Approval of AQenda & *Added Items The Mayor asked to add a proclamation to the agenda of this meeting regarding Environment Week, and Councillor Titus asked to add an item with regard to a forthcoming presentation to Council by the Saint John Fire Fighters' Association, Local 771, IAFF. On motion of Councillor Desmond Seconded by Councillor Court RESOLVED that the agenda of this meeting be approved, with the addition of a proclamation and an item regarding a forthcoming presentation to Council by Local 771 as items 3A and 3B, respectively. Question being taken, the motion was carried. 3. Presentation Bv Local 771 Councillor Titus, referring to a forthcoming presentation by Local 771 on the manning level of Rescue 3 further to its request to Council on April 14, 2003, expressed the opinion that Council, in order to get a balanced view, should request, through the City Manager, a report from the Fire Chief, as to the rationale behind the decision-making process. On motion of Councillor Titus Seconded by Councillor Court RESOLVED that the City Manager be requested to prepare a report for presentation to Council in conjunction with the forthcoming presentation by Local 771 as to the rationale for the decision regarding Rescue 3. A I'issue du vote, la proposition est adoptee. 4. Sale Of Land To Maber & Somerville Joint Venture Ltd. Consideration was given to a report from the City Manager referring to Common Council resolution of July 7, 1997 authorizing an agreement(s) with Maber & Somerville Joint Venture Ltd. to facilitate the construction of a new sewerage treatment facility in the Kennebecasis Bay area and the collection of a levy, and granting Maber & Somerville an option to purchase 35 acres (more or less) of property along Sandy Point Road having NBGIC Numbers 55059067 and 55059083, upon the commissioning of the new sewerage treatment facility, and noting the reference to the proposed sale in the April 14, 2003 report to Council pertaining to the Sandy Point Road water extension project, such sale having been delayed and the terms of sale altered due to the additional infrastructure issues affecting the Kennebecasis Bay area. The report advises of staff's meeting with the owners of Maber & Somerville to discuss the proposed lot levy and sale price at which time Maber & Somerville offered to purchase the property for $136,400 and agreed to a lot levy of $4,428 per lot; and expresses the view that, although a recent offer from Peter Pappas was $23,600 more than that offered by Maber & Somerville, to choose another path than that proposed herein would not benefit the City and any additional land sale revenue that might arise out of a sale of the subject land to Mr. Pappas would be lost in legal fees while the courts sorted out what damages Maber & Somerville might be eligible for due to a change in direction. The report compares the proposed property sale to a number of other land sales within the northern portion of the City, it having been mentioned several times in the past that the City is not receiving fair market value for its land and, more specifically, that the subject land is under-valued; also advises that new development opportunities that will be created as a result of the Sandy Point Road water extension project will be brought to the attention of Mr. Pappas and other developers who have expressed an interest in developing the subject area; and recommending the subdivision and sale of the subject property. On motion of Councillor Trites Seconded by Deputy Mayor White RESOLVED that as recommended by the City Manager, The City of Saint John subdivide and sell a 34 acre :t portion of PID Numbers 55059067 and 55059083, being City land along Sandy Point Road as generally shown on the submitted plan, to Maber & Somerville Joint Venture Ltd. (the Buyer) for $136,400 (plus HST, if applicable), on or before October 30,2003, subject to an agreement between the City and the Buyer, where the Buyer agrees: (a) to the payment of a lot levy in the amount of $4,428 (plus HST, if applicable) for each and every lot created on the subject land, due payable to The City of Saint John at the time of subdivision approval, meaning that the Development Officer or his designate will not stamp and sign the approved subdivision plan until the applicable levy payment is received for the number of lots being created on the said plan; (b) the subject land be bound