Cormier for 9 Austin Lane (part of PID: 00403972) for Tuesday, September 3, 2024, at nd 6:30 p.m. at the Council Chamber, City Hall 2 floor, 15 Market Square, Saint John, NB. 5.4 RESOLVED that the submitted report M&C 2024-211: 2024 Menahqesk (Saint John) Powwow Sponsorship Package be received for information. 5.5 RESOLVED that as recommended in the submitted report M&C 2024-198: Designation of By-Law Enforcement Officer Mitchell McNeil, Common Council adopt the following: WHEREAS the Common Council of The City of Saint John has enacted certain bylaws pursuant to the authority of the Local Governance Act, S.N.B. 2017 c.18, and amendments -law Respecting the Regulation of Parking in The City of Saint John, By-law Number LG-- A By-law Respecting the Traffic on Streets in The City of Saint John, By-law Number MV- -and WHEREAS section 72 of the Local Governance Act provides that a council may appoint by-law enforcement officers for the local government and may determine their terms of office; NOW THEREFORE BE IT RESOLVED that Mitchell McNeil is hereby appointed as by- law enforcement officer with respect to the enforcement of the Saint John Parking By-Law and Saint John Traffic By-Law, effective immediately, and this appointment shall continue until they cease to be an employee of the Parking department of The City of Saint John or until it is rescinded by Common Council, whichever comes first. 5.6 RESOLVED that as recommended in the submitted report M&C 2024-208: Capital Budget Analysis for Overall Fundy Quay, Market Slip & Harbour Passage and Sea Wall Refurbishment Project, 1. Council approve reallocating $80,000.00 of funding from the Visart Street Storm Sewer project (21TC23) to the Market Slip & Harbour Passage Extension project to offset a portion of the projected budget variance as outlined in this report, 2. Council approve reallocating $200,000.00 of funding from the Engineering Investigation & Design services project (21TC02) to the Market Slip & Harbour Passage Extension project to offset a portion of the projected budget variance as outlined in this report, 3. Council approve reallocating $140,000.00 of funding from the Germain Street project (23TC43) to the Market Slip & Harbour Passage Extension project to offset a portion of the projected budget variance as outlined in this report, 3 COMMON COUNCIL / CONSEIL COMMUNAL August 19, 2024 / le 19 août 2024 4. Council approve reallocating $45,000.00 of funding from the Rockwood Park Lift Station project (23UC34) to the Market Slip & Harbour Passage Extension project to offset a portion of the projected budget variance as outlined in this report, 5. Council approve reallocating $120,600 of funding from Market Square Pneumatic Controls project (23UC19) to the Market Slip & Harbour Passage Extension project to offset a portion of the projected budget variance as outlined in this report, 6. Council approve allocating $714,400 of funding to the Market Slip & Harbour Passage Extension project from an already approved Council recommendation as part of M&C 2023-098 to transfer up to two million dollars from the General Fund Capital Reserve to 2023 General Fund Capital projects requiring additional funding, 7. Council approve the value of Contract 2022-081201T Public Space at Market Slip & Harbour Passage Extension previously awarded to Maxim Construction Inc. on August nd 22, 2022, be increased from $16,283,793.18 (Including HST) to $18,277,301.70 (Including HST) as outlined in this report and, 8. The value of Contract 2021-094501P Architectural Services: Loyalist Plaza and Fundy Quay Harbour Passage Extension previously awarded to Glenn Group on February nd 22, 2021, be increased from $2,118,010.20 (Including HST) to $2,403,010.20 (Including HST) as outlined in this report. 5.7 RESOLVED that as recommended in the submitted report M&C 2024-213: Contract 2024-05: Sussex Drive (Technology Drive to Millidge Avenue) and Shamrock Park Storm Sewer Installation, (A) Council approve the addition of $335,000 of unallocated funding within the Canada Community Building Fund Program (2019-2023) to be allocated to the 2024 General Fund Capital Program to address the projected shortfall on the Sussex Drive (Technology to Millidge Avenue) and Shamrock Park Storm Sewer Installation project; and, (B) Contract No. 2024-05: Sussex Drive (Technology Drive to Millidge Avenue) and Shamrock Park Storm Sewer Installation be awarded to the low tenderer, Fairville Construction Ltd., at their tendered price of $1,301,414.75 (including HST) as calculated based on estimated quantities, and further that the Mayor and City Clerk be authorized to execute the necessary contract documents. 