E2L 4L1 Subject: Concern to Proposed Zoning By -law Amendment Application #08 -072 - 990 Sand Cove Rd Day Care Facility March 31, 2008 Council Agenda - Public Hearing 9.2(a) Dear Elizabeth Gormley / City Councilors, This letter serves as official notice that the owners and operators of 940 Sand Cove Rd multi -unit apartment building oppose the application by the property owner of 990 Sand Cove Rd for Zoning By -law variance to create a day care center complete with parking lot. We regret this action; however, this development will negatively affect our property, which is mostly occupied by seniors, and the respective neigbourhood in the following manners: • potential water drainage issues from parking lot • increased noise to environment from children and traffic • loss of privacy to balconies of apartment units facing the development • daily traffic congestion during peak periods on Sand Cove Rd resulting in difficulties from 940 Sand Cove Rd tenants exiting the property • Parents /Guardians may use 940 Sand Cove Rd parking and idle vehicles during wait times • increased traffic will reduce pedestrian safety and increase noise • driveway access to development is at the crest of a curved hill and unsafe for high traffic and children • de- valuate neigbourhood properties The site selection for this development is poor. The property my husband and I own is approximately 200 feet from Dooly's. We are totally opposed to Dooly's adding an additional lounge. We are currently tired of the existing problems from Dooly's billiard parlour. Prior to their move in 2005 we had very little problems with noise and traffic. Since they relocated this has been an ongoing problem. I understand: That the rear doors to the decks associated with Dooly's billiard parlour remain closed at all times, and that the exterior door from the lounge facility be used only as an emergency exit. That there be no licensing of the decks associated with Dooly's billiard parlour, and that there be no seating or food or beverage service permitted on the decks at any time That no music be played on the decks associated with Dooly's billiard parlour and that no music be audible form the exterior of the building. May I ask who will enforce these rules? Please do not let them make conditions worse for us and if possible put a condition on them that they cannot move any closer to the residential area in the future. If they stayed on the other side of the mall, where they were originally approved for, we would not be going through this process now. Please allow the tax payers of the residential area to be allowed to enjoy their neighborhood without the continuous problems from Dooly's. Would you want them in your neighborhood? Patrick Woods Common Clerk City of Saint John PO Box 1971 Saint John, NB E2L 41_1 Subject: Proposed Zoning By -Law Amendment Re: 55 MacDonald Street Dear Mr. Woods, I am writing with regard to the Public Notice that appeared in the March 25th, 2008 Telegraph Journal which suggested that written objections to the Proposed Zoning By -Law Amendment Regarding 55 MacDonald Street. I am representing myself, as a citizen of Saint John, and the owners of 234 Loch Lomond Road, Eastside Dental, in submitting a written objection to the proposed changes. Although the parties represented are in support of the development, we are concerned with a number of process related items as well as the perceived inability to address issues related to the proposed development. Process issues Public Consultation — there has been no formal public consultation held with regard to this approximately $22.0 million public spend, Public Notice — considering that the public notice was published on the same date that the "ceremonial" groundbreaking occurred, there has to be a concern that the public process has been undermined and become irrelevant, Permitting for site preparation — it is our understanding that a permit has been issued to allow initial site preparation on the site, however there is a concern that the proponents have gone well beyond the guidelines of the issued permit related to work completed on the site. Although there is a general sense that the process is well beyond any ability for the public to comment and potentially input, we would like to propose a number of recommendations that, in our opinion, would make the $22.0 million public investment a better project for the citizens of Saint John. Permit the rezoning to Utility & Service, however disallow the variances requested (a, b, & d) that have to do with the proponent not amassing enough land to construct the required facility. The land amassed was for an 80,000 sq. ft. facility, whereas the SJTC now has a planned 115,000 sq. ft. facility. Direct the SJTC to amass more land. 2. Complete an assessment of traffic related to Loch Lomond, MacDonald, Tiffany and other adjacent streets — there will be an impact on traffic, therefore it is imperative that it is addressed at this time of the project which would mitigate any "retrofitting" in the future. 3. Reconstruct Tiffany Street reflecting that it has been "partially" closed into a cul -de -sac with appropriate paving, curbing, sidewalks, signage and any barriers. Investigate traffic lights at the intersection of Loch Lomond and Tiffany to ensure safety concerns are addressed. 4. Retaining walls and fencing at the back of the 234 Loch Lomond Street property to ensure safety and erosion of land at the back of this property — the planned grade change will be greater than 12 feet in some places.