with a restriction prohibiting development until such time as the City extends and puts into operation water and sanitary sewer services to and along Sandy Point Road connecting with existing services under and along Kennebecasis Drive; (c) the City is neither explicitly nor implicitly obligated to extend any municipal services to and along Sandy Point Road to Kennebecasis Drive; and (d) in the event the subject land is sold in whole, or in part, save and except as building lots created by an approved subdivision plan, the Buyer (or its successors in title) shall extract a like covenant (for the aforesaid development restriction and lot levies) from the purchaser(s); and further that the Mayor and Common Clerk be authorized to execute the transfer and related documents. 89-742 COMMON COUNCIUREUNION DU CONS ElL MUNICIPAL MAY 26, 2003/LE 26 MAl 2003 Councilor Teed advised his opposition to the motion on the basis that the City would be giving land away at a very low price with no commitment as to when it would be developed. Question being taken, the motion was carried with Councillor Teed voting "nay". 4. Vente d'un terrain a Maber & Somerville Joint Venture Ltd. Examen d'un rapport du directeur general relatif a la resolution du conseil municipal du 7 juillet 1997 autorisant I'entente intervenue avec Maber & Somerville Joint Venture Ltd. en vue de faciliter la construction d'une nouvelle installation de traitement des eaux usees dans Ie secteur de la baie Kennebecasis et Ie prelevement d'un imp6t, et accordant a Maber & Somerville une option pour I'achat de 35 acres (environ) de terrain Ie long du chemin Sandy Point (nOS NBGIC 55059067 et 55059083) au moment de la mise en service de la nouvelle installation de traitement des eaux usees. Le rapport fait egalement etat du fait que Ie projet de vente dont il est fait mention dans Ie rapport presente au conseille 14 avril 2003 relativement au projet de prolongement du reseau d'aqueduc dans Ie secteur du chemin Sandy Point a ete retarde et que les conditions de vente ont ete modifiees en raison des travaux d'infrastructure supplementaires requis dans Ie secteur de la baie Kennebecasis. Le rapport fait etat d'une rencontre de membres du personnel avec les proprietaires de Maber & Somerville afin de discuter du prix de vente et de la possibilite de prelever un imp6t. Au cours de cette rencontre, Maber & Somerville a propose de faire I'acquisition du terrain pour la somme de 136 400 $ et a accepte un imp6t de 4 428 $ par lot. Le rapport ajoute que, meme si I'offre recente de M. Peter Pappas est superieure de 23 600 $ a celie de Maber & Somerville, il ne serait pas avantageux pour la Ville de privilegier une autre option que celie qui est proposee etant donne que les profits supplementaires qui pourraient etre realises par la vente du terrain en question a M. Pappas serviraient a couvrir les frais juridiques engages pour que les tribunaux etablissent Ie montant des dommages et interets auxquels pourrait avoir droit Maber & Somerville a la suite de cette volte-face. Le rapport compare Ie projet de vente de ce terrain a la vente d'autres terrains dans la partie nord de la ville, constatant qu'on a affirme a plusieurs reprises dans Ie passe que la Ville n'obtient pas une juste valeur marchande pour la vente de biens immobiliers et, plus particulierement, que Ie terrain en question est sous-evalue. Le rapport indique en outre que Ie projet de prolongement de I'aqueduc dans Ie secteur du chemin Sandy Point donnera lieu a de nouvelles possibilites de lotissement qui seront portees a I'attention de M. Pappas et d'autres promoteurs qui se montres interesses a amenager Ie secteur en question et recommande Ie lotissement et la vente dudit terrain. Proposition du conseiller Trites Appuyee par Ie maire suppleant White Comme Ie recommande Ie directeur general, QUE The City of Saint John procede au lotissement d'une partie des terrains municipaux portant les nOs 55059067 et 55059083 et ayant une superficie d'environ 34 acres, Ie long du chemin Sandy Point comme I'indique de maniere generale Ie plan presente, en vue de la vente a Maber & Somerville Joint Venture Ltd. (I'acquereur) pour la somme de 136400 $ (plus TVH, s'il ya lieu), au plus tard Ie 30 octobre 2003, sous reserve de la signature d'une entente entre la Ville et I'acquereur qui accepte : a) de s'acquitter d'un imp6t de 4 428 $ (plus TVH, s'il ya lieu) pour chaque