REPORT TO COMMON COUNCIL 0 M C 2007 306 September 17 2007 City of Saint John His Worship Mayor Norm McFarlane and Members of Common Council Your Worship and Councillors SUBJECT Rezoning
of 1265 1285 Loch Lomond Road Section 39 Conditions BACKGROUND On September 10 2007 Common Council gave first and second reading to a proposed amendment to the Municipal Plan and Zoning
By law to permit an auto body shop and used car sales lot at 1265 1285 Loch Lomond Road Mr Michael McCluskey spoke on behalf of the applicant as well as Mr Rick Shephard the proposed
building designer and Mrs Wendy Maber a local business owner There was one individual present who expressed concerns regarding the application and noted that a petition had been submitted
A number ofletters both in support of and in opposition to the proposal were received After considering the attached report and presentations made Common Council requested that staff
prepare conditions pursuant to Section 39 of the Community Planning Act for the proposed use Common Council also requested information regarding the potential environmental impact of
the proposed use and whether provincial regulations might already be in place to govern auto body paint and repair operations ANALYSIS Discussions with the Department of Building and
Technical Services have reinforcea that an engineered ventilation system would be required for the proposed use to ensure that fumes and dust would be appropriately dealt with
Report to Common Council September 7 2007 Page 2 Both the provincial and federal governments currently regulate the use of materials containing volatile organic compounds VOCs as they
are the precursors to particulate matter and ozone the key ingredients of smog The solvents in automotive refinish coatings paint and surface cleaners contain VOCs which evaporate to
the atmosphere during surface preparation paint application and clean up The provincial Department of Environment requires that certain sources of air pollutants apply for an Approval
to Operate under the Clean Air Act The Approval limits the amount and type of pollutants released and sets out standards and methods for monitoring and reporting A wide range ofterms
and conditions can be attached to an Approval Small sources are not regulated as the emissions are less than the Department s pre determined criteria for the issuance of a Certificate
ofApproval to Operate A discussion with Department staff revealed that they currently only require an Approval to Operate for auto body paint operations using more than 5 000 litres
of paint per year The applicant has indicated that his operation Distinctive Autobody Collision Centre Ltd only uses approximately 500 litres of paint per year The Department does have
Small Source Users ofMaterials that Release Volatile Organic Compounds Guidelines Draft for small VOC sources including auto body shops These guidelines advise that 1 all facilities
that are considered small source users of materials that release VOCs are to design install and operate alocalized ventilation system that collects the VOCs and vents them through a
stack having a minimum exit velocity of 15 metres per second 2 the stack is to be located as far as possible from the neighbouring properties 3 the localized ventilation system is to
be in operation at all times when materials that release VOCs are being used and for at least two hours after use 4 the materials that release the VOCs and the associated wastes shall
be stored in covered containers to prevent the release of VOCs during storage 5 the area where the materials that release the VOCs are being used shall be isolated from the shipping
and receiving areas
Report to Common Council September 17 2007 Page 3 As well the federal Department of the Environment is working to reduce emissions of air pollutants in Canada and is proposing regulations
that would set mandatory limits on the VOC content of automotive refinish coatings These limits would apply to the manufacture import and sale of these products in Canada and could be
in place as soon as January 1 2009 The applicant has indicated that he is aware of these intended regulations and has also pointed out that he intends to use waterborne paints rather
than solventborne paints in his operation within the next year Industry specifications provided by the applicant indicate that the VOC levels in these waterborne paints are significantly
below regulatory standards As a result of the existing and proposed regulations and controls put in place and enforced by the provincial and federal governments it does not appear that
additional protection would be warranted in Section 39 conditions attached to the proposed rezoning Normally the issues addressed in Section 39 conditions include the permitted uses
and the nature of required site improvements Of late there has been an increasing need to address the detailed design elements of new buildings to ensure that they fit into the surrounding
urban context which varies from site to site and to promote quality developments that that will be an asset to the community The recommended Section 39 conditions detailed below address
