The Mayor suggested that Council table the items on the agenda with the exception of
the public hearings. He requested that Council recess and reconvene in Committee of
the Whole closed to continue hearing a briefing from the Provincial Pension Task Force.

RESOLVED that each of the agenda items of
November 5, 2012 be forwarded to the Council meeting of November 13, 2012, with the

9.1(a) Proposed Zoning By-Law Amendment 317 City Line
9.1(b) Planning Advisory Committee Report Recommending Rezoning with
Section 39 Conditions
The Common Clerk advised that the necessary advertising was completed with regard to
amending Schedule "A", the Zoning Map of The City of Saint John, by re-zoning a parcel
of land with an area of approximately 912 square metres, located at 317 City Line, also
identified as being PID Number 00386193, from "R-2" One and Two Family Residential
to "R-4" Four Family Residential with no objections being received.
Consideration was also given to a report from the Planning Advisory Committee
submitting a copy of planning staff's report considered at its October 16th, 2012 meeting
at which the Committee recommended the rezoning of a parcel of land located at 317
City Line as described above with Section 39 conditions.
The Mayor called for members of the public to speak against the re-zoning with no one
presenting.

Responding to a question, Mr. Forrest stated that the Zoning By-law has a provision
which allows a number of unrelated people to reside together as a family unit within one
dwelling. He explained that the subject property is currently two separate bachelor
apartment units and one boarding house consisting of eight rooms. He added that the
owner has applied to change the 8 room boarding portion of the dwelling into two 4
bedroom apartments with the bachelor apartments being changed to 1 bedroom
apartments.

9.2(b) Planning Advisory Committee Report Recommending Rezoning with
Section 39 Conditions
The Common Clerk advised that the necessary advertising was completed with regard to
amending Schedule "A", the Zoning Map of The City of Saint John, by re-zoning a parcel
of land having an area of approximately 426 square metres, located at 290 Ludlow
Street, also identified as being PID Number 00365098, from "R-1 B" One Family
Residential to "B-2" General Business with no objections being received.
Consideration was also given to a report from the Planning Advisory Committee
submitting a copy of planning staff's report considered at its October 16th, 2012 meeting
at which the Committee recommended the rezoning of a parcel of land located at 290
Ludlow Street as described above with Section 39 conditions.
The Mayor called for members of the public to speak against the re-zoning with Julie
Baribault, resident of an adjacent property at 106 St George St, advising that she would
like to see a new retaining wall and a privacy fence built.
Blair Read, a resident of the neighbourhood, expressed concerns with the poor condition
of the retaining wall. He further noted that the area has water drainage problems.
The Mayor called for members of the public to speak in favour of the re-zoning with
Dwight Allaby appearing on behalf of the applicant. Mr. Allaby stated that he is in
agreement with the recommendations from the Planning Advisory Committee, with the
exception of recommendation 1 d), the requirement to remove the barbed wired from the
roof, noting that he would request a one year period to address the issue.

Mr. Allaby explained that the applicant will be seeking the City's approval in the future to
expand the structure for a small business, noting that the applicant would like to avoid
addressing the barbed wire issue if the same area is to be renovated again in the near
future. He noted, however, should the expansion not be permitted, then the applicant
would have no objections to removing the barbed wire.
Responding to a question, Mr. Forrest advised that when Council adopts section 39
conditions for the subject property, a requirement could be added for the property owner
to complete the necessary work within one year.

rezonage d'une parcelle de terrain d'une superficie d'environ 912 metres carres situee
au 317, City Line, et portant le NID 00386193, afin de faire passer la classification s'y
rapportant de zone residentielle— habitations unifamiliales et bifamiliales « R-2 » a zone
residentielle— habitations de quatre logements « R-4 », et qu'aucune objection n'a ete
re�ue a cet egard.
On procede egalement a I'etude d'un rapport du Comite consultatif d'urbanisme qui
presente un exemplaire du rapport du personnel d'urbanisme examine lors de la seance
du 16 octobre 2012, pendant laquelle le Comite a recommande de proceder au

En reponse a une question, M. Forrest declare que I'Arrete de zonage renferme une
disposition permettant a des personnes non apparentees de resider ensemble dans un
meme logement, comme le ferait une famille. II explique que la propriete en question est
actuellement constituee de deux studios independants et d'une maison de pension a
huit chambres. II precise que le proprietaire a presente une demande visant a
transformer la partie comprenant les huit chambres en deux appartements de quatre
pieces chacun et d'amenager les studios en appartements d'une piece.

qu'elle aimerait qu'un nouveau mur de soutenement et une nouvelle cloture privee soient
eriges.
Blair Read, un resident du quartier, se dit preoccupe par le piteux etat du mur de
soutenement. II fait egalement etat de problemes d'ecoulement des eaux dans le
secteur.
Le maire invite le public a venir exprimer son appui au projet de rezonage; prenant la
parole au nom du requerant, Dwight Allaby se prononce en faveur des
recommandations du Comite consultatif d'urbanisme, a I'exception de la
recommandation 1 d), a savoir I'obligation de retirer le barbele du toit, et mentionne qu'il
lui faudra un an pour accomplir cette tache.
M. Allaby explique que le requerant demandera a la Ville d'approuver I'agrandissement
de la structure afin d'y etablir un petit commerce et mentionne que celui-ci aimerait eviter
d'avoir a regler la question du barbele si le secteur en question doit etre renove sous
peu. Toutefois, il precise que si I'agrandissement n'est pas autorise, alors il n'aura
aucune objection a enlever le barbele.
Repondant a une question, M. Forrest mentionne que lorsque le conseil appliquera les
conditions imposees par I'article 39 a la propriete en question, une exigence voulant que
son proprietaire execute les travaux requis dans les douze mois pourra etre ajoutee.
