To conform to the Government COVID-19 State of Emergency and Mandatory Order Alert
Level Orange requirements, Council Members and senior staff participated by video
conference. The City Clerk conducted roll call of the Council Members to determine
quorum, all were recorded present. To ensure access to the public and transparency of
the meeting, livestreaming on the City's YouTube feed is provided. Rogers TV also
provides the public live streaming of the Council meeting.

5.1 That as recommended by the City Manager in the submitted report entitled
Budget Monitoring Policy Common Council approve the 2021 General Fund Operating
Budget as presented, in order to separate personnel and non -personnel costs in order to
adhere to the Budget Monitoring Policy.
5.2 That as recommended bythe City Manager in the submitted report entitled Award
for Demolition of the Vacant, Dilapidated and Dangerous Building at 149 Broad St (PID
00000604), Common Council award the contract for demolition of the building at 149
Broad Street (PID 0000604) to W&S General Contractors Ltd. for the amount of $98,900
plus HST.
5.3 That as recommended by the City Manager in the submitted report entitled
Contract 2020-24: Greenhead Road Sanitary Lift Station "C" Replacement:
1) Common Council pre -approve the supplemental funding request ($75,705.00) for this
project which will be included in the revised 2021 Water & Sewerage Utility Fund Capital
Program which is expected to be before Common Council in the first quarter of 2021; and
2) Common Council approve Contract No. 2020-24: Greenhead Road Sanitary Lift Station
"C" Replacement be awarded to the low Tenderer, Fairville Construction Ltd., at the

tendered price of $482,655.00 (including HST) based upon estimated quantities; and
further that the Mayor and Common Clerk be authorized to execute the necessary
contract documents.
5.4 That as recommended by the City Manager in the submitted report entitled
Cancellation of Public Hearing for Street Closure for Portion of Proud Road, Common
Council cancel the Public Hearing set for December 7, 2020 to consider the passing of a
By-law to Stop -Up and close a 26,820 square metre portion of a public street, known as
Proud Road.
5.5 That as recommended by the City Manager in the submitted report entitled
Proposed Public Hearing Date — 154 Waterloo Street, 19 Paddock Street, and 144
Landsdowne Avenue, Common Council schedule the public hearings for the rezoning
applications of Coverdale Centre for Women Inc. (154 Waterloo Street), Resonance Inc.
(19 Paddock Street) and Dr. Tunde Apantaku (144 Lansdowne Avenue) for Monday
January 11, 2021 at 6:30 p.m. to occur in Council Chambers with a remote participation
option.

Referring to the submitted report entitled Business Improvement Area 2021 Budget the
Clerk advised that the budget has been advertised in the newspaper and no written
objections were received. Council may proceed with approving the budget and amending
the BIA bylaw for 2021.

10.2 By -Law Amendments for Development Fees Adjustments (1st and 2nd Reading)
Referring to the submitted report entitled Bylaw Amendments for Development Fees
Adjustments Director A. Poffenroth introduced 5 bylaw amendments in support of the
City's Sustainability Plan that will generate additional revenue from development fees
incorporating existing fees and news fees. The bylaw amendments affect the following:
• Building Bylaw
• Plumbing Bylaw
• Water & Sewerage Bylaw
• Subdivision Bylaw
• Excavation of Streets Bylaw
Once approved the bylaws will come into effect January 1st, 2021.

The City Manager updated Council on 3 items:
• The COVID-19 pandemic remains at Orange Alert Level. All City services continue
with minor adjustments to programs in Parks and Recreation

• The Cyber-attack is being addressed deliberately and cautiously. Full network
functionality is expected early in 2021.
• Recent rain events in the City caused flooding in some areas and roads were
barricaded. The public is urged to be cautious and to respect the road barricades.