lot constitue sur Ie terrain en question, payable a The City of Saint John au moment de I'approbation du lotissement, ce qui signifie que I'agent de developpement ou son representant n'estampillera pas et ne signera pas Ie plan de lotissement approuve tant que l'imp6t applicable correspondant au nombre de lots figurant sur ledit plan n'aura pas ete acquitte; b) que Ie terrain en question so it soumis a une restriction interdisant de proceder a I'amenagement tant que Ie reseau d'aqueduc et d'egout n'a pas ete prolonge et mis en service Ie long du chemin Sandy Point et qu'il n'a pas ete raccorde aux services existants sous la promenade Kennebecasis et Ie long de cette promenade; c) que la Ville n'a pas I'obligation explicite ou implicite de prolonger les services municipaux Ie long du chemin Sandy Point jusqu'a la promenade Kennebecasis; d) dans Ie cas ou Ie terrain en question est vendu, en totalite ou en partie, sauf en tant que parcelles constructibles figurant sur un plan de lotissement approuve, I'acquereur (ou ses ayants droit) accepte d'imposer une disposition semblable (relativement a la restriction en matiere d'amenagement et a l'imp6t sur les lotissements) aux acheteurs; et que Ie maire et Ie secretaire municipal soient autorises a signer les documents de transfert et les documents connexes. 89-743 COMMON COUNCIUREUNION DU CONS ElL MUNICIPAL MAY 26, 2003/LE 26 MAl 2003 Le conseiller Teed s'oppose a la proposition, considerant que la Ville s'apprete a vendre des terrains a rabais sans obtenir d'engagement quant au debut des travaux d'amenagement. A I'issue du vote, la proposition est acceptee, Ie conseiller Teed ayant vote contre. 5. Sale Of Land On Greenhead Road On motion of Deputy Mayor White Seconded by Councillor Fitzpatrick RESOLVED that as recommended by the City Manager, The City of Saint John sell PID Number 468322, being land on Greenhead Road, to Maguire Excavating Ltd., for $4,000 (plus HST, if applicable), on or before November 30,2003, subject to the following terms of sale: (1) the lot be filled and brought to road grade (t 45 cm) prior to the issuance of a building permit for residential construction purposes, and (2) the buyer acknowledges the presence of a sanitary sewer pumping station situated on PID Number 405951 (the adjacent lot) and the buyer agrees to extract a like acknowledgement from subsequent buyers; and further that the Mayor and Common Clerk be authorized to execute the transfer documents. Question being taken, the motion was carried. 5. Vente d'un terrain situe sur Ie chemin Greenhead Proposition du maire suppleant White Appuyee par Ie conseiller Fitzpatrick Comme Ie recommande Ie directeur general, QUE The City of Saint John vende Ie terrain portant Ie NID 468322, situe sur Ie chemin Greenhead, a Maguire Excavating Ltd. pour la somme de 4 000 $ (plus TVH, s'il y a lieu), au plus tard Ie 30 novembre 2003, sous reserve des conditions suivantes : 1) que Ie terrain soit remblaye au niveau de la route (t 45 cm) avant qu'un permis de construire a des fins residentielles ne soit delivre; 2) que I'acquereur soit informe de la presence d'un poste de pompage d'eaux d'egout sur Ie terrain portant Ie NID 405951 (lot adjacent) et qu'il accepte d'en aviser les acheteurs subsequents; et que Ie maire et Ie secretaire municipal soient autorises a signer les documents de transfert. A I'issue du vote, la proposition est adoptee. 6. Tender For Contract 2003-1 Consideration was given to a report from the City Manager advising that two tenders were received for Contract 2003-1, Rothesay Avenue (Route 100) street reconstruction, McLean Street to Sunnyside Avenue - Debly Enterprises Ltd. in the amount of $2,091,981.03 (Option #1 - Night), $2,091,981.03 (Option #2 - Day), and Galbraith Construction Ltd. - $3,250,384 (Option #1 - Night), $2,397,579 (Option #2 - Day), the Engineer's estimate for the work being $2,241,978 (Option #1 - Night), $2,142,413 (Option #2 - Day); also advising that the tender of Debly Enterprises Ltd. was not signed in Division 4.2.02 (Performance Bond) to indicate the type of performance surety to be employed and, with respect to the tender of Galbraith Construction Ltd., there was no indication in Division 4.3.05 (Tenderer's Plant) as to the location of the shale pit or rock quarry for the supply of necessary materials; and setting out the reasons why, having consulted with the City Solicitor on this