1, Mayor Ivan Court, of Saint John do hereby
proclaim the week of October 18 24, 2010 as Waste Reduction Week
in the City of Saint John on behalf of FUSION Saint John's Urban
Development Et Economic Growth Committee and Uptown Saint John's
Green Feet Committee.
On October 24, 2010 FUSION Saint John, in conjunction with Uptown
Saint John's Green Feet Committee, will host a Party with a Purpose
wherein the winner of the "BYOB" art contest will be announced, and
a reusable cotton lunch bag featuring the winning design will be
unveiled and given to attendees.

on the adverse effects of awn and garden
pesticides on babies, chi dren and
househo d pets. This information is

earning disabi ities, cancer, and diseases of the
nervous system.

Vvliret makes the-se statistics even more gailing is that
stickle poisoning is an un7 hazard. Certainly
in the case of so-called cosmetic pesticides (chemicals
used on lawns and gardens), there is little or no real
benefit derived frotri the risks these products pose.
The findings presented in this report highlight
7 cable gaps in our knowtedge about the prevalence
of acute pesticide poisoning in Canada and point to the
need to reduce risks posed by pesticides. The surest way
to reduce risks is to eliminate the possibility of cposure,

pesticide poisonings in Quebec predate tbis pesticide
poisonings in the province might be exped to decline
as a result of the new iasv.)
Most importantly, this report issues a :4 call to
federal, and provincial governments, which playa crucial
role in reporting and monitoring all s of Poisoning,
educating Canadians about ways to ree uce risks, and
regulating substances that pose an arna-?ces...ary threat
to health. Human health 'concerns atust r ot be trumped
by pesticide industry interests. The 'David Suzuki

JOHN
Be it enacted by the Common
Council of The City of Saint John as
follows:
1 A by-law of The City of Saint John
entitled, "A By-law Respecting The
Stopping Up and Closing of Highways in
The City of Saint John", enacted on the
nineteenth day of December, A.D. 2005, is
hereby amended by adding thereto Section
214 immediately after Section 213 thereof,
as follows:
214 The City of Saint John does hereby
stop up and close permanently the
following portion of highway:
FORT DUFFERIN ROAD: All that
portion of Fort Dufferin Road, a public
street in the City of Saint John, in the
County of Saint John, in the Province of
New Brunswick, comprising 292 square
metres (3,143 square feet) more or less as
shown on a Plan of Survey Dwg. No.
S08494D prepared by Hughes Surveys
Consultants Inc. surveyed by Russell J.
Robinson, New Brunswick Land Surveyor,

PARKING GARAGE FACT SHEET
Ownership the garage will be built, owned, operated and maintained by the Parking
Commission (PC) which is a City entity.
Debt the PC can borrow with the permission of the City. The PC will repay the debt incurred
to build the garage with revenues it derives from parking fees. The PC aiso has a cash reserve it
can draw on if it does not raise sufficient funds in any year. The City is exposed to risk in so much
that if sufficient revenues are not generated to cover the debt then the City would be obligated
to cover the debt. This is high!y unlikely.
Property Tax Rebate the PC is owned by the City. The Parking Commission via the Parking
Commission Act is not required to pay the City of Saint John property taxes based on Section 13.
The Act references the payments are payments "in lieu of" municipal property taxes. The PC will
pay municipal property taxes to the City and the City will rebate the taxes to the PC. In this
regard, the City and the PC will be in the same financial position after construction of the garage
as before le the City does not have a tax revenue from the PC and the PC does not have a tax
expense to the City. In other words it 15 a wash.
Council Decision(s) the key decision that Council will be asked to make is whether or not it
wants to authorize the PC to borrow the funds needed to construct the garage. Based on the PC
Act, the City of Saint John would need to pass a resoution to guarantee a loan.
Council will also have to determine the extent of the tax rebate that it is prepared to offer the
PC in any given year. For example a good year for revenues may limit the need for a full rebate.
Tax Rate Impact assuming the revenue and operating cost assumptions are as projected there
is no impact on the City tax rate. The construction, operating and maintenance costs wifl be the
responsibility of the PC. OnIy if the PC faced a significant downturn in revenues could the city
be called upon as this is a City Commission.
Current Status the design of the garage is nearing completion and tenders are planned to be
let before month end by the PC.
Relocating the Garage the foliowing should be considered
Users Location at Harbour Station is distant from Court House and does not provide ready access to
courts.
NIOU the City and the Province entered into an agreement respecting funding of the various Peel
components. Council should consider the impact on the business relationship and the risk to the
funding contribution from the Province.
Costs PC has invested approx $i.7M to date for engineering and land. These investments will be Iost.
The costs referenced in the Parking Study are 5 years old. A new design would be required based on
new site conditions.