5.8 RESOLVED that as recommended in the submitted report M&C 2024-213: Proposed Public Hearing Dates for 461-475 Millidge Avenue and 665-669 Loch Lomond Road and 0 Commerce Drive, Common Council schedule a public hearing for the Zoning By-Law Amendment and Section 59 Application submitted by Brad Kierstead c/o Don- More Surveys for 473-475 Millidge Avenue, 471 Millidge Avenue, and 461 Millidge Avenue (PIDs 55147797, 00041525, 00041517); and schedule a public hearing for the Zoning By- Law Amendment and Section 59 Application submitted by Amerco Real Estate Company for 665 Loch Lomond Road, 669 Loch Lomond Road, and 0 Commerce Drive (PIDs 55102917, 55102925, and 00313155 (portion) for Tuesday, October 1, 2024 at 6:30 p.m. nd in Council Chamber, City Hall 2 floor, 15 Market Square. 5.9 RESOLVED that as recommended in the submitted report M&C 2024-218: Contract 2024-15: Spruce Lake Water Transmission Main Screen Building Bypass, the contract be awarded to the low tenderer, Fairville Construction Ltd., at the tendered price of $725,017.50 (including HST) as calculated based upon estimated quantities; and further that the Mayor and City Clerk be authorized to execute the necessary contract documents. 4 COMMON COUNCIL / CONSEIL COMMUNAL August 19, 2024 / le 19 août 2024 5.10 RESOLVED that the Council Community Fund application submitted by Deputy Mayor MacKenzie for the Crescent Valley Resource Centre for $500.00 be approved. Public Hearings 6:30 p.m. Councillor Killen withdrew from the meeting during the Public Hearing for item 9.1. 9.1 Proposed Zoning By-Law Amendment with Planning Advisory Committee report and Staff Presentation - 199-201 Union Street (1st and 2nd Reading) Director McKiel introduced the proposed amendment to the Zoning By-Law located at 199- 201 Union Street -Law, land having an area of approximately 1005 square metres, also identified as PID No. 55108997, from Ground Floor Use to permit a ground floor residential use. Planner Y. Matson introduced the text amendment to the proposed by-law. Mayor Noade Reardon called the Public Hearing to order. The Mayor called for members of the public to speak against the proposed amendment with the following presenting: Nancy Tissington Executive Director Uptown Saint John noting the potential impact to existing businesses including the Union Street corridor and stating the need for commercial activity in the uptown ground floor space to promote uptown development. The Mayor called for members of the public to speak in favour of the proposed amendment with no one presenting. Mayor Noade Reardon closed the public hearing. Councillor Killen re-entered, joining the meeting virtually. 9.2 Proposed Zoning By-Law Amendment with Planning Advisory Committee report and Staff Presentation - 3277 Westfield Road (1st and 2nd Reading) Director McKiel introduced the proposed amendment to the Zoning By-Law located at 3277 Westfield Road to rezone a piece of land having an area of approximately 3,471 square metres (PID 00295048) from Rural Settlement (RS) to Neighbourhood Community Facility (CFN) to align the zoning of the existing special care facility with an appropriate zone. Mayor Noade Reardon called the Public Hearing to order. The Mayor called for members of the public to speak against the proposed amendment with no one presenting. Read a third time by title, the by--Law No. MV-10.1 A By-Law to Amend a By-Law respecting the Traffic on Streets in The City of Saint John and amendments 10.3 Proposed Municipal Plan Amendment Spruce Lake Industrial Park Expansion The City Clerk read the Public Notice into the record and advised that the 30-day public notice timeline has lapsed. All letters received have been added to the agenda. Council may refer the matter to PAC for review and proceed with a Public Hearing or deny the referral to PAC and not proceed with a Public Hearing. Senior Planner Mark Reade commented on the input heard from the Lorneville community at the Public Open House in July concerning the expansion, and the proposed next steps to refer the community feedback to Dillon Consulting Limited for their review and recommendations. The application timeline has been extended by one month to allow the th Dillon Consulting report to be available for the proposed October 8, 2024, PAC meeting th and the November 12, 2024, Council Public Hearing. The Dillon public engagement report and recommendations will be posted on the City website Shape your City section. Business Matters Municipal Officers 12.1 Chief Administrative Officer Update on Select Catalytic Projects and Advocacy (Verbal) The CAO updated Council on the advancement to advocacy projects for affordable housing, and the development of several infrastructure projects, improvements at South End school, North End school, Rainbow Park, Turner-Brewer Memorial Garden, Industrial 10 COMMON COUNCIL / CONSEIL COMMUNAL August 19, 2024 / le 19 août 2024 Parks governance, Comprehensive Recreation Facility, Fundy Quay, Ihtoli-maqahamok The Gathering Place and responded to questions on the full occupancy permits on the Market Square boardwalk. 