LETTER OF AGREEMENT
BETWEEN:
THE CITY OF SAINT JOHN
(the Employer)
-and-
(the Union)
Background
On December 21, 2012 the City of Saint John and the Canadian Union of Public
Employees, Locals 18 and 486, the Saint John Fire Fighters Association, the
International Association of Fire Fighters, Local 771, and the Saint John Police
Association (collectively the "Unions ") entered into a Memorandum of
Understanding (the "MOU ") to permit the conversion of the pension plan provided
by the City of Saint john Pension Act into a Shared Risk Plan.
The MOU provides, in paragraph 11(t), that the City "shall obtain long term
disability insurance for all its Employees effective as of the Conversion Date. Such
long term disability insurance must be covered under an insured policy with a life
insurance company on such terms as the Employer and Unions agree upon ".
At the time of signing the MOU, the City was unable to obtain long term disability
(LTD) insurance on a permanent basis given its procurement requirements.
Therefore, the parties agreed to an interim arrangement, to expire on December 31,
2024, so that LTD insurance couhi be provided to employees. The parties agreed
that they would continue discussions so that a permanent LTD policy could be
established, and that they would invoke binding arbitration as a dispute resolution
mechanism should they fail to reach an agreement by the expiration of the interim
arrangement. This interim arrangement was approved by the Superintendent of
Pensions.
The interim arrangement resulted in the Employer acquiring LTD through the
"Group Insurance Policy" with Great West Life, Policy No.: 165993GHA. The parties
agreed to the terms and conditions of this policy, and the Employer, as per the
interim arrangement, paid 100% of the costs associated with the Policy.
In March, 2014, this matter was referred to arbitration before an Arbitration Board
consisting of Chair George Hiner, Employer Representative Stephen Beatteay and
Union Representative George Vair, A hearing has been scheduled for November 5, 6,
and 7, 2014 to hear and determine the matter.

On October 27, 2014, the parties met in an attempt to mediate this matter before the
hearing. This Letter of Agreement represents the parties' agreement.
Agreement
1. The City of Saint John will obtain an LTD policy, to be effective as of January
1, 2015, with the same coverage as outlined in the policy with Great West
Life, Policy No.: 165993GHA (or equivalent), except the following terms and
conditions shall be amended as follows:
a) L112 Benefit: benefits to be based on 70% of an insured
employee's monthly earnings;
b) Im le Status of Benefits :, benefits to be taxable,
c) Waiting Pe ' d: the waiting period shall be 180 calendar days;
and
d) All Source Maximum: the 85% of net take home pay all source
maximum condition shall be removed;
2. All other terms and conditions shall be equivalent to the terms and
conditions as outlined in the policy with Great West Life, Policy No.:
165993GHA or equivalent.
3. The Arbitration Board shall determine what the cost sharing arrangement of
the LTD plan ought to be. The parties agree to be bound by the decision of
the Arbitration Board.
4. The LTD plan, including the cost sharing arrangement, shall be fully
negotiable and not changed without mutual consent.
S. This Letter of Agreement forms part of the Collective Agreement dated
Signed on the day of November, 2014.