these issues RECOMMENDATION That pursuant to Section 39 of the Community Planning Act the proposed rezoning of 1265 1285 Loch Lomond Road also identified as PID Number 55054514 be subject
to the following conditions a the use of the site be limited to an auto body paint or repair shop a car sales lot a used car sales lot a business office a personal service shop and subject
to terms and conditions as may be imposed by the Committee aretail store b the Developer must pave all parking areas loading areas manoeuvring areas and driveways with asphalt c all
paved areas at the front and sides of the site must be enclosed with continuous cast in place concrete curbs to protect landscaping and facilitate proper drainage d site drainage facilities
including necessary catch basins must be provided by the Developer in accordance with a detailed drainage plan prepared by
Report to Common Council September 17 2007 Page the Developer and subject to the approval of the Chief City Engineer or his designate e all disturbed areas of the site not occupied by
buildings driveways walkways parking storage or loading areas must be landscaped by the Developer Landscaping must extend onto the City street right of way to the edge ofthe street curb
or sidewalk f the site must be developed only in accordance with detailed site and elevation plans prepared by the Developer and subject to the approval of the Development Officer illustrating
the building location design and finishing materials asphalt paving areas access curbing lighting signage and landscaping The approved site and elevation plans must be attached to the
building permit application for the development g water and sanitary sewer services must be provided in a manner acceptable to the Chief City Engineer or his designate and the Developer
must convey any required public utility or municipal services easements h any outdoor storage of materials must be within a storage compound completely enclosed with privacy fencing

0I J SECTION 39 AMENDMENT 461 ELLERDALE STREET RESOLVED that Common Council amend the Section 39 conditions imposed on September 2 1975 and sUbsequently amended on December 15 1975 March
15 1982 June 15 1988 and October 10 2006 in conjunction with the rezoning of that portion of the subject property located at 461 Ellerdale Street also identified as the majority of PID
Number 00431536 by accepting the revised proposal showing three apartment buildings containing a total of up to 168 dwelling units as the basis for development of the expanded site subject
to the following a development of the site is limited to a maximum of 80 dwelling units until such time as the proponent has completed an engineering water and sanitary sewer analysis
that demonstrates to the satisfaction of the Chief City Engineer that the proposed development of more than 80 units does not exceed the current capacity of the existing systems b all

aj p Reducing or eliminating THMs in drinking water What are THMs THMs are trihalomethanes chemical compounds that can be formed when water is disinfected with chlorine THMs occur when
chlorine reacts with organic matter naturally present in water such as decaying leaves and for this reason THMs are common in surface water supplies throughout Canada Saint John s water
comes from surface supplies The north south and east parts of Saint John receive water from Latimer Lake and the Loch Lomond watershed The west side ofSaint John receives its water from
the Spruce Lake watershed which is supplemented at times by the Musquash watershed The chemical reaction between chlorine and organic matter forms a group of chemicals known as disinfection
by products The most common of these by products are trihalomethanes THMs THMs include four chemical compounds bromodichloromethane BDCM dibromochloromethane DBCM chloroform and bromoform
Is there a drinking water guideline set for THMs and BOCMs in drinking water The acceptable level or guideline for THMs in drinking water in Canada is set by Health Canada in consultation
with the provinces and territories The Canadian drinking water guideline for total THMs is 100 micrograms of THMs per litre of water IlgL The guideline is based on a locational running
annual average of aminimum of four quarterly samples an average of the samples from the same place The acceptable level for bromodichloromethane or BDCM is set at 16 IlgL The updated
guidelines for total THMs and BDCM werereleased by Health Canada in May 2006 For more information go to Guidelines for Canadian Drinking Water Oualitv Supporting Documents
Why was the guideline updated in 20061 The new BDCM guideline is a result of new studies published since the last Canadian guideline on THMs was established In response to these new
findings Health Canada established aNational Chlorination Disinfection By Products Task Group It assessed the health risks from THMs and developed risk management options Health Canada
will continue to monitor new research in this area and recommend any changes to the guidelines when necessary What are the potential problems of having THMs in drinking water There is
