minister of Finance, as the case may be, is discharged, the local government shall
provide a certificate in the form prescribed by regulation which requires that the
corporate seal of the local government be affixed;
NOW THEREFORE BE IT RESOLVED, that Jonathan A. Taylor, City Clerk, is
hereby authorized to affix the corporate seal of The City of Saint John to a
Certificate of Discharge that is issued by Emmanuel Babatunde under the
Saint John Unsightly Premises and Dangerous Buildings and Structures By-
law, and such authorization shall continue until Jonathan A. Taylor ceases
to be the City Clerk of The City of Saint John or until it is rescinded by
Common Council, whichever comes first.
6. WHEREAS, the Common Council of The City of Saint John has enacted certain
bylaws pursuant to the authority of the Community Planning Act, S.N.B 2017, c.
Community Planning Act including The
Zoning By-law, By-law Number C.P. 110, including all amendments thereto, and it
may from time to time be necessary to commence proceedings in the Provincial
Court of the Province of New Brunswick, when a person has contravened or failed
to comply with these By-laws;
AND WHEREAS paragraph 137(a) of the Community Planning Act provides
that no person shall violate or fail to comply with a provision of a by-law
made under this Act;
AND WHEREAS section 139 of the Community Planning Act provides that
proceedings for an offence under this Act shall be commenced in the name
of the Minister or the clerk of the local government or any other person
who is designated for that purpose by the council;
NOW THEREFORE BE IT RESOLVED, that Emmanuel Babatunde is
hereby designated and authorized to lay informations in the
Provincial Court of the Province of New Brunswick for breach of The
Zoning By-law, effective immediately, and this appointment and
authorization shall continue until they cease to be an employee of
the Growth and Community Services department of The City of
Saint John or until it is rescinded by Common Council, whichever
comes first.

7. WHEREAS the Common Council of The City of Saint John has enacted a by-law
pursuant to the authority of the Building Code Administration Act, S.N.B. 2020, c.

and enforcement of this By-law;
NOW THEREFORE BE IT RESOLVED, that Emmanuel Babatunde is hereby
appointed as a city inspector, effective immediately, and this appointment
shall continue until they cease to be an employee of the Growth and
Community Services department of The City of Saint John or until
rescinded by Common Council, whichever comes first.
8. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Building Code Administration Act, S.N.B
2020, c. 8 Building Code Administration Act
including the Building By-law, By-law Number BC-1, and amendments thereto, and
it may from time to time be necessary to make orders for the administration of
these By-laws;
AND WHEREAS subsection 134(1) of the Building Code Administration Act
provides that a council may authorize persons to, when a development is
undertaken in violation of the Building Code Administration Act, a by-law
or regulation under the Building Code Administration Act, a by-law or
terms and conditions imposed on the development, order the cessation of
the development, alteration of such development so as to remove the
violation, or the doing of anything required to restore the land, building or
structure to its condition immediately prior to the undertaking of such
development;
NOW THEREFORE BE IT RESOLVED, that Emmanuel Babatunde is
hereby authorized to, when a development is undertaken in
violation of the Building Code Administration Act, the Building By-
law or the terms and conditions imposed on the development,
order the cessation of the development, alteration of such
development so as to remove the violation, or the doing of
anything required to restore the land, building or structure to its
condition immediately prior to the undertaking of such
development, effective immediately, and this authorization shall
continue until they cease to be an employee of Growth and
Community Services of The City of Saint John or until rescinded by
Common Council, whichever comes first.

RESOLVED, that as recommended by the Chief Administrative Officer, the following
resolution be adopted:
1. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, and
Local Governance ActA By-law Respecting
the Regulation of Parking in The City of Saint John, By-law Number LG-8 Saint
John Parking By-Law, A By-law Respecting the Traffic on Streets in The City of
Saint John, By-law Number MV-10.1 Saint John Traffic By-Law and all
amendments thereto;
AND WHEREAS section 72 of the Local Governance Act provides that a
council may appoint by-law enforcement officers for the local government
and may determine their terms of office;
NOW THEREFORE BE IT RESOLVED, that Everett Leblanc is hereby
appointed as by-law enforcement officer with respect to the
enforcement of the Saint John Parking By-Law and Saint John
Traffic By-Law, effective immediately, and this appointment shall
continue until they cease to be an employee of the Parking
department of The City of Saint John or until it is rescinded by
Common Council, whichever comes first;

RECOMMENDATION
It is recommended that Common Council adopt the attached resolution
appointingBradleyEckertas Plumbing Inspectorfor enforcement of the Saint John
Plumbing By-lawand as By-law Enforcement Officer for enforcement of the Saint
John Water and Sewerage By-law.
EXECUTIVE SUMMARY
The purpose of this report is to designate Bradley Eckert,as PlumbingInspector
and as a By-law Enforcement Officer for the City of Saint John.
In doing so, Mr. Eckertwill be authorized to:
Conduct plumbing inspections and issue permits in accordance with the
{ğźƓƷ WƚŷƓ tƌǒƒĬźƓŭ .ǤΏƌğǞ.
Revoke or reinstate plumbing permits as necessary when enforcement
actions are required due to violations.
Issue written orders requiring the correction of violations under the ğƷĻƩ
ğƓķ {ĻǞĻƩğŭĻ .ǤΏƌğǞ, and take appropriate action if those violations are
not remedied.
Issue notices of penalty andlay informationsin the Provincial Court of New
Brunswick for breaches of the Water and Sewerage By-law.