12.2 Recreation Investment Policy Guidelines Meaghan Carey, Partner RC Strategies presented the recommendations for the Recreation Investment Policy Guidelines. Moved by Councillor Stewart, seconded by Councillor Ogden: RESOLVED that as recommended in the submitted report M&C 2024-219: Recreation Investment Policy Guidelines, Common Council: 1. Adopt the City of Saint John Recreation Subsidy Policy Review, Implementation Plan, and the Recreation Investment Policy as attached to M&C 2024-193; and, 2. Approve and set the City of Saint John Recreation Facility Rates for 2024/2025, 2025/2026 and 2026/2027 as attached to M&C 2024-193. Supplemental Agenda 16.1 Cedar Hill Cemetery Expansion Moved by Councillor Norton, seconded by Councillor Lowe: RESOLVED that the correspondence from Donna Gray re the Cedar Hill Cemetery Expansion be referred to the CAO for a report and recommendation. Committee of the Whole 17.1 Multipurpose Recreational Facility Memorandum of Understanding 11 COMMON COUNCIL / CONSEIL COMMUNAL August 19, 2024 / le 19 août 2024 Commissioner Hugenholtz presented the recommendation for the Multipurpose Recreational Facility Memorandum of Understanding. Moved by Councillor Sullivan, seconded by Councillor Lowe: RESOLVED that as recommended by the Committee of the Whole, having met on August 19, 2024, Common Council approve the following: 1. That the City enter into a Memorandum of Understanding with the Greater Saint John Field House Inc. and the YMCA of South Western New Brunswick Inc. in the form as presented to Committee of the Whole at its meeting held August 19, 2024 for the purpose of exploring the viability and negotiating a contractual arrangement for the construction and operation of a multipurpose facility, and that the Mayor and Clerk be authorized to execute the said Memorandum of Understanding and any documents ancillary thereto; and, 2. That staff be authorized to withdraw up to $3M from reserves to support the further development of this project. MOTION CARRIED. 17.2 Reorganization of Saint John Industrial parks (2024) Ltd. Moved by Councillor Sullivan, seconded by Deputy Mayor MacKenzie: RESOLVED that as recommended by the Committee of the Whole, having met on August 19, 2024, Common Council approve the following: 1. Industrial Parks (2024) Ltd. for $1.00 and that the Mayor and Clerk be authorized to execute any documents necessary to facilitate this transaction; 2. That the Provisional Directors of Saint John Industrial Parks (2024) Ltd., being Chief Administrative Officer, Chief Financial Officer, and General Counsel for the City, be Ltd. to accept t ancillary documents necessary to facilitate the transaction; 3. That Melanie C. There are no finances needed to spend on creating this item however the savings could be substantial for the city if resources of fire and police are decreased. If police and fire could report on how many calls are happening to the site from now on, we could then report accurately if there is security issued from the province in the future to see what that cost savings is alone as a KPI. I have not consulted with Council prior to drawing this up but have shared my concerns in the past on this. Unfortunately, this does nothing to change my mind I am against the rezoning of this area. I was disappointed that this crucial information was not communicated us by the city, given that we, as residents, will be significantly impacted by such a large development. There has also been no attempt by developers to discuss this proposal with the community. Our neighborhood, characterized by its rural landscape of mature trees and river views, is a unique part of Saint John and deserves to be preserved. Many of us chose to live here specifically for its single-family home environment, rather than living in Quispamsis or Rothesay like many of my peers. The proposed site lacks essential amenities and infrastructure like sidewalks, making car ownership a necessity. It is unclear how this development will address the current affordable housing crisis or provide