matter, the absence of a signature in the Performance Bond section of Division 4.2 does not render Debly Enterprises Ltd.'s bid non-compliant and, furthermore, the absence in question neither provides a material advantage to Debly Enterprises Ltd., works a material disadvantage to the other tenderer, nor prejudices the City's interests. The report further advises that staff is of the opinion that the low tenderer has the necessary resources and expertise to perform the work and, accordingly, is recommending that, once a choice is made between day time and night time options, the Contract be awarded to the low tenderer; and recommends that Common Council adopt the resolution as set out. On motion of Deputy Mayor White Seconded by Councillor Desmond RESOLVED that having considered the tender submitted for Contract 2003-1, Rothesay Avenue (Route 100) street reconstruction, it is Common Council's determination that, in the absence of a signature 89-744 COMMON COUNCIUREUNION DU CONS ElL MUNICIPAL MAY 26, 2003/LE 26 MAl 2003 in the "Performance Bond" section of Division 4.2. of the Debly Enterprises Ltd. tender does not render it non-compliant for the following reasons: (a) the statements in Division 4.2.02 are but commitments to negotiate a performance bond or supply a certified cheque in lieu thereof at some unspecified future date; (b) Division 4.2.02 does not require the submission of "performance security with the tender"; (c) there is no time limit within which to supply the bonds required other than that found at Division 2.14 of the Contract Specifications which requires a successful tenderer to do so within one week of acceptance of the tender; (d) said Division 2.14 also provides that failure to supply bonds within one week of the City's acceptance of the tender will automatically mean the forfeiture to the City of the tender deposit or enforcement of the bid bond, in this case, an amount of $180,000 having been supplied by a certified cheque; (e) the requirement to provide "performance" security is in keeping with the custom and trade respecting contracts of this nature and is consistent with the City's past practice and the requirements of the Contract Specifications for this work; (f) Division 6 of the City's General Specifications which form part of the Contract Specifications for this work provides in Section 6.6.04 that the City will accept a certified cheque in lieu of the performance bond and the labour and material payment bond, but does not there provide a deadline for the supply of that cheque; (g) there is no requirement in the Contract Specifications for this work that such a certified cheque or performance bond be submitted with the tender, and signature at Division 4.2.02 is only a commitment to get one or the other in the future; (h) since the only requirement to supply bonding other than bid bonding is to do so within one week of the acceptance of the tender, as stipulated in Division 2.14 aforesaid, the same time requirement applies to the supply of a certified cheque in lieu thereof; (i) the City will require, pursuant to the terms of the Contract Specifications for this work, the supply of bonding or a certified cheque in lieu thereof within a week of acceptance of the tender; and U) a discretion exists in the City under Division 4.2 to accept as a compliant tender one in which Division 4.2, "Form of Tender Division 4" has not been completed; and furthermore and consequently the absence in question neither provides a material advantage to Debly Enterprises Ltd., works a material disadvantage to the other tenderer, nor prejudices the City's interests: AND BE IT FURTHER RESOLVED that, once Common Council chooses between the day time and night time options for the execution of work under Contract 2003-1, Rothesay Avenue (Route 100) street reconstruction, a resolution shall be adopted awarding the said Contract 2003-1 to Debly Enterprises Ltd. at the tendered price of $2,091 ,981.03, as calculated based upon estimated quantities and authorizing the Mayor and Common Clerk to execute the necessary contract documents. Note was made of the letter from Debly Enterprises Ltd., under agenda item 11, and during discussion Mr. Nugent made the observation that this was a rather unusual arrangement with which Council was dealing and different from other contracts as Council at this time was not awarding the contract but rather making a commitment