REPORT
Bradley Eckert is a licensed plumber who serves as a shared resource between
Growth and Community Services and Saint John Water. He will be responsible for
supporting the Plumbing Inspection Program by issuing permits and conducting
inspections to ensure that all plumbing work performed within the City of Saint
John complies with the requirements of the Saint John Plumbing By-law and the
National Plumbing Code.
In addition, Mr. Eckert will support the Backflow Prevention Program by verifying
that all backflow prevention devices are properly installed and functional, thereby
To enable Mr. Eckert to carry out these duties, it is necessary to designate him as

1. WHEREAS the Common Council of The City of Saint John has enacted certain by-
laws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, and

John Water & Sewerage By-law, and it may from time to time be necessary to
commence proceedings in the Provincial Court of the Province of New Brunswick,
when a person has violated or failed to comply with the said By-law;
AND WHEREAS section 72 of the Local Governance Act provides that a
council may appoint by-law enforcement officers for the local government
and may determine their terms of office;
AND WHEREAS subsection 150(1) of the Local Governance Act provides
that proceedings for breach of a by-law shall be commenced in the name
of the clerk of the local government or such other person as is designated
for that purpose by the council;
NOW THEREFORE BE IT RESOLVED, that Bradley Eckert is hereby
appointed as a by-law enforcement officer with respect to the
enforcement of the Saint John Water & Sewerage By-law, effective
immediately, and this appointment shall continue until he ceases
to be an employee of The City of Saint John or until it is rescinded
by Common Council, whichever comes first;
AND BE IT FURTHER RESOLVED, that Bradley Eckert is hereby
designated and authorized to lay informations in the Provincial
Court of the Province of New Brunswick for breach of the Saint John
Water & Sewerage By-law, effective immediately, and this
designation and authorization shall continue until they cease to be
an employee of The City of Saint John or until it is rescinded by
Common Council, whichever comes first.
2. WHEREAS all work done to a plumbing system in the Province of New
Brunswick, must conform to the standards prescribed by the Plumbing
Installation and Inspection Act, SNB 2014, c 126 and associated regulations
AND WHEREAS section 9 of the Plumbing Installation and Inspection Act
provides that a local government may by by-law regulate and control any
act or thing which is not already regulated and controlled by said Act and
regulations, provide for the appointment of local government plumbing
inspectors and the prescribing of their duties;

EXECUTIVE SUMMARY
The Flash Ice SalesProgram allows unclaimed available ice timeto be sold at a discounted rate.
These ice times are onlyavailable after the seasonal allocation process is completed for regular
arena users.
The program offers one-hour bookings over a 2-week period on a first comebasis. Notice of
available ice time is communicated as identified,inviting booking requests to be submitted.
Administered by Community Services staff, the program aims to maximize the use of available
ice time at City arenaswhile alsogeneratingadditional revenue.

REPORT
In the summer of July 2024,Common Council adopted the Recreation Investment Policy which
governs how rate adjustments are calculated for sport amenities. The policyallowsfor practical
adjustments on pricingwithoutimpeding on the integrity of the policy.
During the 2024/2025 ice arenas season, Community Servicesstaff piloted a Flash Ice Sale
Program with seasonal ice users. Starting in November 2024,a two-week period of available ice
timewassent to users to purchaseavailable one-hour time slots offered at a discounted rate.
These Flash Ice sales were offered four timesduring the season. This resulted inan additional
eighteen one-hourbookings and approximately $1,700 in additional revenue.
Building on the success of last season, the Flash Ice Sales Program hasexpanded to offer to the
general publicfor the 2025/2026 season.Noticewill be sent out on biweeklybasisin the form
of a public service announcement on the Citywebsite and Facebook page (Attachment A-
External Public Service Announcement). Only ice times within theadvertised two-week
windows areeligible for discountand bookings will be accepted on a first-comebasis. All
required insurance coverage must be inplace before any booking is confirmed. If a group does
not currently hold the necessary coverage, the group has the option to obtain coveragethrough
Opening the Flash Ice Sales tothe publicgreatlyexpands the reach of the program, maximizes
the use of available ice time at City arenas and will generate additional revenue.
The first Flash Ice Sales for this season wasdistributed on Wednesday, October 1, with17
bookings confirmedgenerating $1,675.68in revenue. These bookings were 41% from seasonal
users and 59% from the public.

Background Information:
On September 25, 2025, Minister Joel Lightbound announced major changesto
Canada Post's model of public service, which includes ending daily door to door
delivery. Minister Lightbound wants Canada Post to install community mailboxes, with
mail delivery two or three times per week. Saint John does have community mailboxes,
however, a large portion of the city's mail is delivered to the door. Community mailboxes
would be installed for thousands of residents of Saint John, decreasing mail service,
property values, and jobs.

Purpose for submission (what is the ask of council):
To prohibit the use of off-road vehicles within municipal parks.
Executive summary
I requested that the Office of the City Clerk search the bylaws of the City of Saint John
for a bylaw that deals with the use of off-road vehicles within the municipal parks of
Saint John, NB. The office did search and was unable to find such a bylaw.
The Off-Road Vehicle Act of NB addresses provincial parks but not municipal parks. As
Past President of the Little River Reservoir Association and as a proponent of our
municipal parks I feel it pertinent to either identify an existing bylaw that deals with this
issue or see to it that one is created.

Investments Ltd. and are recommending that the City enter into this Agreement of Purchase and
Sale.

with the sale or the reimbursement for environmental remediation in accordance with
section 2.4 of the Agreement of Purchase and Sale, be deposited into the General Fund
