RECOMMENDATION
That Common Council cancel the public hearings for the rezoning applications of
Dr. Tunde Apantaku Professional Corp. (144 Lansdowne Avenue), Resonance Inc.
(19 Paddock Street), and The Coverdale Centre for Women Inc. (154 Waterloo
Street), that were scheduled for Monday December 7, 2020 at 6:30 p.m. in the
Council Chambers.

The purpose of this report is to cancel the public hearing dates scheduled for three
rezoning applications that were to be dealt with by the Planning Advisory
Committee at their meeting of November 17, 2020, which was cancelled. Staff
are working on rescheduling the PAC meeting and public hearing date and will
return with a follow up resolution to set a new public hearing date.

REPORT
The public hearings for three rezoning applications were scheduled to be
considered by Common Council at the December 7th meeting. These
applications were to be considered by the Planning Advisory Committee at their
meeting of November 17, 2020. Given the Planning Advisory Committee
meeting was cancelled, a revised plan is required for consideration of these
applications.

A number of procedural steps are required to reschedule the public hearings,
including setting a date, public notification on the City's website and notification
to landowners within 100 metres of the subject sites. For these reasons, the
public hearings for these three applications will be postponed.
City Staff have been in discussions with the applicants to inform them of the
cancellation and are reviewing scheduling of the required Planning Advisory
Committee Meeting and public hearings. Dates for special meetings of the
Planning Advisory Committee and Common Council will be determined, with the
public hearing dates formally set by Council at one of the December meetings.
This will allow for the required advertising and notification in advance of a new
public hearing date.

RECOMMENDATION
Your City Manager recommends that this report "Update on By-law Amendments
for Development Fees Adjustments" be received and filed.
EXECUTIVE SUMMARY
This report provides an updated plan and new dates for consideration of by-law
amendments concerning the development fees sustainability initiative.

REPORT
A number of by-law amendments were scheduled to be considered by Common
Council at the November 16rd meeting. Given the meeting was cancelled, a revised
plan is required for consideration of these by-law amendments.
Two of the seven by-law amendments require a public hearing, being the Zoning
By-law and the Heritage Conservation Areas By-law. A number of procedural
steps are required to reschedule the public hearings, including setting a date,
public notification and in the case of the Heritage by-law, letters to each and every
property owner. For these reasons, the hearings for both by-laws will be
postponed until the new year. A date for the hearings will be determined in the
coming weeks and will be formally set by Council at one of the December
meetings, which will be followed by required advertising and notification in
advance of a new year hearing date.

The remainder of the by-law amendments (Building, Plumbing, Water and
Sewerage, Subdivision and Excavation of Streets) will be considered for approval
of first and second readings at the December 7, 2020 Council meeting, with third
reading scheduled for December 14, 2020. This will position the City to have the
majority of fee increases and adjustments in place by January 1, 2021.
STRATEGIC ALIGNMENT
The permit and development approvals fees initiative is part of the City's
Sustainability plan, which supports Council's fiscally responsible priority.
SERVICE AND FINANCIAL OUTCOMES
The revenue target for this initiative is $100,000.

The Finance Committee recommends that Common Council:
1. Approve the City of Saint John Safe Restart Funding Application based on
the following net impact of Covid-19 in the year 2020:
• Add: Total of Additional Covid-19 Specific Costs - $302,310
• Add: Total of Covid-19 Specific Losses - $4,781,194
• Less:Total of Covid-19 Specific Operating Savings - $1,706,779
• Net COVID-19 impact - $3,376,725

On Friday, October 30, 2020 the Province of New Brunswick, collaborating with
the Federal Government, announced financial support would be provided to local
governments to cover COVID-19 related expenses through the Safe Restart
Agreement.
On November 6, 2020 the Province of New Brunswick distributed a letter from the
Minister of Local Government and Governance Reform Daniel Allain that
indicated local governments must submit a resolution of Council which clearly
outlines the net impact of COVID-19 in 2020 to access Safe Restart funding.
The letter indicated specifically the following information is required in the Council
Resolution with a deadline for submission of December 31, 2020:
• Add: Total of Additional Covid-19 Specific Costs
• Add: Total of Covid-19 Specific Losses
• Less: Total of Covid-19 Specific Operating Savings
• Net COVID-19 impact
Based on this formula, the City of Saint John is submitting a claim for $3,376,725
($2,152,725 General Fund; $1,225,000 Utility Fund). This would include Covid-
19 related costs incurred such as materials and services including plexiglass, masks,
sanitizer, digital solutions to work remotely, signage, and equipment. Total Covid-
19 specific losses would be various municipal revenues as a direct result of Covid-
19 such as lower than normal parking related revenues, water revenues, user &
recreational revenues, and utility cut revenue. Covid-19 specific operating savings
includes fuel, materials, casual workforce reduction (as a result of closures due to
Covid-19), energy savings and reduction in overtime. The Finance Committee
approved this application at its meeting on November 26, 2020.
Based on the conditions contained in the 2020 Short Term Provincial Funding
Agreement, the City will not be able to retain funds associated with the Safe Restart
program. Rather than relying on the Provincial agreement as a backstop, the City
curtailed over $5 million in expenses to mitigate the financial risk of Covid-19. As
discussed with the Finance Committee, the Mayor will make a formal request to
the Province to recognize the City's strong fiscal management and amend the Short
Term Funding Agreement to allow the City to retain any approved Safe Restart
funding. If the Province approves an amendment, the City would place the funds
in a reserve to support the City's future long term financial plan objectives.