to award it to the low tenderer after deciding, based on a further recommendation from the City Manager, which of the two options to pursue - the day or night time option. As to whether the work could be done on a combination-basis of day and night time, Mr. Groody advised that staff would like the opportunity to review the low tenderer's plan, speak to the contractor and the East Saint John Business Association and come back to Council as part of the normal award process with a recommendation, and noted that the Contract Specifications provided that the asphalt and concrete curb and sidewalk portion of the work be done in the day time. Question being taken, the motion was carried. 6. Soumission pour Ie contrat 2003-1 Examen d'un rapport du directeur general indiquant que deux soumissions ont ete reyues pour Ie contrat 2003-1 relatif a la refection de I'avenue Rothesay (route 100), de la rue McLean a I'avenue Sunnyside: la soumission de Debly Enterprises Ltd. s'eleve a 2 091 981,03 $ (option 1 - horaire de nuit) et a 2 091 981,03 $ (option 2 - horaire de jour), tandis que celie de Galbraith Construction Ltd. s'eleve a 3250384 $ (option 1 - horaire de nuit) et a 2397579 $ (option 2 - horaire de jour), Ie cout des travaux etant estime a 2 241 978 $ (option 1 - horaire de nuit) et a 2 142 413 $ (option 2 - horaire de jour) par I'ingenieur municipal. Le rapport precise en outre que la soumission de Debly Enterprises Ltd. n'a pas ete signee a la Section 4.2.02 (Garantie de bonne execution) pour indiquer Ie type de cautionnement d'execution prevu et, en ce qui concerne la soumission de Galbraith Construction Ltd., la Section 4.3.05 (Etablissement du soumissionnaire) ne comporte aucune indication relative a I'emplacement de la 89-745 COMMON COUNCIUREUNION DU CONS ElL MUNICIPAL MAY 26, 2003/LE 26 MAl 2003 carriere d'ou seraient extra its les materiaux necessaires (pierre ou argile). Le rapport expose les raisons pour lesquelles, de I'avis de I'avocat municipal, I'absence de signature a la Section 4.2 (Garantie de bonne execution) ne rend pas invalide la soumission de Debly Enterprises Ltd. et, en outre, ne procure pas un avantage important a Debly Enterprises Ltd., ne constitue pas un desavantage important pour I'autre soumissionnaire et ne nuit pas aux interets de la municipalite. Le rapport signale enfin que Ie personnel est d'avis que Ie soumissionnaire moins-disant possede les ressources et Ie savoir-faire necessaires pour executer les travaux et recommande, par consequent, une fois qu'on aura choisi d'opter pour I'horaire de jour ou I'horaire de nuit, d'accorder Ie contrat au soumissionnaire moins-disant. II recommande egalement au conseil municipal d'adopter la resolution telle quelle. Proposition du maire suppleant White Appuyee par Ie conseiller Desmond IL EST RESOLU, apres I'examen de la soumission presentee pour Ie contrat 2003-1 relatif a la refection de I'avenue Rothesay (route 100), que Ie conseil municipal estime que I'absence de signature a la Section 4.2. (Garantie de bonne execution) de la soumission de Debly Enterprises Ltd. ne la rend pas invalide pour les raisons suivantes : a) les declarations a la Section 4.2.02 ne constituent que des engagements en vue de negocier une garantie de bonne execution ou de fournir un cheque certifie en tenant lieu a une date ulterieure indeterminee; b) la Section 4.2.02 n'exige pas que la soumission so it accompagnee d'un cautionnement d'execution; c) aucun delai n'est fixe pour la production des cautionnements requis a I'exception de ce que prevoit la Section 2.14 (Modalites du contrat) qui stipule que I'entreprise retenue doit s'acquitter de cette obligation dans un delai d'une semaine suivant I'acceptation de la soumission; d) la Section 2.14 prevoit egalement que Ie defaut de fournir les cautionnements requis dans la semaine suivant I'acceptation de la soumission par la Ville entralne automatiquement la perte du depot ou I'execution du cautionnement de soumission, soit, en I'occurrence, une somme de 180 000 $ sous la forme d'un cheque certifie; e) la necessite de fournir un cautionnement d'execution constitue une pratique courante dans les contrats de cette nature et est compatible avec la fayon habituelle de la Ville de proceder et les modalites du contrat fixees pour la realisation des travaux; f) la Section 6.6.04 des Specifications generales qui font partie des Modalites du contrat etablies pour