concern among experts in Canada that THMs including BDCM may pose a risk in the development ofcancer Some studies report an association between elevated THMs and reproductive effects
though there is presently insufficient evidence to establish a specific relationship suggesting the need for more studies Exposure to BDCM at levels higher than the guideline value has
also been linked to a possible increase in the risk of reproductive effects increased risk for spontaneous abortion or stillbirth above what can normally be expected Again further study
is required It is important to note that BDCM levels in Saint John have not approached or exceeded the guideline The guidelines represent a level ofexposure that is deemed acceptable
by Health Canada for a typical life span 70 years and that will not cause an increased risk to health It takes into account all three methods of exposure ingestion inhalation and skin
absorption How are Canadians exposed to THMs in drinking water Canadians can be exposed to THMs when drinking tap water containing the chemical compounds Showering bathing and other
water use activities can also contribute to an individuals total exposure For example THMs can evaporate from the tap and be inhaled during showering or they can be absorbed through
the skin during bathing These types ofexposure have been considered in the guideline setting process Water that meets the total THMs and BDCM guidelines is considered safe for all domestic
uses including drinking bathing showering and food preparation Should pregnant women take special precautions While THMs may be a contributing factor to birth outcomes there are several
other influencing factors involved Exposure to BDCM levels in excess of the guideline has been linked to a possible increase in reproductive effects the New Brunswick Department of Health
recommends that pregnant women or women planning to become pregnant be aware of the BDCM levels in their water and take steps to reduce their intake ofthese substances Once again please
note that BDCM levels in Saint John have not approached or exceeded the guideline
If I m worried about THM levels in my water supply what can I do To reduce or eliminate THMs in drinking water use a water pitcher with an activated carbon filter install a tap mounted
carbon filter or to use bottled water When using a filter check to verify that it is certified to NSF Standards for removal of THMs and follow replacement instructions recommended by
the manufacturer Such devices if not properly maintained can become sources ofbacterial contamination in water When using bottled water check to verify that the supplier is a member
of the Canadian Bottled Water Association or the International Bottled Water Association Individuals may also want to keep the length of time spent in showers or baths to a minimum in
areas with elevated levels ofTHMs and BDCM in drinking water What if I have my own water well Most private well water supplies are not disinfected The lack of chlorine disinfection means
there should be no THMs or BDCMs present Why don t we simply stop chlorinating our drinking water Without adequate disinfection of our water supplies the health risks from micro organisms
would far outweigh the risks from THMs or BDCMs Drinking water is disinfected with chlorine to kill bacteria and viruses that can cause serious illnesses and deaths In fact chlorination
of drinking water has virtually eliminated typhoid fever cholera and many other diseases it represents one ofthe greatest achievements ofpublic health protection Secondly drinking water
disinfection is necessary because once the treated water leaves the treatment plant it may travel through water mains and pipes sometimes at significant distances before it reaches its
destination During this time it is necessary to maintain a residual level of disinfectant in the water to ensure no possible regrowth of micro organisms Without adequate disinfection
the health risks from microorganisms far outweigh the risks from THMs Do levels of THMs fluctuate Levels normally vary within a single water supply depending on the season water temperature
amount amount of natural organic matter in the water pH amount of chlorine used time the water is in the distribution system and other factors The concentration of chloroform one of
the four THM chemical compounds is approximately two to three times higher during summer months as during winter months
What is being done to reduce the levels of THMs in municipal drinking water The City of Saint John is working in conjunction with the New Brunswick Departments of Health and Environment
to monitor the level of THMs so that they are within the guideline of lOOIlgl The City of Saint John is currently collecting data through THM surveys analyzing data and identifying options
associated with THM formation reduction as part ofaTHM Action Plan In addition the City of Saint John is currently going through the process of preliminary design of new water treatment
facilities New treatment technologies can remove much of the organic matter prior to disinfection thus reducing the levels of by products while maintaining sufficient levels ofdisinfection