As you are aware, the City of Saint John has addressed its sustainability challenges with direct and decisive
action including:
1. Eliminating a structural deficit by restructuring operations by approximately $10 million dollars
(more than 6% of the overall budget);
2. Implementing best practice financial policies in areas such as wage escalation, asset management
and budget practices that will protect the organization from falling into deficits in future years;
3. Approving a Long Term Financial Plan with 10 year targets to reduce the tax rate by 21.5 cents as
well as a 25% reduction in the City's long term debt and infrastructure deficit;
4. While undergoing a historical financial reset, Saint John simultaneously took swift mitigation
action to address a potential $5 million dollar shortfall due to Covid-19 in order to protect
taxpayers and to be fiscally responsible with short-term provincial funds.
As announced on Friday, October 30, 2020 the Province of New Brunswick, collaborating with the Federal

While YSJ has seen the return of daily service, our airline
partners continue to assess the viability of routes across the
country.
We can't assume we won't be affected by future service
disruptions.

ABOUT YSJ
The Saint John Airport has been self-sustaining, profitable and
growing since it was privatized in 1999. We're poised to continue
serving all of southern New Brunswick's business and leisure travel
needs, once public health restrictions are lifted.
We are a not -for -profit authority owned by the community. We are
user -funded. Until 2019, when our airport modernization project was
eligible for a new federal program, we had never received public
funding.

service / access would have on our region's economic recovery and return to growth.
SO FAR, WE'RE HEARING:
• Employers anticipate challenges filling highly -skilled positions (e.g., 80% of NB tech execs believe
access to air is key to recruitment and growth: Tech Impact)
• Our UVP to remote workers will be compromised.
• Hotels would see a decline in the range of 20 per cent occupancy, representing a $7.4 M reduction in
related revenue and an $18M loss to the local economy.
• The Algonquin Hotel, a $15M regional asset, is dependent on meetings & conventions and having air
access inside a one -hour drive; 65% of guests arrive via YSJ.

AND WHEREAS, The City of Saint John deems
it advisable to make this by-law to establish fees for
fire protection services provided by or on behalf of
the local government;
WHEREAS, paragraph 10(1)(i) of the Local
Governance Act, authorizes a local government to
make by-laws for municipal purposes respecting
programs and services provided by or on behalf of
the local government;
AND WHEREAS, paragraph 10(6)(d) of the
Local Governance Act authorizes a local
government to establish fees for programs or
services provided by or on behalf of the local
government;
AND WHEREAS, notice of this by-law, and of the
Common Council meeting at which this By-law
was discussed, was provided in accordance with the
provisions of the Local Governance Act.

direction of the Canadian Council of
Ministers of the Environment (CCME),
February 1992,
(c) carpets,
(d) domestic garbage,
(e) electrical wire,
(f) hazardous materials such as chemicals or
physical agents regulated under the
provisions of the Workplace Hazardous
Materials Information System (WHMIS) or
the Transportation of Dangerous Goods Act
and its Regulations,
(g) petroleum products,
(h) plastics,
(i) pressure treated lumber or railway ties,

(f) The Schedules attached to this By-law are

By-law.
Fees
4(1) The City shall collect fees for fire protection
services delivered by the Fire Department as
described in Schedules A, B and C.
4(2) A person shall pay the fees described in
Schedules A, B and C.
Offences
5 A person who violates any of the provisions
of this By-law is guilty of an offence and liable
upon summary conviction to a fine of not less than
one thousand dollars ($1,000.00) and not more than
two thousand one hundred dollars ($2,100.00).
Administrative Penalties
6(1) The City may require an administrative
penalty to be paid with respect to a violation of a
provision of this By-law as set out in
subsection 6(2).
6(2) A person who violates any provision of this
By-law may pay to the City within forty-five (45)
calendar days from the date of such violation an
administrative penalty of five hundred dollars
($500.00), and upon such payment, the person who
committed the violation is not liable to be
prosecuted therefor.
Repeal
7 A By-law of The City of Saint John enacted
on the 6th day of July, 2020, entitled "By-law
Number LG-9, A By-law respecting Fees for Fire

6(2) Toute personne qui contrevient a une
disposition du present arrete peut payer a la
municipalite dans un delai de quarante-
cinq (45) jours civils a compter de la date de ladite

