Meeting Called To Order The Mayor called the Committee of the Whole Open Session Meeting to order. 1.2 Disclosures of Conflict of Interest Referring to the submitted report entitled M&C 2018-107: Disclosures of Conflict of Interest the City Manager advised members that the process to declare a conflict of interest is to file a declaration of conflict with the Common Clerk. There is a form prescribed under the Municipalities Act until the new regulation under the Local Governance Act is published. In absence of a written declaration there is a positive inference the member is not in conflict. Responding to a question, the City Solicitor stated that there may be occasions when a conflict emerges during a meeting, and it is appropriate for a member to verbally declare their conflict 2018-2 Committee of the Whole Meeting Open Session April 9, 2018 and to leave the meeting. There may be instances where a member is uncertain they have a conflict, the best practice is to obtain independent legal advice. The City Solicitor and Councillor Norton withdrew from the meeting. Acting Solicitor M. Tompkins entered the meeting. Ms. Tompkins outlined the three ways to determine conflict with the West Side Water litigation: • You area west side property owner • You have suffered damages • You are a member in the class action Moved by Deputy Mayor McAlary, seconded by Councillor MacKenzie: RESOLVED that the submitted report M&C 2018-107: Disclosures of Conflict of Interest, be received for information. LTA IQI[Q►[4L1:k]k]11191 1.3 Discussion of Confidential Matters Moved by Deputy Mayor McAlary, seconded by Councillor Sullivan: RESOLVED that the public be excluded from the meeting for the duration of the discussion on the following matters: 1.1 Approval of Minutes 68(1); 1.2 Financial Matter 68(1)(c); 1.3 Financial Matter 68(1)(c); 1.4 Financial Matter 68(1)(c); 1.5 Financial Matter 68(1)(c); and 1.6 Employment Matter 68(1)(b,j).