Concurrent process the best tender bids will be the result of a competitive process. Bidders incur
considerable expense to prepare detailed bids. Running a parallel process will likely reduce bidder
interest in the pr ject if they believe the bids are just meant to test the waters.

Your City Manager recommends that the following resolution be adopted:
RESOLVED that Deputy Commissioner Amy Poffenroth, P. Eng. is hereby designated
and authorized to make an application on behalf of The City of Saint John to the Court of
Queen's Bench of New Brunswick for an order that would require the owner(s) of 1660
Manawagonish Road to, within 60 days or such other period of time as the judge may
direct, cease using, or permitting the use of his property that is located at 1660
Manawagonish Road, Saint John, NB (PID 402727), for the occupancy of tenants for
residential purposes and to refrain from such uses in the future.

The Purchaser shall acquire from the Vendar an easement and rights at the cost, risk
and expense of the Purchaser, by its officers, servants, agents, contractors and workers,
to enter the Real Property with machinery, materials, vehicles and equipment and to
construct, alter, maintain, inspect and repair underground pipelines, storm sewers,
sanitary sewers or any like municipal works including all related works appurtenant
thereto, promptly restoring as far as is practical the surface of the Real Property to the
same conditions as it was prior to the commencement of the work or excavation,
together with the right by action or otherwise at any time to enjoin the Vendor,
including the heirs, executor, administrators, successors and assigns of such Vendor
from erecting or Iocating on the Real Property any building, structure or other obstacle
which could impair the free and full use of the easement or permitting the erection or
location thereon of any such building, structure or other obstacle; provided that upon
completion of the initial installation of municipal works the Purchaser shall re-instate
any portions of the Real Property disturbed by work or excavation to the same or better
condition existing prior to the initial installation.

2. The Purchaser may examine the title to the Real Property at its own expense within
thirty (30) days foliowing the Purchaser's acceptance of this offer. If within that time any
valid objection to the title to the Real Property is made in writing by the Purchaser to
the Vendor which the Vendor shall be unable or unwilling to remove within twenty (20)
days of notification of such objection or objections and which the Purchaser will not
waive, this agreement shall, notwithstanding any intermediate acts or negotiations in
respect of such objections, be null and void and any deposit shall be returned by the
Vendor without interest and the Vendor shall not be liable for any costs or darnages.
Save as to any valid objection so made within such time, the Purchaser shall be
conclusively deemed to have accepted the title of the Vendor to the Real Property.
3. In the event that the Vender's title is encumbered, the determination that any
encumbrance exists is in the sole and absolute discretion of the Purchaser, the Vendor
shall obtain from each encumbrance a Postponement, in registerable form, of such
encumbrance to the Purchaser's easement provided, that the Purchaser shall reimburse
the Vendor for all administration (including appraisal) fees required by each
encumbrancer to give the Postponement.
4. (1) The Purchaser shall prepare at its cot pny Plan of Survey required to effect the
conveyance herein contemplated; and'
/i0 The Purchaser shall reimburse the Vendor 4p to $500.00 o|us H.S.T. for legal fees
expended by the Vendor to finalize this conveyance; and
(Hi) The Purchaser shall pay for registration 8k filing fees at SNB, if applicable, for the
plan, Grant of Easement and the Postponement.
5. The Purchaser will have vacant possession of the Real Property on Closing.
6. If the Purchaser defaults in the closing of the sale under the terms of this Agreement,
any money paid hereunto shall be forfeited to the Vendor by way of liquidated damages
or tbe Vendor may at its option compel the Purchaserto complete the sate.