Subject: AIM Recycling Facility
Background:
The City of Saint John on behalf of residents continues to have concerns with respect to AIM Recycling's ability
to comply with their Provincial operating licence. Of particular concern is the severity and frequency of recent
explosion events in close proximity to a number of Uptown and West Side residential and commercial
neighbourhoods and key tourism assets.
Our concerns regarding the AIM recycling facility in Saint John are premised on two key Council Priorities:
Vibrant, Safe City and Growth & Prosperity. It is essential that we do everything possible to ensure that Saint
John is recognized by its residents and citizens as a positive place to live, work and play. Our ability to grow our
community and attract new people and investment requires a healthy coexistence between unique, livable
neighbourhoods that coexist with commercial and industrial activities. Unfortunately, we do not currently have
a healthy coexistence, with disruptive heavy industrial activities and explosion events taking place within the
heart of our City and Inner Harbour.
Recognizing that the City of Saint John has absolutely no regulatory or land use planning authority with respect
to the AIM facility and Port Saint John operations in general, AIM's presence within the City's urban core
impacts the overall sustainability and livability of our Uptown and Inner Harbour neighbourhoods (one of our
region's key emerging growth catalysts). The status and operation of the AIM facility also continues to be a key
area of focus and discussion (and concern) with developers and investors that are working with the City and
DevelopSJ with respect to a range of Uptown and Inner Harbour property and real estate development
projects.
Motion:
That a letter be sent to the appropriate Minister, copying all area MLA's, Member of Parliament Wayne Long,
The appropriate Federal Minister, the Port SJ CEO and Board Chair, calling on the Provincial and federal
governments to ensure enforcement is happening on all aspects of the AIM facility approval to operate. In
particular as it related to the requirements to have all raw materials shipped in with accelerants removed and
that AIM is required to inspect all raw materials to ensure accelerants are removed (clause S6 & 57 of the
Approval to Operate). If this were happening, there would be no explosions. That the definition of an explosion

RECOMMENDATION
RESOLVED that Council Receive and File the Presentation "Back to Life" from the
Saint John Airport,
And FURTHER BE IT RESOLVED that the Mayor send a letter to the Minister of
Transport in support of the Saint John Airport that is attached to this report.
EXECUTIVE SUMMARY
This report directs the Mayor to issue a letter to the Minister of Transport in
support of the Saint John Airport. The Letter explicitly calls on the Federal
Government to ensure that commercial passenger flights are maintained or
increased at the Saint John Airport. It also requests the Federal Government to
provide stable operational funding to the Saint John Airport. Finally, it calls upon
the Provincial Government to safely pilot rapid Covid testing at the Airport for all
passengers.

Dear Minister Garneau,
On behalf of the City of Saint John, I would like to thank your Government for the support
it has provided to date in assisting our residents and businesses through this Pandemic, and for
working collaboratively with the Province of New Brunswick to support municipalities through
these challenging times.
The City of Saint John was pleased to read your statement of November 8', where the
Government of Canada committed to developing a package of assistance to Canadian airlines,
airports and the aerospace sector. I am writing to you to express the City's support of this assistance
program in principle and to convey to you our unequivocal support for the Saint John Airport.
The Saint John Airport is a vital infrastructure link for Southern New Brunswick, providing
an essential service for our residents, businesses, visitors, health care sector, students and new
Canadians. The Saint John Airport is a key economic driver in Greater Saint John with an economic
impact of more than $90 million annually and supporting 650 Jobs. Last year over 280,000
passengers used the Saint John Airport and its airfield was completely modernized thanks in part
to a $10 million dollar investment from Transport Canada, and a $4 million dollar investment from
the Government of New Brunswick.
As you are well aware, a number of airlines have suspended service across the Country due
to the pandemic. This has significantly impacted our community, and we are down to one
commercial flight daily operated by Air Canada. It is absolutely critical that commercial passenger
service is maintained at the Saint John Airport with the goal of improving access to passenger
flights as quickly as possible. To that end, the City of Saint John is calling on your Government to
continue to work collaboratively with our airline industry to ensure that this critical need is met.
Airports across the Country are facing tremendous financial strain due to the unprecedented
decline in commercial passenger traffic. It is vital that the Saint John Airport remains open so it
can continue to serve as an essential transportation link to our region. Accordingly, the City of Saint
John is also urging your Government to provide stable operational funding to our Airport to ensure
it remains open to serve our community, and Atlantic Canada.
Saint John is fortunate to be in the Atlantic Bubble and is currently one of the safest
jurisdictions in the world. A large part of this is due to the proactive and timely decisions made by
the New Brunswick Government and the GNB Office of Public Health. While it is paramount we
keep the Atlantic Bubble intact, we recognize that the 14-day isolation period for many travelers
has had a significant impact on airlines, residents, businesses, tourism, and our local economy
overall. We are encouraging our health authorities to safely investigate and pilot initiatives, such
as rapid COVID testing for all passengers at our New Brunswick Airports, with a goal of reducing
the amount of time travelers are required to self -isolate, while always ensuring public safety is
maintained.
The City is happy to work in collaboration with the Federal and Provincial Governments
and the Saint John Airport to ensure the Region of Greater Saint John has quick, safe, affordable,
and continued access to air transportation. I look forward to you releasing details of the pending
assistance package for the aviation industry and I hope we can count on this assistance being of
benefit to Saint John and our airport as soon as possible.