affordable, sustainable options for those in need. Additionally, the traffic impact cannot be overlooked. The area already struggles with heavy traffic from the hospital, university and the ferry, and the recent addition of a daycare on the Cherry Brook Zoo property will only exacerbate the situation. The intersection of Foster traffic circle in the future does nothing to change the number of cars along this route. The absence of sidewalks makes walking and biking dangerous, a problem that additional traffic would only worsen. I am also concerned about the effects of water drainage. Deerwood Place already suffers from excess water runoff, creating hazardous ice conditions in winter, as do other streets in the neighbourhood. The removal of trees crucial for water absorption could worsen this issue. will add to an already existing problem in the area. Rezoning of this area also sets a dangerous precedent, and other available land will be subject to such proposals in the future. This will irrevocably change the area from an attractive rural setting to mix of very high apartment buildings. An unfortunate consequence is that current residents will no doubt see the value of their properties decrease if this project moves forward in its current form. I would consider supporting a development of 3 stories or less provided issues of traffic and drainage are appropriately addressed. However, in its current form I strongly oppose the rezoning of 1750 Sandy Point Road from Two-Unit Dwelling to Mid-Rise Residential. As a long-time resident of Deerwood Place, I believe this development would have detrimental and irreversible effects on our neighborhood. DISCLOSURE: I was born in the North End of Saint John, and grew up in the Millidgeville area. I currently have a stake in the ownership of 1750 Sandy Point Road through Ensemble Holdings Inc. The property has been on the market for the past 8 years. We personally own the adjacent property at 1700 Sandy Point Road, on which we recently built our retirement home. I have read many opinions given for not granting the rezoning, and I welcome this opportunity to offer a rebuttal. TRAFFIC: I agree 100% that the traffic along the section of Sandy Point Road, from the intersection of Foster Thurston Road to the hospital/university entrance is very busy. The majority of this traffic originates from the Kennebecasis Valley, and Kingston Peninsula, via the Millidgeville Ferry. Traffic Study indicated there will be negligible impact on traffic with increased density on this property. We had been unsuccessful to sell property as low density (R2) due to the traffic concerns. Number one comment was that Sandy Point too busy for kids. We purchased our property, at 1700 Sandy Point Road, from a couple who did not want to raise a family on this busy road. To my knowledge there are no children residing on properties directly fronting unto Sandy point Road, in the immediate vicinity of this property. More density will likely fund a future sidewalk along Sandy Point Road. Mid-Rise is more suitable on a collector route, than single family residential. TREES: Regardless of the zoning (R2 or RM), trees on any vacant land are destined to be removed for development. As a nearby example, there is hardly a tree remaining in the Fieldstone Estates development of single-family homes. Most single-family lots are without existing mature trees. Neighbours enjoy trees on adjacent undeveloped land because the landowners choose to leave them until such time the property is ready for development. As the owner of 1750 Sandy Point Road, we are at liberty to clear the site as a R2 Zone, as the land has a subdivision plan that has been granted tentative approval by a development officer. I believe the prospective developers intend to incorporate as many trees as possible. There is 2200 acres of undevelopable, forested lands, great for wildlife, directly across Sandy Point Road. Rockwood Park! STORMWATER: The property is currently an impervious formation of limestone. The stormwater from the vacant property drains to a natural water course below on the river side. A portion of stormwater drainage from Fieldstone Estates, the 4 properties 1810 through 1840 Sandy Point Road, and the runoff from apportion of Sandy Point Road also drain to this same natural water course. Stormwater retention will be required by development, to impede runoff so there is a net-zero increase. We subsequently set a stake at the SW corner of the proposed building and tethered a helium balloon 20 meters (the height of 5 storey building, over an at-grade parking level) above the proposed