PROCLAMATION
SAINT JOHN
WHEREAS: Little League Baseball has been played in Saint John
since 1951 when it was first chartered in Canada; and
WHEREAS: the 2009 Canadian Little League Senior Championship
will be held in Saint John from August 8th to 13th Five
teams from across the country will compete alongside
the host club for the senior baseball title. The players
are aged 13 - 16; and
WHEREAS- Little League is worldwide and the winner of this
tournament will go to the World Championships in
Bangor, Maine; and

NOW THEREFORE: 1, Mayor Ivan Court, _ -ate -
of Saint
John do hereby proclaim the week of August 81h to 13t11, 2009 as National
Senior Little League Baseball Week.

Re: Fairville Boulevard Corridor Improvement Plan
Context: Several weeks ago Council supported my motion to build on the valuable
recommendations which emerged from the West Side Retail Business Forum hosted by the City of Saint
John and Enterprise Saint John. Council should be commended for their support as it has allowed us to
move this economic growth file ahead.
Based on this motion, action was taken by Acting City Manager Pat Woods who convened a
meeting of City Staff, Enterprise Saint John and Ward One Councillors. Present at this meeting was Mr.
Paul Groody, Mr. Ken Forrest, Mr. Bernie Morrison, Mr. Tim O'Reilly, Mr. Jay Reid representing
Enterprise Saint John, Councillor Farren and myself, Our goal was to begin an exchange of open
dialogue between departments and with Enterprise Saint John with respect to turning
recommendations made at the retail forum into a plan of action.
Some of the progressive ideas which were discussed at this meeting included: allowing for more
access for pedestrians to developments, creating a shopping atmosphere that will make developments
more user friendly for residents and establishing a forum whereby City Staff, Enterprise Saint John and
retailers can exchange ideas with respect to retail growth.
This initial meeting was a strong beginning. All ideas are at a conceptual stage and Council will
be fully briefed as we move forward.
Motion: That this report be received for information.

Deputy Mayor and Councillors,
The Committee of the Whole, having met on August 4, 2009, makes the following
recommendation:
13.3 Committee of the Whole: Pension Entitlements-City Manager Position
of May, 2002:
That the following resolution adopted' by Common Council on the 13i" day
1. That, effective December 16, 2001, the salary for the position of City Manager be set at an
amount equal to the top level in the management pay scale as approved by Council on an
annual basis, divided by a factor of .8.
2. That the City provide the appointee to the position of City Manager with a supplemental
pension calculated as 2%m of the annual salary at the date of retirement for each of the five years
of service commencing December 16, 2001.
3. That the City Manager be provided with the option of retiring any time after he or she reaches
the age of 55, with a pension as calculated under Section 10(2) of the City of Saint John
Pension Act and, should the employee select this option, his or her pension shall be calculated
as per the City of Saint John Pension Act as of the employee's retirement date and compared to
that as calculated with sole reference to Section 10(2) of the Act, and this calculation shall be
made once on the date of retirement and, should the amount calculated under the appropriate
provisions of the Act be less than the amount as calculated under Section 10(2), the City shall
annually pay the amount to the employee in the same manner as the employee's pension as
stipulated in Section 10(3) of the Act. "

The Committee of the Whole, having met on August 4, 2009, makes the following
recommendation:
13.4 Committee of the Whole: Section 74 of the Municipalities Act and Contracting with
Senior Officers
That the following resolution be adopted:
"That Section 74 of the Municipalities Act be amended so as to provide a municipality with the
option, exercisable at the time of creating an employment relationship, of establishing the
duration of employment for a person occupying a position referred to in Section 74"
And further that the City Solicitor be directed to initiate the legislative amendment process.
And further that the Common Clerk be directed to submit the resolution, in the appropriate
format, to the Cities of New Brunswick Association.