ces travaux stipule que la Ville peut accepter un cheque certifie au lieu d'une garantie de bonne execution et d'un cautionnement de paiement sans toutefois fixer de delai pour la production de ce cheque; g) les Modalites du contrat etablies pour ces travaux ne stipulent pas que Ie cheque certifie ou la garantie de bonne execution doit accompagner la soumission, et la signature a la Section 4.2.02 ne constitue qu'un engagement a fournir I'un ou I'autre a une date ulterieure; h) puisque la seule exigence relative au depot d'une caution autre qu'un cautionnement de soumission consiste a s'acquitter de cette obligation dans la semaine suivant I'acceptation de I'offre, comme Ie stipule la Section 2.14 precitee, Ie meme delai s'applique a la production du cheque certifie en tenant lieu; i) la Ville exigera, conformement aux Modalites du contrat etablies pour ces travaux, qu'un cautionnement ou un cheque certifie en tenant lieu soit fourni dans la semaine suivant I'acceptation de la soumission; j) conformement a la Section 4.2, la Ville se reserve Ie droit de considerer comme conforme et d'accepter une soumission dont la Section 4.2 intitulee Formule de soumission - Section 4 n'a pas ete remplie; par consequent, I'omission en question ne procure pas un avantage important a Debly Enterprises Ltd., ne constitue pas un desavantage important pour I'autre soumissionnaire et ne nuit pas aux interets de la municipalite. ET QUE, une fois que Ie conseil municipal aura decide s'il opte pour I'horaire de jour ou I'horaire de nuit pour I'execution des travaux vises par Ie contrat 2003-1 relatif a la refection de I'avenue Rothesay (route 100), une resolution soit adoptee en vue d'attribuer Ie contrat 2003-1 a Debly Enterprises Ltd. au prix offert de 2 091 981,03 $, etabli a partir de quantites estimatives, et d'autoriser Ie maire et Ie secretaire municipal a signer les documents contractuels necessaires. Steven D. Latimer of 1845 Golden Grove Road and Janice Kirkpatrick of 4 Timberview Drive appeared in opposition to the proposed re-zoning, having signed the petition in opposition to any type of licenced establishment that sells alcohol at the subject location, submitted with the above correspondence from the Planning Advisory Committee; and Mr. Latimer, in addressing Council, referenced a previous attempt by a former owner of the property to obtain such a licence, as well as the applicant's intent to install video lottery terminals (VL Ts) if the re-zoning were approved. Mr. Latimer expressed concern that the applicant might decide to turn the restaurant into a lounge and, in noting the residential nature of the area where it is relatively safe for people to walk or ride bicycles, advised that he did not want that to change. Jeffrey Benson of 1593 Golden Grove Road spoke in opposition to the proposal, expressing concern about safety in that a liquor-licenced establishment could mean impaired drivers in an area with a windy road, no sidewalks and in some places no shoulders, where children and other people walk. Sharon Gordon of 2401 Golden Grove Road, stated her support for the proposal as part owner of the establishment, on the basis that she did not anticipate an increase in road traffic and VL Ts would generate income for small business owners like herself which results in tax dollars for the City; and expressed the opinion that people go to bars to drink not eating establishments. Referring to the petition in support of the proposal submitted with the Planning Advisory Committee's report, Ms. Gordon advised that those who signed it were customers who frequent their store and, with their 89-759 COMMON COUNCIUREUNION DU CONS ElL MUNICIPAL MAY 26, 2003/LE 26 MAl 2003 proposal, it was hoped that some people who were currently going to other establishments to use the VL T machines would come to their establishment. (Councillor Court re-entered the meeting during the above presentation.) Ryan Thorne of 1925 Golden Grove Road appeared in support of the proposed re-zoning, and expressed the view that there should be no increase in traffic on the Golden Grove Road as people would not likely travel from other parts of the City to the proposed establishment. Russell Press of 1885 Golden Grove Road spoke in support of the proposal as the owner and occupier of the property immediately west of the subject property in that, if there were one family in the area who would have