Deputy Mayor White called the meeting to order with Pastor Don Ingersoll
offering the opening prayer.

Sunday Opening of The Saint John City Market resulting from an unscheduled visit of
the 'Grandeur of the Seas' Cruise Ship on October 19, 2003.

Number C-115-24 A By-law To Amend The By-law Relating To The Market In The City
Of Saint John" with regard to being open from 8:00 AM. until 4:00 P.M. on October 19,

2003 be read a third time and enacted and the Corporate Common Seal be affixed
thereto.

3A. Property Acquisition - 330 Charlotte Street
On motion of Councillor Trites
Seconded by Councillor Court
RESOLVED that the Agreement of Purchase and
Sale respecting land commonly referred to as the former Sugar Refinery Site, the
execution of which was authorized by Common Council at its meeting of September 22,
2003, be amended as follows: (1) PID Number 00018291 referred to in paragraph 2 be
deleted; (2) PID Number 55147482 be added to line 5 of paragraph 1; (3) that the
following be added as paragraph 2(b): That the Vendor agrees to assign to the
Purchaser all of the former's interest, rights, and privileges held under License No.
35312 given by Canadian National Railway Company to Atlantic Sugar Refineries
Limited dated May 30, 1967; and as recommended by the City Solicitor, in the event that
Lantic Sugar Limited is, for want of consent to assignment and release of covenants
from Canadian National Railway Company and/or want of consent to assignment from
Saint John Port Corporation; unable to complete the Purchase and Sale of the former
Sugar Refinery Site on October 20,2003 (the Closing Date) the Mayor and Common
Clerk are hereby authorized to execute a further amendment to the Agreement of
Purchase and Sale as amended whereby the Closing Date is extended to "on or before
November 30, 2003".
Question being taken, the motion was carried with Councillor Teed voting
nay.
3A. Acquisition d'un terrain situe au 330. rue Charlotte

QUE Ie contrat de vente relatif au terrain
communement appele terrain de I'ancienne raffinerie de sucre, dont Ie conseil a autorise
la signature au cours de la reunion du 22 septembre 2003, soit modifie comme suit:
1) suppression du NID 00018291, auquel on fait mention au paragraphe 2; 2) ajout du
NID 55147482 a la 5e ligne du paragraphe 1; 3) ajout du texte suivant au paragraphe
2b) : Que Ie vendeur accepte de ceder a I'acquereur tous les interets, droits et privileges
anterieurs qu'il detient aux termes du permis nO 35312 qu'a delivre la Compagnie des
chemins de fer nationaux du Canada a Atlantic Sugar Refineries Limited en date du
30 mai 1967; et, comme Ie recommande I'avocat municipal, advenant que Sucre Lantic
Limitee, a defaut de consentir a la cession et a la liberation des clauses de la
Compagnie des chemins de fer nationaux du Canada ou a defaut de consentir a la
liberation de la Societe des ports de Saint John, ne peut mener a bien la vente du terrain
de I'ancienne raffinerie de sucre Ie 20 octobre 2003 (date de cloture), que Ie maire et Ie
greffier soient autorises a signer une autre modification au contrat de vente par lequella
date de cloture serait prolongee << au plus tard Ie 30 novembre 2003 >>.
A I'issue du vote, la proposition est adoptee, Ie conseiller Teed ayant vote
contre.
5. Request of Rolv Mclntvre. MLA to Present to Council on Red Head Road
On motion of Councillor Trites
Seconded by Councillor Titus
RESOLVED that the request of Roly Mcintyre to
present to Council on October 20, 2003 on the subject of the need for a secondary
access road in Red Head, arising from a public meeting on the proposed LNG project at
Canaport be approved.

5. Demande de Roly Mcintyre, membre de I'assemblee legislative, en vue de faire
une presentation au conseil au suiet du chemin Read Head
Proposition du conseiller Trites
Appuyee par Ie conseiller Titus
QUE la demande de Roly Mcintyre en vue de
faire une presentation devant Ie conseille 20 octobre 2003 sur la necessite d'un chemin
d'acces secondaire dans Ie secteur de Read Head, a la suite d'une reunion publique sur
Ie projet de gaz naturelliquefie (GNL) propose a Canaport, soit adopte.
A I'issue du vote, la proposition est adoptee.
4. Red Head Secondary Access Road
On motion of Councillor Trites
Seconded by Councillor Fitzgerald
RESOLVED that the letter from Councillor Chase
regarding a secondary access road raised at a public meeting on the proposed LNG
project at Can aport be deferred to the next meeting of Council following Mr. Mcintyre
and his delegation's presentation on the same issue on October 20, 2003.

4. Chemin d'acces secondaire Read Head

QUE I'examen de la lettre du conseiller Chase au
sujet d'un chemin d'acces secondaire aborde lors d'une reunion relative au projet GNL
propose a Canaport soit reporte a la prochaine reunion du conseil qui suivra la
presentation de M. Mcintyre et de sa delegation sur cette question Ie 20 octobre 2003.