12.2 Demolition of Vacant, Dilapidated and Dangerous Building at 403 Dufferin Row
(PID 55098040)
Referring to the submitted report entitled Demolition of Vacant, Dilapidated and
Dangerous Building at 403 Dufferin Row (PID 55098040) Planner B. Purington illustrated
the state of the building.
The Mayor advised that any member of the public with an interest in the property had an
opportunity to register and present evidence that the building is structurally sound,
advising that no one registered to present. The Mayor read the cautionary demolition
statement as follows:
"The information which has been provided in the Council Kit includes the report of the
Building Inspector stating that the building located at 403 Dufferin Row (PID 55098040) is
a hazard to the safety of the public by virtue of its being amongst other things, dilapidated
or structurally unsound. Is there present an owner, including anyone holding any
encumbrance upon this property, who wishes to present evidence to the contrary, i.e.
that the building is structurally sound and not dilapidated?"
No one registered to come forward to present evidence.
Moved by Councillor MacKenzie, seconded by Councillor Norton:
RESOLVED that as recommended by the City Manager in the submitted report entitled
Demolition of Vacant, Dilapidated and Dangerous Building at 403 Dufferin Row (PID
550980401 the building located at 403 Dufferin Row, PID# 55098040, is to be demolished
as it has become a hazard to the safety of the public by reason of dilapidation; and
BE IT FURTHER RESOLVED that one or more by-law enforcement officers appointed and
designated under the Saint John Unsightly Premises and Dangerous Buildings and
Structures By-law are hereby authorized to arrange forthe demolition, in accordance with
the applicable City purchasing policies.

12.3 2021 Utility Fund Operating Budget
12.3.1 Water and Sewerage Bylaw Amendment — Schedules "A" and "B" and "C" (15t and

12.3.2 Water and Sewerage Bvlaw Amendment — Schedules "E" Ust and 2" Reading)
Referring to the submitted report entitled 2021 Utility Fund Operating Budget
Commissioner McGovern stated the utility is facing pressure in shrinking revenues.
• Flat -rate customers continue to decline
• Closure of Saputo revenue loss is $225k/year
• Impacts of reduced meter revenue due to COVID-19 will likely continue into 2021
• Industrial water rates are implemented by bylaw; revenue required for 2021 is
budgeted at $5,981,751
Rate stabilization will continue to be challenging.

RESOLVED that as recommended by the City Manager in the submitted report 2021 Utility
Fund Operating Budget Common Council approve the following:
1. RESOLVED that the estimated revenue for the Water and Sewerage Utility for the year
2021 in the amount of $47,922,000 be adopted (Appendix "A")
2. RESOLVED that the estimate of expenses for the Water and Sewerage Utility for the
year 2021 in the amount of $47,922,000 be approved (Appendix "A").

Infrastructure

RESOLVED that as recommended by the Committee of the Whole having met on
December 71", 2020 Common Council approve that the City enter into the Form of Project
Agreement Accession and Termination Agreement between Brookfield (PCWP) Inc., Mazu
(PCWP) LP and Port City Water Partners, relating to the Safe Clean Drinking Water Project,
and that the Mayor and City Clerk be authorized to execute the agreement.

complete du reseau est prevue pour le debut de 2021.
• Les recentes averses de pluie sur la ville ont provoque des inondations clans
certaines zones et les routes ont ete bloquees. Le public est invite a faire preuve
de prudence et a respecter les blocages routiers.

Dangerous Building at 403 Dufferin Row (PID 55098040) (PID 55098040), l'urbaniste B.
Purington a illustre 1'etat du batiment.
Le maire a indique que tout membre du public ayant un interet clans la propriete avait la
possibilite de s'inscrire et de presenter des elements de preuve attestant que la structure
du batiment est solide, et a precise que personne ne s'etait inscrit. Le maire a lu
l'avertissement de demolition comme suit :
« Les informations fournies clans le cadre de la trousse du conseil comprennent le rapport
de l'inspecteur des batiments indiquant que le batiment situe au 403 Dufferin Row
(PID 55098040) presente un risque pour la securite publique en raison, entre autres, de
son etat de delabrement ou de sa structure instable. Y a-t-il un proprietaire present,
notamment une personne detenant une charge sur cette propriete, qui souhaite
presenter la preuve du contraire, c'est-a-dire que le batiment est structurellement solide
et non delabre ? »
Personne ne s'est inscrit pour presenter des elements de preuve.