cause for concern, it would be his, and his only concern was what would happen to the property business next door if the zoning proposal were declined. Mr. Press asked Council to approve the re-zoning application to allow the Gordons to be more competitive with other establishments in the area. Leonard Beaulieu of 109 Green Lake Crescent appeared in support of the application, his view being that the lack of sidewalks should not make a difference as people do not always use them and he did not expect any more impaired drivers than what was there at the present time. On motion of Councillor Desmond Seconded by Councillor Fitzgerald RESOLVED that with regard to the application of Bruce Gordon for the re-zoning of property located at 1925 Golden Grove Road, the re-zoning be denied. M. Latimer craint que Ie requerant ne decide de convertir Ie restaurant en salon-bar et, soulignant Ie caractere residentiel de ce secteur ou les gens peuvent se promener a pied ou a bicyclette en securite, dit souhaiter que la situation ne change pas. Jeffrey Benson, qui demeure au 1593, chemin Golden Grove, fait part de son opposition au projet et se dit inquiet a propos de la securite etant donne qu'en raison de la presence d'un etablissement possedant un permis d'alcool, des conducteurs en etat d'ebriete risquent de circuler sur la route sinueuse sans trottoir, et sans accotement a certains endroits, ou marchent des enfants et d'autres personnes. En tant que coproprietaire de I'etablissement, Sharon Gordon, qui reside au 2401, chemin Golden Grove, se dit en faveur du projet etant donne qu'elle ne prevoit pas d'augmentation de la circulation routiere et que les appareils de loterie video generent des revenus pour les proprietaires de petits commerces comme Ie sien, qui paient des impots a la Ville. Elle ajoute que les gens se rendent dans les bars, plutot que dans les restaurants, pour boire. En ce qui concerne la petition en faveur du projet, qui accompagne Ie rapport du comite consultatif d'urbanisme, Mme Gordon affirme que les signataires de la petition sont des clients qui frequentent son etablissement et elle espere que Ie projet permettra d'attirer dans son etablissement ceux qui se rendent ailleurs pour utiliser les appareils de loterie video. (Le conseiller Court se joint de nouveau a la reunion au cours de la presentation. ) Ryan Thorne, demeurant au 1925, chemin Golden Grove, se montre en faveur du projet de rezonage et affirme qu'il ne devrait pas y avoir d'augmentation de la circulation sur Ie chemin Golden Grove etant donne qu'il etait peu probable que les gens qui habitent d'autres quartiers de la ville se rendent a I'etablissement propose. En tant que proprietaire et occupant du logement a I'ouest de la propriete en question, Russell Press, qui reside au 1885, chemin Golden Grove, se dit en faveur du projet, affirmant que, si une famille du secteur devait eprouver des inquietudes, ce serait la sienne et se disant plutot preoccupe par I'avenir du commerce voisin en cas de refus du projet de rezonage. M. Press demande au conseil d'approuver la demande de rezonage afin de permettre a I'entreprise des Gordon d'etre plus concurrentielle dans Ie secteur. Leonard Beaulieu, qui demeure au 109, croissant Green Lake, se dit en faveur de la demande, indiquant que I'absence de trottoirs ne changerait rien a la situation etant donne que les gens ne les utilisent pas toujours et qu'il ne prevoit pas d'augmentation du nombre de conducteurs en etat d'ebriete. A I'issue du vote, la proposition est adoptee. 89-761 COMMON COUNCIUREUNION DU CONS ElL MUNICIPAL MAY 26, 2003/LE 26 MAl 2003 21 (a) Municipal Plan Amendment, (b) Re-Zoning Portion Of New Brunswick Southern Railwav Corridor The Assistant Common Clerk advised that the necessary advertising was completed with regard to (a) a proposed Municipal Plan amendment to redesignate on Schedule 2-A, from Low Density Residential to Heavy Industrial classification, a portion of the New Brunswick Southern Railway Corridor, extending from west of the Greenhead Road Overpass to McKiel Street, having an area of approximately 1 hectare (2.5 acres), also identified as being a portion of PID Numbers 55109813 and 00036657, and (b) the proposed re-zoning of a portion of the same parcel of land, having an area of approximately 0.9 hectares (2.2 acres), from "RM-1" Three Storey Multiple Residential and "R-2" One and Two Family Residential to "1-1" Light Industrial classification, to recognize the existing use as a railway corridor and to permit construction of a service road parallel to the rail line, as requested by New Brunswick Southern Railway Company Limited under lease from Saint John & Marine Railway Company, and 21 (d) two written objections were received in this regard. 