1997-06-02_Minutes 86-432 COMMON COUNCIL JUNE 2, 1997 At a meeting of the Common Council, held at the City Hall in the City of Saint John, on Monday, the second day of June, A.D. 1997, at 4:00 o'clock p.m. present Shirley McAlary, Mayor Councillors Arthurs, Ball, Brown, Chase, Fitzpatrick, Knibb, Trites, Vincent and Waldschutz - and - Messrs. 1. Totten, City Manager; J. Nugent, City Solicitor; D. Wilson, Commissioner of Finance; C. Robichaud, Commissioner of Municipal Operations; J. C. MacKinnon, Commissioner of Environment and Development Services; J. Baird, Manager of Community Planning; W. Edwards, Building Inspector; B. Fillmore, Assistant Deputy Chief of Police; Mrs. M. Munford, Common Clerk; and Ms. C. Joyce, Assistant Common Clerk. 1. MeetinQ Called To Order Mayor McAlary called the special meeting to order, and Reverend Tim Davidson of the Saint John Vineyard Church offered the opening prayer. 2. Crane Mountain Landfill Site Leachate Treatment Consideration was given to a report from the City Manager further to Council's consideration at its April 28 meeting of a letter from Gemtec Limited with regard to the request of the Fundy Region Solid Waste Commission for the City of Saint John to accept pre-treated leachate from the Crane Mountain landfill operation for final treatment at the City's Lancaster wastewater treatment plant, recommending that the City enter into an agreement with the Fundy Region Solid Waste Commission to accept pre-treated leachate at the Lancaster wastewater treatment plant for up to five (5) years, subject to terms and conditions to be determined. The Mayor advised of the need to delete the words "up to" from the above recommendation in order for the Department of Environment to accept the resolution. On motion of Councillor Knibb Seconded by Councillor Waldschutz RESOLVED that as recommended by the City Manager, the City enter into an agreement with the Fundy Region Solid Waste Commission to accept pre-treated leachate at the Lancaster wastewater treatment plant for five (5) years, subject to terms and conditions to be determined. (Councillor Ball entered the meeting.) Mr. Totten noted the approach taken by staff in hiring Crandall Engineering Ltd., the firm which originally designed the Lancaster lagoon, to prepare a technical evaluation of the Commission's proposal to the City, and the recommendation to enter into a five-year agreement to accept pre-treated leachate from the Crane Mountain site, under certain terms and conditions. Councillor Vincent, in noting the presence at the meeting of representatives from Gemtec Limited, asked if they were eligible to answer questions, to which the Mayor replied that, in order to do so, a motion of Council and eight affirmative votes would be necessary. 86-433 COMMON COUNCIL JUNE 2, 1997 On motion of Councillor Trites Seconded by Councillor Knibb RESOLVED that representatives of Gemtec Limited be invited to respond to questions in the above regard at this time. Question being taken, the motion was carried. During discussion Councillor Vincent referenced the discussion at the last meeting at which time it was felt that Council could delay a decision on the above matter until June 9 in that, while the Commission could proceed with drawing up and calling its tender, it would not award the tender until after June 9; and expressed the understanding that this was perhaps not completely correct as the Commission could not draw up, let alone award, the tender until it has a place to direct the leachate. Councillor Vincent, having directed questions on this matter to Mr. Lutes of Gemtec Limited and Mr. Robichaud, questioned the City of Saint John's involvement in this issue not knowing the Town of Grand Bay's decision on accepting the pre-treated leachate; advised that, as there was no information provided to give him assurance, his position had not changed and he would not be supporting the motion. The Mayor confirmed that, following the last Council meeting, it was determined that it was necessary for the Commission to have this issue brought forward as soon as possible because it was not able to call for proposals for any construction at the site until it met all of the thirteen conditions set out by the Minister of the Environment, one of which was the placement of leachate for five years. (Councillor Fitzpatrick entered the meeting during the above discussion.) Question being taken, the motion was carried with Councillor Vincent voting "nay". 3. Contract 97-4: Phase VI Closure Spruce Lake Landfill On motion of Councillor Knibb Seconded by Councillor Trites RESOLVED that as recommended by the City Manager, Contract 97-4: Phase VI Closure - Spruce Lake Landfill, be awarded to the low tenderer, Galbraith Construction Ltd., at the tendered price of $524,322, as calculated based upon estimated quantities, and the Mayor and Common Clerk be authorized to execute the necessary contract documents.