to kill micro organisms What are the alternate disinfectants Alternate disinfectants include chloramine chlorine dioxide ozone ultraviolet and others Each ofthese alternate disinfectants
have advantages and disadvantages regarding handling and storage disinfection by product formation and cost Following the initial disinfection at the treatment plant however the use
of some form of chlorine is still essential to maintain the required residual in the water distribution system in order to ensure microbiologically safe water How can I obtain information
about my drinking water quality If you are connected to the Saint John Water municipal water system Saint John Water staff are available at 658 4455 How do I test for THMs in my drinking
water Individuals on municipal water supplies do not need to have their water supply tested because the City of Saint John regularly monitors water quality Saint John Water currently
uses Caduceon Environmental Laboratories If you have a private well that does not mix chlorine with the water there should be no need to test for THMs However if you wish to have your
water tested please contact one of the following laboratories offering chemical analyses to obtain the proper sampling vial and how to properly collect a representative water sample

dans les approvisionnements d eau de surface partout au Canada L eau de surface approvisionne Saint John Le lac Latimer et Ie bassin hydrographique de Loch Lomond assurent la distribution

sur les THM A la suite de ces nouvelles decouvertes Sante Canada a cree un groupe de travail surles sous produits de desinfection au chIore Ce groupe de travail a evalue les risques
pour la sante associes aux THM et a elabore des solutions de gestion des risques Sante Canada continuera de surveiller les recherches dans ce domaine et de preconiser la modification
des recommandations au besoin Quels sont les risques potentiels associes aux taux de THM dans I eau potable Les specialistes du Canada craignent que les THM y compris Ie BDCM constituent
un risque dans Ie developpement du cancer Selon certaines etudes les THM pourraient avoir une une incidence nefaste sur les grossesses meme s il n y a presentement pas suffisamment de
preuves pour etablir ce lien avec precision des etudes plus poussees sont cependant necessaires L exposition it des concentrations de BDCM supeneures it la recommandation a egalement
ete associee it une augmentation possible du risque des effets sur la reproduction risque accru de fausse couche ou de mortinaissance au dessus des niveaux auxquels on peut s attendre
nonnalement Encore une fois des etudes plus poussees sont necessaires II importe de souligner que les concentrations de BDCM it Saint John n ont pas atteint ou depasse la recommandation
etablie La recommandation represente un niveau d exposition que Sante Canada juge acceptable pour toute la duree de la vie 70 ans sans risque accru pour la sante Elle tient compte des
trois moyens d exposition l ingestion linhalation etlabsorption cutanee De queUe fa on les Canadiens sont ils exposes aux THM presents dans Ieau potable Les Canadiens peuvent etre exposes
aux THM THM en consommant de l eau qui renfenne des composes chimiques Les douches les bains et d autres utilisations de leau peuvent egalement contribuer it l exposition individuelle
totale Par exemple les THM peuvent s evaporer du robinet et etre inhales pendant la douche ou ils peuvent etre absorbes par la peau pendant Ie bain Ces voies d exposition ont ete prises
en compte au moment de fonnuler la recommandation L eau qui respecte les recommandations concernant la concentration totale de THM et de BDCM est consideree comme securitaire pour toutes
les utilisations domestiques y compris la consommation les bains les douches et la preparation des aliments
Les femmes enceintes devraient elles prendre des precautions speciales Meme si les THM tout comme Ie BDCM peuvent avoir une incidence importante sur les issues de la grossesse plusieurs
autres facteurs decisifs entrent en ligne de compte Cependant Ie ministere de la Sante du Nouveau Brunswick recommande toujours aux femmes enceintes et aux femmes qui prevoient etre
enceintes de prendre connaissance des niveaux de THM et de BDCM dans leur eau et de prendre des mesures pour reduire leur consommation de ces substances Encore une fois il importe de
souligner que les concentrations de BDCM a Saint John nont pas atteint ou depasse la recommandation etablie Si les niveaux de THM et de BDCM presents dans mon eau me preoccupent que
puis je faire Afin de reduire ou d eliminer les THM dans l eau potable utilisez un filtre a charbon actif fixe a un pichet ou au robinet ou encore de l eau en bouteille Si vous utilisez
un filtre assurez vous qu il est conforme aux normes NSF pour enlever les THM et suivez les instructions de remplacement recommandees par Ie fabricant Ces appareils lorsqu ils ne sont
pas adequatement entretenus peuvent devenir source de contamination bacterienne de I eau Si vous utilisez de I eau en bouteille assurez vous que Ie fournisseur est membre de IAssociation