21 (c) Consideration was also given to a report from the Planning Advisory Committee submitting a copy of Planning staff's report and two letters and a petition against the proposed amendments considered by the Committee at its May 21,2003 meeting at which the Committee decided to recommend approval of the proposal as set out in the staff recommendation, with an additional suggested Section 39 condition that would limit the location of the proposed industrial service road to the north side of the railway tracks; and recommending that (1) Common Council redesignate on Schedule 2- A of the Municipal Development Plan, from Low Density Residential to Heavy Industrial classification, a portion of the New Brunswick Southern Railway Corridor as described above; (2) Common Council re-zone the portion of the same parcel of land as described above, from "RM-1" Three Storey Multiple Residential and "R-2" One and Two Family Residential to "1-1" Light Industrial classification; and (3) pursuant to Section 39 of the Community Planning Act, the proposed development of an industrial service road on the parcel of land identified as a portion of the New Brunswick Southern Railway Corridor, extending from west of the Greenhead Road Overpass to McKiel Street, having an area of approximately 0.9 hectares (2.2 acres), also identified as being a portion of PID Numbers 55109813 and 00036657, be subject to the following conditions: (a) the use of the re-zoned area shall be limited to the proposed industrial service road and the existing railway line; (b) location, design and construction of the proposed industrial service road must be in accordance with a detailed plan and engineering study, prepared on the proponent's behalf by a registered professional engineer and subject to the approval of the Chief City Engineer, indicating the location of all piped services and the proposed measures to ensure that such piped services are adequately protected; (c) the proposed industrial service road shall not be used for the transport of gravel or other aggregate material from the Bald Hill quarry, other than that which may be required for construction projects within the adjacent lands designated Heavy Industrial on Schedule 2-A of the Municipal Plan, located between Main Street West and the Saint John River; (d) the proposed industrial service road must be paved or otherwise maintained with an all-weather dust-free surface of sufficient strength to carry imposed loads; (e) prior to commencing construction of the proposed industrial service road, the owner of the property must convey to the City any easements that, in the opinion of the Chief City Engineer, are necessary to permit the City to maintain the existing piped services; and (f) the proposed industrial service road must be located entirely on the north side of the existing railway tracks; and further that, upon the re-zoning of the area, the land and any building or structure thereon must be developed and used in conformity with the proposal and conditions identified herein. Robert Ouellette of 148 Busby Street, appearing in opposition to the proposal, asked if the proposed service road would be open for the use of chip trucks en route to the Irving Pulp mill entering from the Reversing Falls side. Ronald Ouellette of 146 Busby Street, speaking in opposition to the application, noted the location of his home approximately seventy-five feet away from the railway track, expressing concern regarding an increase in the already-high noise level; and asked how the road would be policed to prevent trespassers. As to the concern regarding chip trucks, Mr. Turner advised that it was not the intent for the service road to be used as second entrance for these vehicles, and also that New Brunswick Southern Railway would be policing the road and the applicant was looking into the possibility of installing a privacy fence or a landscape barrier as a solution to the noise level concern; and indicated that he would be meeting tomorrow with residents in the area to discuss any concerns they may have.
