DISCUSSION CouncilandPACneedtobeawarethatthispieceoflegislationintroducesanumberof significantchangestohowplanningisimplementedinNewBrunswick. Thesechangeswill directlyimpactstaffandthePlanningAdvisoryCommitteeinparticular. VariancesfromtheZoningBylaw Ofmostsignificance,thelegislationprovidesauthoritytotheDevelopmentOfficertomake decisionsonmanyapplicationsforZoningBylawvariances. Thesepowerswereexclusivelythe domainofthePlanningAdvisoryCommitteeinthepast.Specifically,thelegislationgivesthe DevelopmentOfficertheauthoritytograntorrefusethefollowingtypesofvariancerequests identifiedinSection34(3)(a)oftheCommunityPlanning Act: (i)theminimumsizeanddimensionsoflotsandotherparcelsintowhichlandmaybe subdivided,andtheminimumsizeanddimensionsoflandrequiredforanyparticular classofuseorsizeofbuildingorstructure, (iii)theheight,numberofstoreys,groundarea,floorareaandbulkofbuildingsand structures, (iv)thepercentageoflandthatmaybebuiltupon,andthedepth,sizeorareaofyards, courts,parkingareasandopenspaces, (v)theplacement,locationandarrangementofbuildingsandstructures,includingtheir settingbackfromtheboundariesofstreetsandotherpublicareas,andfromrivers, streamsorotherbodiesofwater, (vii)theplacement,heightandmaintenanceoffences,walls,hedges,shrubs,treesandother objects, (viii)thetypes,dimensionsandlocationofmeansofaccessoflotstostreets, (ix)thefacilitiestobeprovidedandmaintainedforoff-streetparkingandloadingof vehicles, (xiii)thelocation,dimensions,standardsofconstructionandpurposesofpublicadvertisement. Thislegislativeapproachis similartotheprocessusedinotherCanadianprovinces. Theoperationalprocedurehasbeenprovided fortheinformationofCouncil(andwillalsobeprovidedtothePlanningAdvisoryCommittee). Itisproposedthatthesenewproceduresandtheauthorityprescribedbythelegislationwillbe implementedconcurrentlybyeachoftheplanningagenciesidentifiedaboveinJuly,2009.