parking garage floor elevation. (Margin of error 2 meters). The images indicate the height of the SW corner of the proposed building is not towering above the tree tops, as rendered on the neighbourhood website. IN CLOSING: Traffic count from outside our area, to the important Hospital and University facilities in our neighbourhood, cannot be reduced. Tree removal on private properties, is at the discretion of the landowner. Precipitation cannot be controlled, however, we can slow its impact on run-off. Municipalities that prosper, need additional housing. Development is inevitable. Higher density zoning should be encouraged along busier collector roads. We need housing for young professionals and retirees. This proposed development is in my backyard, and I’m OK with it. As a resident of Beaconsfield Avenue, I have personally experienced the effects of this property being used as transitional housing in the past. I have 3 young children who attend Seaside Elementary, and are required to walk to/from daily based on the close proximity between our home and school. I cannot express how uncomfortable I am with the influx of questionable individuals that will be in our neighbourhood (as this happened with the out of cold shelter) while our children are walking to/from school, waiting at bus stops and playing outside with their friends. My children were approached by multiple strangers, some asking for money, others so far under the influence they did not make any sense. My children bore witness to several overdoses and people passed out on sidewalks/roadsides. We experienced multiple break ins throughout that winter season- bicycles, pool toys, our bbq, propane tanks, recyclables were all stolen. We put up cameras and motion lights- those were stolen too! Many public places were no longer able to be enjoyed- playgrounds and soccer fields littered with dirty needles, walking trails deemed unsafe because of multiple encampments (across the street from the Belyea) which left behind garbage, more needles, used pipes, toilet paper and buckets/pails of feces that were left for the community to clean! This new consideration puts my neighbourhood at risk once again. Please think about the open drug use, violence, nudity, crime etc that people will be exposed to with these changes, especially the children who cannot fully understand why someone is doing something. I should not have to explain drug addiction and needle safety to my 7-9 year olds. I would love to see a location used that is close to amenities (walking distance) that these individuals would benefit from. Access to health care, grocery stores, pharmacy would be essential.. With a new daycare centre opening on Lowell Street, the close proximity to 2 different schools, no access to social development services, among many, many other things, the Hilton Belyea Arena seems like an inadequate location to place unhoused people that need to access to amenities and other services. Without the crucial information that we would need to support this decision (Who will be living here, will this site be supervised 24/7, will it illegal substances be allowed on the premises, etc) residents in the surrounding area are struggling to support this motion. I believe we have a right to be included in this process and am hoping to get some direction in regards to where/when we can voice our concerns. Yes About your Submission Topic of submission Safety on Harbour Passage Purpose for submission (what is the ask of council): To introduce rules for the use of electric bikes and scooters on Harbour Passage Executive summary Harbour Passage I am a frequent user of Harbour Passage and consider it one of the gems of our city. However over the past year or so it has become a hazardous place to walk due to the dangers posed by the number of motorized vehicles and in particular the electric bikes and scooters that travel at high speeds without regard for pedestrians. The problem is exacerbated by the rental of e scooters that are often driven by inexperienced riders on machines that can easily exceed 40km/hr. I think it is time to put regulations in place similar to those imposed by other jurisdictions on multi use trails. Typically these include; 1) Restricting the e- 2) A speed limit of say 15-20km/hr. 3) Require the use of an audible device such as a bell 4) Make it clear that pedestrians have right of way 5) Require all bike and scooters users to wear helmets and not use cell phones while riding. Action is required to put rules in place and enforce them before there are more accidents and insurance claims against the city
