SUBJECT: Rainbow Park Improvements
Amendment to Recreational Infrastructure Canada Letter of Offer
The City of Saint john
Attached to this report is a copy of an Amendment to ACOA's Letter of Offer for this project
that requires sealing and signature. In 2010 there were three separate projects that received
support through the Recreational Infrastructure Canada Fund: Rainbow Park, Rockwood Phase 11
and Fleming Court. The actual final costs of the latter two were lower than anticipated based on
actual tender unit prices and final construction quantities. ACOA's support for these projects is
capped at a fixed percentage of the eligible construction costs. As such the total amount of
support would be reduced.
We have worked closely with our partners at ACOA to redirect these funding shortfalls towards
Rainbow Park where construction costs were higher than originally anticipated. With this
amendment the total support for these three projects increases from $754,700 to $762,800
(approximately).
This is a time sensitive document, requiring signature and return before March 31, 2011.
We recommend that the attached amendment be signed and executed.

Re, Amendment Approval under the Recreational Infrastructure Canada Program

As per your correspondence dated January 7, 2011, the Atlantic Canada Opportunities Agency
( "the Agency ") hereby agrees to the following amendment, effective immediately:
Clauses 3.01 and 4.01(a) are hereby deleted and replaced by the following:
3.01 Subject to all other provisions of this Agreement, the Agency shall make a non - repayable
contribution (the "Contribution "), to the Applicant, to assist in the execution of the
Project as described in Annex 1 (Statement of Work), and calculated as the lesser of (a)
and (b) as follows:
(a) 32,679% of eligible costs, estimated to be 956,272; and
(b) $312,500.
4.01 (a) Payments of the Contribution are estimated to be in the following amounts for the
Agency's fiscal years and based on the Eligible Costs anticipated to be incurred by the
Applicant within the fiscal year:
Fiscal Year 2009 -10 $24,296
Fiscal Year 2010 -11 $288,204
Annex 1, Statement of York, is to be replaced by the attached revised
Annex 1, Statement of Work, dated March 25, 2011.
All other terms and conditions of our Letter of Offer dated July 31, 2009, and accepted by you on
September 28, 2009, and as amended on January 21, 2011, remain unchanged.

"Resolved that the Committee of the Whole recommend to Common Council that the By -Law
Respecting the Procedures of the Common Council of The City of Saint John be amended in
the attached form and that such by -law amendment be given first and second reading by
Common Council at its meeting of March 28, 2011.