canadienne des embouteilleurs d eau ou de la International Bottled Water Association II est egalement recommande de reduire au minimum la duree des bains et des douches dans les regions
OU les niveaux deTHM et deBDCM dans l eau potable sont eleves Que dois je faire si je tire mon eau d un puits La plupart des reserves d eau de puits prives ne sont pas desinfectees L
absence de desinfection au chlore signifie qu aucun THM ou BDCM ne devrait etre present Pourquoi ne pas simplement cesser la chloration de I eau potable Si nous ne procedons pas a la
desinfection efficace de nos sources d eau potable les risques pour la sante poses par les micro organismes seront beaucoup plus importants que les risques associes a la presence de
trihalomethanes THM et de bromodichloromethane GDCM dans leau L eau potable est desinfectee par chloration afin d eliminer les bacteries et les virus susceptibles d entrainer des maladies
graves et Ie deces En fait la chIoration de leau potable apermis d eliminer presque entif rement la fievre typhoide Ie cholera et une multitude d autres maladies il s agit d une des
plus importantes reussites en matiere de protection de la sante publique Deuxiemement la desinfection de leau potable est necessaire etant donne que l eau traitee quitte l usine de traitement
des eaux et coule dans les conduites principales et les canalisations parfois sur une distance considerable avant d atteindre sa destination
Pendant cette etape il est necessaire de maintenir un niveau residuel de desinfectant dans l eau afin de prevenir toute revivification possible de micro organismes Si nous ne procedons
pas a la desinfection efficace les risques pour la sante poses par les micro organismes seront beaucoup plus importants que les risques associes a la presence de THM Les concentrations
de THM subissent elles des fluctuations Les niveaux varient habituellement dans une meme source d approvisionnement en eau en fonction de la saison de la temperature de l eau de la quantite
de matiere organique naturelle dans l eau du pH de la quantite de chlore utilise du temps passe dans Ie systeme de distribution d eau et de certains autres facteurs La concentration
de chloroforme un des quatre composes chimiques des THM est generalement de deux atrois fois plus elevee en ete qu en hiver Quelles demarches sont entreprises aftn de reduire la concentration
des THM dans Ieau potable municipale The City of Saint John collabore avec Ie ministere de la Sante et Ie ministere de lEnvironnement du Nouveau Brunswick afin de surveiller les niveaux
de THM pour s assurer qu ils respectent la recommandation etablie a 100 Jlgl A l heure actuelle The City ofSaint John recueille des donnees a laide d etudes d analyses de donnees et
de la determination d options de reduction des THM comme volet d un plan d action relatif aux THM En outre The City of Saint John examine a lheure actuelle des concepts preliminaires
pour de nouvelles installations de traitement des eaux Selon la nouvelle technologie relative au traitement des eaux une partie importante de la matiere organique peut etre extraite
avant la desinfection donc les niveaux de sous produits sont reduits tandis que la concentration de desinfectant demeure suffisante pour eliminer les micro organismes Quels sont les
autres desinfectants Les chloramines Ie dioxyde de chIore lozone les rayons ultraviolets entre autres sont des desinfectants Chacun de ces desinfectants comporte des avantages et des
desavantages en matiere d entretien et d entreposage de formation de sous produits de desinfection et de couts Cependant suivant la desinfection initiale a l usine de traitement lutilisation
d un melange queiconque de chlore est toujours essentielle afin de maintenir la concentration residuelle exigee dans Ie reseau de distribution d eau pour assurer une eau potable saine
du point de vue microbiologie
Comment puis je obtenir de I information sur la qualite de mon eau potable Si vous etes desservi par Ie reseau d aqueduc municipal de Saint John vous pouvez communiquer avec Ie personnel
du reseau au 658 4455 Comment puis je faire analyser mon eau potable pour detecter la presence de TOM Les personnes
utilisant Ie reseau municipal d approvisionnement en eau nont pas a faire analyser leur eau puisque The City of Saint John surveille regulierement la qualite de l eau Ces analyses ont

S jJ Whereas The City of Saint John pursuant to the authority ofthe Municipalities Act Chapter M 22 has enacted the Saint John Noise By Law And Whereas section 102 1 1 of the Municipalities
Act provides that an officer appointed by a municipality to administer aby law may enter upon any property for making any inspection that is necessary for the administration or enforcement
ofa by law and section 102 1 8 provides that such a person may apply for an entry warrant And Whereas section 101 of the Municipalities Act provides that proceedings for the breach of
aby law under that Act shall be commenced in the name ofthe clerk ofthe municipality or such other person as is designated for that purpose by the council It Is Hereby Resolved That
