RE: Item 5.5 on the Common Council Agenda for October 24, 2011
This item recommends that an amendment to the City's Traffic By -Law be
prepared to change the speed on a portion of Main Street and the Viaduct from 50
km/hr to 601an/hr. This stretch of highway is a portion of a Provincial Highway
as the latter term is defined in the Motor Vehicle Act. The Motor Vehicle Act
provides that the speed limit on Provincial Highways is a matter exclusively
within the jurisdiction of the Province. A Municipal By -Law that purports to
establish a speed limit for that portion of roadway is beyond the Municipality's
jurisdiction and is of no force or effect. Consequently, the recommendation at
Item 5.5 should be simply that the report be received and filed.

It is recommended that notwithstanding the City's Procurement Policy, Common Council award a
contract to Gulf Operator's Ltd. for the supply, installation and construction of a 4 inch conduit to carry
fibre optic cable between the City Hall Building and the new Police Headquarters in an amount not to
exceed $40,000.00, in accordance with the dated October 14, 2011, and that the Mayor and Common
Clerk be authorized to sign the necessary documentation.
